My wife and I ran into some trouble with CPS about 2 years ago. Our children were removed by a bully of a CPS agent while I was in San Francisco CA as an over the road tractor trailer driver (we live in upstate NY). Our two children were put in foster care for three months and were then returned to us. Our case is now closed and I wanted to ask a question… My youngest broke her arm while in foster care, do we have a legal case against CPS and NY’s foster care system? I asked a few different lawyers this same question and they either said “no, I’m sorry but CPS can not be sued†or “CPS is designed to help children who NEED their help and in situations where they make mistakes the law provides them an escape rout that prevents them from having to be accountable†some simply gave me the run around. Could you please give me some feedback?

Erik, most lawyers won’t consider a CPS related case. Maybe they’re on the system’s payroll one way or another, and you waste your time trying to get them to help you. The responses you quoted are LAME and EVASIVE. I think you just asked the wrong lawyers for help.
Instead, why not try going to the courthouse and looking at other cases filed against the Department of Social Services. Also try courthouses in nearby counties. And try the federal courthouse. All these types of cases are public so you can ask to look at them and write down the names of the lawyers who fight CPS in court.
Choose a lawyer from another county than the one you want to sue, if possible. Once you know which lawyers go up against CPS you’ll have a better chance of getting someone to consider your case.
In most states CPS can be sued - and I know of cases in NY state. You may have to file in Federal Court on Constitutional Law issues.

My boyfriend and I got involved with C.P.S, due to a girl who was 15 at the time decided to call and make a report of false information. She stated that my son was beaten by his father, while her mother and I was in Florida on vacation. Came home to my “friend” the mother of the 15yr old girl, taking my son to children’s hospital. There they (c.p.s) placed a hold on my son from there it lead to my son who’s only 2 at the time being adopted. All due to a 15yr old girl making false accusations. I believe that the mother of the 15yr old coached her into doing this. Now my family is torn apart, because C.P.S believed a 15yr old girl. From there C.P.S made up the rest of the lies! They do nothing but LIE, LIE, LIE!

