My wife and I ran into some trouble with CPS about 2 years ago. Our children were removed by a bully of a CPS agent while I was in San Francisco CA as an over the road tractor trailer driver (we live in upstate NY). Our two children