We ( me and my boyfriend Kevin Krantz) have been having some problems with the cps (child protective service). It all started when we came here from Louisiana and our son came early (August 3,2007). He was at 30 weeks when he was born. I was sick with bronchitis at the time and coughing alot, which was what the doctor said caused it. I tested positive for THC (marijuana) in my urine which they took out of my catheter without my permission. My dad died back at the first part of June (June 6) and I took a couple of puffs off of a joint, not knowing I was pregnant at the time. I didn’t find out I was until the first part of July (July 9). At about 11pm that night 2 cps agents showed up (Mr. Ruben Villegas and a Ms. Theresa Julio). They asked me all kinds of questions, which I answered. Telling about what had happened. They asked if I would be willing to take a urine and hair test, and have Justin (5 almost 6) tested as well. I said yes to mine, and I reluctantly said yes to Justin’s, figuring I had no choice. They told me I had 45 days to go to take the tests, even gave me a safety plan saying this. Then they asked if they could interview Justin, to which I said yes. Which is in the safety plan also. Next Mr. Villegas came and talked to Kevin telling him the same things, wanting him to take the same tests, which he agreed to. Mr. Villegas gave him the same amount of days to do his as he had given me for mine. Also telling Kevin that I had admitted to smoking two joints a day since I was 16, and that is not what I told him. I told him that I had smoked two joints a day since I was 16, but only until I got pregnant with Justin. He did his interview with Justin that same day saying that he could not certify Justin’s interview because he had no clue what was going on. He also interviewed Kevin’s dad (Ron Krantz), and took some pictures of Justin and Kevin. When I got out of the hospital (5th) he said that they had made a mistake in giving the 45 days, and started pushing for us to take the tests sooner. He also asked for the number for my middle child’s adoptive parents, telling me that Kevin said he had the number, which he didn’t have or say. I want to know what the adoption has to do with anything, we did that for the benefit of her and Justin because we couldn’t support two kids at the time. He called me on August 9th leaving me a voicemail stating that if I didn’t take myself and Justin for the drug tests by the following Tuesday, which was supposed to be a voluntary, that they would have to remove Justin from my home. I had already called my sister (Angela Brenden) and asked her to come get Justin for a little while, to put him in school and try to keep him out of some of this mess. Cause it is my felling that my son is an exceptional kid who is oblivious to what is going on, and I don’t want him to be messed up by all of this, which I told Mr. Villegas. On the 10th my sister arrived to get Justin, and she took him that day to get his drug screens. The lady at the testing place said that they couldn’t test him, saying that he was too young for the urine test (had to be 10) and that his hair was too short for the hair test, that it would irritate his scalp( was the same length when he was interviewed by Mr. Villegas). She called his supervisor and told he that they couldn’t. So because they wouldn’t do it we called Mr. Villegas’ supervisor (Aurora Acosta); he was out of the office that day; and asked what we needed to do. She said that we needed to come into the office and sign some paperwork so Angela could take Justin with her and that they could do the testing in Nebraska. So we went to the office, and he tells me that I needed to sign this paper voluntarily placing Justin outside of my home that they would do a background check on Angela and let us know Monday or Tuesday if she could take him with her. I refused to sign the paper without it saying that he was to go only to Angela. In which ended up in a argument with him and his supervisor, because they said that since they had decided to place Justin if we (me & Justin) didn’t go for our tests they were going to remove him from the home the night before. But Justin went that day and I still had the weekend and two days to go for mine. Mr. Villegas also tried to make what I was doing as me just trying to make it easier on myself. So we stepped outside of his office, and they ran their checks on Angela. Then we went back in his office and he told us that the police check came back with nothing, but they still had to wait till probably Mon. or Tues. for the cps check to come back (still trying to get me to sign the paper). And yet again we ended up in a fight with Mr. Villegas, because he started threatening me, telling me that when Truman’s drug test came back that the safety plan would change. Come to find out they already got Trumans’ urine test back and it was negative, so they asked for a stool sample test. Asking me if I made the decision to send Justin because I was worried about his drug tests. If I was worried about his test why would I have had Angela take him to get his tests the day before he was suppose to leave. Then in the next breath he started to tell me that he had no intentions of taking my kids, that he new I was a good mom, stating that he knew this from meeting Justin and from what the nurses at the hospital had said about how me and Kevin was with Truman. Next he started telling us about a case he had where the people tested positive for cocaine and they had done everything they were suppose to and said that he was about to close their case. He even went so far as to tell me that if he took them that it would be too much paperwork for him and showed us the case file where he had removed the kids. So I decided not to send him with the promise from Mr. Villegas that Justin would never see him again unless by chance he was around when he need to talk to me or Kevin. We did ask him to finish his checks though. Then we left the office and went home. He called on Tuesday and told me and my voicemail that Angela was cleared ( still trying to get me to sign that paper). I went that day and took my drug tests. The next Monday he started calling Kevin’s job asking them to have him call him pushing for him to take his. I called him a little after that trying to find out what the next step was, and he told me that he hadn’t got the results of my screens back yet, that he would let me know in a couple days, and that Kevin needed to take his test by Monday of next week. Now Kevin is a truck driver and doesn’t know where he is going to be from one day to the next, so how is he going to commit to that. He also stated that after he got mine and Kevin’s tests that he was probably going to refer us to a sap (substance abuse professional). I found out the next day that Truman’s stool sample came back positive. Also that them taking the urine the way they did was illegal, and that cps gets paid for every child they place in foster care.
Any advise?????????????????

Jessica, I suggest you register at the message board where you can get ideas on how to deal with this from other parents going through the system: Fight CPS Message Board.
I read your entire post and think it is terrible that they would threaten to take children over a marijuana issue but I’ve seen this kind of thing happen many times over the years. I hope that you get to keep your kids and that you never use marijuana again while you’re raising them because the kids are so much more important. So long as CPS pursues this issue, it isn’t safe to use while parenting.
How could Kevin be a truck driver and marijuana user? Don’t the trucking companies do drug testing? (I know they do, because my boyfriend is a truck driver.) So I don’t see CPS’s point in getting more testing done for Kevin. That’s just abusive on the part of CPS… and there’s no court order in place forcing this issue.
You see, that’s the thing that confuses me. They have you running scared, trying to do everything they ask because you’re afraid they’ll take your kids. But there’s no court order! The kids are not in any immediate danger! And they can’t take kids that aren’t in immediate danger unless they have a court order to do so.
I can’t advise you as I’m not an attorney; it would be best if you could get one now to be an intermediary between you and CPS. Sometimes a good attorney is the best thing, to discourage them from harassing you further.

On Feb 15, at about 4 pm, I got a call at work that my 6 week old baby had stopped breathing. So, of course I started driving like a mad man to get home, just like most dads would do. All the while I was praying and trying to contact someone on the phone. My girlfriend came on the line crying and said they were at the hospital. I raced up there and saw the doctor trying to keep my baby alive. Then, two Bakersfield detectives walked up and said they needed to talk to us. So, I went into a room with them . I told them I don’t know what going on that I was at work Then she went into the room with the detective. I then called my sister and she was crying while saying that she was trying to keep the cops from taking my 10, 7, and 5 year girls to Jamenson Center. I told her I would be right there. I ran out, got in my car, and headed to my house. The detective called me a few minutes after leaving the hospital and told me to get back to the hospital, “NOW!” he said. I informed him that I was going to my house. He told me again to get back here, “NOW!.” I said, “#### you” and hung up the phone. He called again and said get back here, “NOW!”. I said, “NO!” and that I was going to my house. He then told me to get to the hospital or to the house. He followed with, “anywhere there are cops.”
I parked my truck down at my brother’s house and walked down to my house. Approaching my house, I found my kids standing out front in the cold and wind with their aunt. The detective made them stand outside for several hours. My 5 year had been sick and I asked several times if I could walk down to my brother house with her. My sister asked if she could take the girls to her house, around the corner, because it felt as though the 5 year old was getting warm with fever. She offered to have an officer follow her so he could make sure her house was clean or whatever. She just wanted to get my girls out of the cold and get some tylenol for my 5 year old. The detective would not let us in the house to get anything. He also would not let my sister take the girls to her house and take care of my sick child. They made her wait another 3 to 4 hours before going to the Jaminson Center with a police escort. When my sister went inside with the girls crying hysterically, she asked the person at the window for some tylenol because my 5 year old felt so hot. They took her temperature and it was at 103 degrees. At which time the Center would not except my 5 year old without a medical clearance. So, my sister took her to KMC (the only place the cop would let her take her), again escorted by the police. The police sat with my daughter and sister until 1 am and escorted them back to the Jaminson Center again. Meanwhile…
After the detective sent my sister to take my girls to the police station, as she pullled away, a cop grab my arm and told me on the ground. So, I let them handcuff me. They put me in the back of the cop car and pulled the car right in front of my house . You could hear the cops laughing and having a good time. The whole time I am sitting in the back of a cop car like I did something wrong. I sat and watched everyone stare as the drove by, all I could think about is my baby boy and my three girls. It was about 1 and 1/2 hours later when we finally headed to the police station. When we got there they put me in a small room and cuff me to the wall. I asked why they were doing this to me and they told me that my girlfriend just killed my baby. I knew that wasn’t true, she loved that baby way to much. They questioned me a long while before cutting me lose. I walked out of the station alone, they arrested my girl friend, and took my kids.
I had a friend come and get me. I got home and called the hospital. They said I needed to come to Madera, which was over 100 miles away. I went and got my car from my brother. As I was talking with everyone, I found out that the detective was telling everybody that it was shaking-baby syndrome. As I left my house, I was pulled over and my car was impounded. I called a friend and he brought over a truck for me to drive. I drove up to the hospital. Frist, I had to talk to a cps worker. She said I could see my baby, but my girlfriend had a stay away order. I am not a cry baby, but I could stop crying in this case. I talked to the doctor. The doctor informed me that he was breathing on his own, but it doesn’t look good. I said to the doctor, “it wasn’t shaking baby syndrome, right?” The doctor informed me that there was no wrong doing. Relieved about that, I went and bailed my girlfriend out of jail. The first thing she ask is, “how is the baby?” I had to tell her, “not good.” . We went back to the hospital to see the baby and we were in there for about 10 minutes, when the staff told me that I could stay, but my girlfriend would have to leave because Kern County has a stay away order on her. She was crying and ask why, the baby needs me. We both felt that if the baby was going to make it, he needed his mother, his only comfort zone. She has never left his side since he was born. They wouldn’t let her stay. Two hours after they kicked my girlfriend out of the room, he stop breathing on his own. My opinion is that he heard his mom’s voice, felt her touch, and smelled her smell and when it was gone again, he just gave up.
Now, I have lost my baby and CPS has my three girls.The DA didn’t pick up the charges the detectives arested my girl friend for.They was just trying to make a crime out out of it. Bakersfield finest .So no charges against me or my girlfriend and cps still won’t give my kids back to me.

Ted this is horrible I hope you and your girlfriend get your three girls very soon, this is just another sad event on behalf of law enforcement and cps. I hope you sue them, because no body deserves this kind of treatment, you might be right about your son not making it because they kept him from his mom. My son was in foster care they returned him right away because he was not eating even though he was still getting my breastmilk, he probaly just want to be in my arms, just as your baby wanted to be in his mothers arms. When is the department going to realize that most children are better off without cps involement or I should say care.

My daughter was illegally removed and we were separated based on lies a pot smoking cocaine addicted alchoholic woman who did not want her own children told that i was prostituting my daughter and putting her on drugs while i did it.I,until i get a lawyer who will take the case,not allowed near my daughter,I am considered a danger to her and she”s in states hidding.While this has gone on my identity was stolen,II was followed,warned Iwas followed and told over and over you can not fight the system.Still want to sue the Child C.P.S. and Texas for emotional damages to my daughter and I,for a letter this womans son wrote from teaching how to steal the inside ,homes,vehicles ect…San Antonio Law would not even acknowledge my legal report.

820.21. (a) Notwithstanding any other provision of the law, the
civil immunity of juvenile court social workers, child protection
workers, and other public employees authorized to initiate or conduct
investigations or proceedings pursuant to Chapter 2 (commencing with
Section 200) of Part 1 of Division 2 of the Welfare and Institutions
Code shall not extend to any of the following, if committed with
malice:
(1) Perjury.
(2) Fabrication of evidence.
(3) Failure to disclose known exculpatory evidence.
(4) Obtaining testimony by duress, as defined in Section 1569 of
the Civil Code, fraud, as defined in either Section 1572 or Section
1573 of the Civil Code, or undue influence, as defined in Section
1575 of the Civil Code.
(b) As used in this section, “malice” means conduct that is
intended by the person described in subdivision (a) to cause injury
to the plaintiff or despicable conduct that is carried on by the
person described in subdivision (a) with a willful and conscious
disregard of the rights or safety of others.

Summary:
I am Aviva Yehudit Bat Ya’akov, daughter of a Polish holocaust survivor. Despite financial and health challenges, I have raised my only child as a Jew. He was taken from me 7/10/08 by DCFS on false allegations. Immediately notified county we are observant Jews; called for help to Chabad and Jewish Family Services. My worker at JFS is Ms. Alexander, I assume a Jew; we have no trouble communicating despite my hearing impairment, we use live relay (assistive technology). My worker at the county is Mr. Dario, a Catholic. Dario refuses to use relay or email. Dario disregarded written requests made in July for a Jewish home and placed my son at Trinity, where foster family takes him to Catholic mass. When I called Trinity in protest, they claimed Dario told them we are “non practicing.” I told Dario less than two weeks ago that I cannot meet on Saturday because I do not drive on the Jewish Sabbath.I have made an issue of not calling child on Saturdays until after dark; County dictated calls be made “at 6:30 pm every day.”
On or about 9.11.08, my child ate ham for the first time in his life. This resulted in intestinal distress that lasted for at least 48 hours and was documented at a hearing before Commissioner Trendacosta at Edelman Childrens Court on 9.12.08. Minor child requested through counsel, Sheila Youngberg 1. to return to mother; 2. to return to CAVA Charter School; 3. to have only kosher food; 4. to be placed in a Jewish home; 5. to be allowed to attend high holy services this month with mother. The judge ordered the following: 1. kosher food; 2. Jewish placement and did not rule on the education issue (2) or the worship issue (5) in violation of the child’s civil rights.
Parent independently prepared and will be filing an Extraordinary Writ in the California Court of Appeal, Third Appellate District, Division Two Monday September 15, 2008, in accordance with local rules that require me to file within 7 days of the ruling I want to contest, Monday is the fourth day. Issue of the Extraordinary writ is SCHOOL PLACEMENT (child attending Rivera Middle School against my wishes and against his own wishes).
Timeline:
Late February 2008, my child goes to LAPD after a scuffle following a routine argument about routine chores. Tells LAPD he wants to be emancipated. He was 12. LAPD thinks he wants out of my home permanently, notifies DCFS.
March 2008-Zadik Shapiro, Esq. assumes formal representation of me and sends letter to county counsel notifying them all communication to cease with me and go directly to him. Workers ignore this agreement for five months, continue to call and leave notes on my door.
7/10/08-child snatched by DCFS, after police take him with no warrant; child is placed in PALMDALE, CA with single Latina mom and 5-6 other children. Sandra Amana was foster #1. Nueva was first foster agency. Only justification given is “scratches on face” presumed to be parent inflicted (child reported they were self-inflicted due to sunburn.) This single allegation used for months to monitor our calls, our mail, our 1:1 meetings and to limit contact to 3 hours per week, monitored, and to prevent him from homeschooling with charter school under my supervision, despite extremely high test scores on the STAR 2008.
7/10/08-LAPD spends 45 minutes trying to break down my front door with battering ram “because we do not have cell phones and cannot accept relay calls in the field.” Holguin made similar comment, but she had a cell. LAPD did not accept for 2-3 hours that I am hearing impaired.
7/10/08–DMH Holguin does 5150, refuses to show county issued ID; tells me I am “paranoid” for asking for ID at the door, then asks if I am “gravely ill.” I show her lease and paid utility bills, discuss benefits I already receive. She then decides I am manic.
Asked for a concrete example of my mania she observed, she stated, “You said you are going to sue child services. That is CRAZY. You can’t sue child services, nobody can sue child services.”
7/10/08-Holguin refuses to listen to my explanation and refuses to take copy of my audiology report with her. When done with discussion re mania, Holguin states, “I think homeschooling is a bad idea. Your son belongs in public school. I am gonna take him and put him in a foster home.” Holguin’s boss is Linda Boyd. LA Dept. of Mental Health. I ask her to leave. She refuses until I move toward the phone to call 911.
7/10/08-language form signed, DCFS agrees in writing to communicate with me by relay (written language).
7/11/08-Bramachari Lee (monastic at SRF Palisades) confirms he supervised child for one week at sleepover camp during week ending 5 days before DCFS snatched child. Lee informed DCFS (Marcelino) he witnessed child scratching facial SUNBURN. Marcelino left this out of the report.
7/15/08-detention hearing. County counsel (Leftwich) lies to Commissioner Trendacosta about “scratches” “general neglect” and “mental illness” as well as “educational neglect.” Child testifies through counsel he has never been abused, I have never taken pills. I also deny abuse. Neither I nor child are allowed to speak directly.
Trendacosta issues minute order to detain child.
7/18/08-Los Angeles Department of Mental Health doctor Alvaro Campos declares I have no psychosis; am suffering from “stress related to custody battle” and issues related to my audiological condition, CAPD and hyperacusis. Letter faxed to county, which insists I still have untreated mental illness; ignores hearing impairment.
7/22/08-David Myers, DCFS ER CSW tells Rebbitzin Miriam Ferris at Chabad that my request for Jewish home is being denied. No reason given. Case transferred away from Myers to Ngo/del Rio. (No county caseworker yet assigned is a Jew).
7/23/08-I call Shorena Alexander, ASW and Debbie Fox at JFS and request Jewish foster home.
7/27/08-child transferred from Palmdale to East LA, (after hitting incident) to Latino foster #2 (Rodeglio and Anna Hernandez), no active proselytizing. Child tells me Rodeglio Hernandez is former teacher. I find written evidence in the form of a legal document from the East Coast that someone with SAME NAME, (Rodelgio Hernandez), race, age and general description was convicted of abusing teenage boys on the east coast and report foster family #2 (dad fit description and was described by my son as “former teacher.”) to the child abuse hotline.
7/27/08-08/01/08-DCFS (Franco) investigates Rodeglio Hernandez of Maywood. Maywood Police investigate as well (while denying to me child is there). Nueva sends 7 day notice to LA County that child cannot remain with Hernandez family “due to mother’s harassing reports.” Again request for Jewish home is made by me, to Ngo/del Rio. Am told by County (Ngo) County will cooperate with JFS. They do not.
7/28/08-child notifies his counsel independently that: 1. he wants to go home; 2. he wants to go to charter school.
8/8/8-California court of appeal issues pro homeschooling ruling in Jonathan, another dependency case pending in LA, I think I have stronger case.
8/12/08-Meet with Rabbi Dennis Brown (Chabad Betzalel, also runs Ness Counseling Ctr) re case and parenting class, tell him whole story, DCFS (del Rio) referred to Brown. Attend Rabbi Brown’s rap group for two weeks. Brown warns me new change in worker coming.
8/19/08-case transferred to Perez/Dario. Dario is Catholic.
9/1/08-notified Dario that child exercising right through his own attorney to attend home school, through his counsel, Sheila Youngberg, Esq., appointed by county.
9/1/08-Brown tells me story about Jewish mother who put her kid up for adoption b/c she could not handle him, he was also reporting her (like my son), he goes along with adoption, seems troubled; I stop seeing Brown, complete online parenting class instead,
9/2/08-child moved to foster home #3 in Pico Rivera, to Catholic Family (Rocio and Ernesto Tapia) that is actively proselytizing by taking my son to mass. Also pushing public school. Did not assume it was the foster parents’ idea this time, called their agency (Trinity) and spoke to social worker (use of proper channels, no dumping on the wrong people).
9/5/08-Pellerin advised the court to give my son back in 2 days “under county jurisdiction.†Meaning CATHOLIC jurisdiction? I told the county workers I already have JEWISH services and they have ignored me. My lawyer (name withheld per her request) says County workers have authority, JFS has zero authority. We have private services and a Jewish social worker. Services being forced on me are either duplicative or unnecessary and not wanted.
9/8/08-I requested of Trinity that they give 7 day notice to the county that the current placement (#3) is inappropriate b/c it violates kinship & community and is in East LA, I live a few miles from West LA and spend all my time there. Dario’s number at the county is 213.639.4677, and his Supervisor is Hanh Perez. 213.639.4243. They are located at the 3075 Wilshire Blvd. office. The court investigator is Melanie Pellerin, same building, her report is on file with the Edelman Childrens’ Court, my case docket number is on fightcps.com along with more names and numbers, look at September guestbook for 2008. 9/9/08-Called Trinity social worker (Palacio) to ask her why they are taking Jewish kid to church. Trinity says “the county” (Dario) had told them we were not practicing; they apologized and said they would take action. Palacio is at 626.625.7028.
9/10/08-I file EEOC charges against three agencies LAPD, DMH and DCFS for failure to use assistive technology in an emergency situation, directly and proximately causing emotional distress, etc., violations of the Unruh Act. EEOC promises to prepare complaints (relay conversation). Can be confirmed by Robert Hammock and at 213.439.6724 or robert.hammock@dfeh.ca.gov.
9/11/08-county’s secret §301 offer to return child back to me on condition of continuing County jurisdiction REJECTED. Offer included dismissal of physical abuse and mental health counts, county threatens to keep child in custody and “add new counts” if I do not agree.
9/12/08-trial previously scheduled at Edelman Childrens’ Court (a Division of Los Angles County Superior Court) for this day (was first on docket) now continued until 10/15/08, for no apparent good reason. Two of the lawyers, the child and me are Jewish. High Holy days are not over until October 10th. This could be reason for delay. Judge grants our request for jewish home, kosher food, no prosteylization, and orders DCFS to communicate with me by email as an ADA accommodation. Education, worship, monitoring remain unchanged.
9/15/08-parent files extraordinary writ and notices Edelman of intent to do so.
10/15/08-new trial date

I understand the extreme importance of the abuse by government in the area of Child Protective Services. I must ask is there a site that also includes Disabled and Vulnerable Adults.
The abuse is throughout the government services agencies and no one is ever really held to account.
There should be all out assault in the media about (Especially Washington) about Child and Adult Protective services.
The agencies who are supposed to over see any wrong doing. The complaint resolution Dept. The state Ombudsman office who are accountable to NO ONE by LAW.
We have suffered with a Elder abuse situation that has opened my eyes to all the business of these Social Workers and Agencies who are there to help. They will lie, be deceitful and try and turn it around on you. So we all should be concerned about all these agencies who destroy Thousands of lives just here in Washington. John, sorry I don’t know of any sites that deal with the problem of abusive social services intrusions into the lives of disabled and senior citizens, though I’m well aware of them. As I understand it, APS (Adult Protective Services) has been known to incarcerate elders in nursing homes, confiscating their real estate, ostensibly to pay for unwanted, forced “services”.
I agree with you that there should be an all-out assault in the media about APS and CPS. People affected should write letters to newspaper editors, articles, op-eds, etc. on a consistent basis to let people know of their suffering.

I stumbled upon this site as I was searching for information on what can be done when you feel an injustice has been dealt you by a system that is supposed to protect you.
I am a disabled woman who lost custody of my children years ago. The charges against me were that I was emotionally abusing my children by being overly protective of them.
My ex husbands parents were found guilty of molesting my children and I wrote a letter to the DA a year and a half later asking why no one had ever been arrested for the crime. Within two months of writing that letter my children were taken from me and placed back in the home of the paternal grandparents who were child molesters.
I have never seen any justice from this event and it has devestated my life. I lost everything in the process of this and to this day nobody has ever been held accountable.
Because of my income status I cannot get anyone to help me. Now so many years have passed that I can’t do anything to help my children and sometimes wondered whether or not it was just an isolated incident. But, I don’t think it is and I think something should be done about it. How can we change the rules so that no one system has such ultimate power to ruin another person’s life so tragically?

EXTREMELY IMPORTANT/TIME SENSITIVE!! (not sure where to post this at this website)–
Before April 1st, this Wednesday, please send a brief email in support of Oregon’s HB 2897 which asks the House to give more consideration to relatives when placing children who are in foster care.
Of course, this encouragement of kinship care is stated in the DHS manual, but in actuality DHS hardly ever follows the policy.
Less than 3% of the time, DHS places a child with their kin in Oregon, among the lowest percentages in the country. This, in despite of the fact that relatives undergo the same background screening as that of foster parents, turn out to be record-free, and yet are eliminated by DHS for placement of their related children in foster care.
It’s too late for so many of Oregon’s families. Let’s make it so that families come first in Oregon, not last. Families count!!

The C.P.S. workers mislead the court at the shelter hearing fabricating a case by making false statement of police report without having the actual police report in court just their version of it . And misquoting people they questioned while investigating case and using Adams past drug problem against him.
At the advice of council with State of Oregon approval Adam quit his job and moved to California January 28th of this year. Adam and Trinity are now living with us here in California.
Adam was recently hired by Food Max the only one hired out of 723 people interviewed.
The state of Oregon is still threatening to take our granddaughter away not only from Adam but from all of her family here in California can you help us?

I would expect the judge to encourage the state to reach some sort of agreement with us and the agreement might include a bit more than just the tests.
Some of what I’ll lay on the table will include the state’s latest pleading which says how well Trinity is doing and what a good dad Adam is. Also, I’ll present some letters and a police report saying they detected no intoxication and didn’t observe anything they’d consider mental illness. I do hope to prevail on this.

Hi, my husband and I have been fighting CPS since October 3, 2008. When cps first came out to my home that day it was to inform me that while my children where at their fathers home that week he had spanked them and left bruises on them. Well cps removed my three kids from my husband and me that day because when they came out we where in the middle of cleaning our home, they said we neglected the kids because the home was not completely clean when they got there. They charged my ex husband with abuse by exsevice corpal punishment, but guess what they gave two of my children to him and my oldest that does not belong to him is still in a girls home in another county. I can only see my kids twice a month for one hour each time.Also, my ex who physically abused me and was found guilty in court, has to supervise my visit with my boys, a police officer testified for me as being a wonderful mother and he would let me watch his children any time but it didn’t help my case. I was ordered to take parenting classes along with my ex. I took the classes but he has not, he was suppost to have taken them by January 18, 2009, I also had to take a crazy test, which cps keeps saying that they have not gotten the results back yet, I took this test in January,2009. I am also having to take a support group for non offenders because my daughter was raped last summer, but I can’t take that until my daughter has a forinsic test done which cps don’t no if they want her to take it or not but tells me that if I don’t take the class it will be held against me. Ok, the Judge told my ex he could not spank my boys any more, well a couple of weeks ago, my boys told cps their daddy is still hitting them, well cps is not going to do any thing about it because, the judge did not put it in writing. CPS tells me now that it may be October before we go back to court. My kids cry wanting to come home, they have to be pulled off of me when they have to leave. They are depressed over all this. Their gaurdian ad litem is not there for them, and my court appointed lawyer is just as bad, her specialty is in real estate, she shows up late for court which gets the judge mad at me, she want return my calls. I have called the state on CPS, news channel 7, everybody I can think of. I don’t know what else to do. Any advice would be greatly apprecatied.

NEVER NEVER let an angency in your home without a warrant. ESPECIALLY if you Have NOTHING to hide. Be nice and ask them if they have a warrant. Let them know you will cooperate fully if they have a warrant. Let them know you will answer any pertinent questions received by the postal mail, no telephone calls. AND never never let them talk to your children without YOUR LAWYER present.
If you need to you can place a special “NO TRESPASS” sign on your property that prohibits corporate agents from entering.
They will send you lots of scary letters and give you pamphlets that try to scare you into giving them information to make a case against you. Talk with them as little as possible unless you are recording the conversation or it is in writing, because they will twist everything you say that is not documented in writing. BE VERY cooperative in a SMART and compliant way. DO Not be stupid and think they want to help you. It is always about the money!

Heather, if you’re about to have a TPR trial it is nearly too late… it is easier to help when people find this board early on and start collecting and developing evidence and paperwork in their favor. Do what you can with the time you have left. I’m so sorry they are hurting your family this way!!!

3. They used spy cameras in my place.
4. I gave up my parental rights to CPS.
5. Friends told me to quit coming by.
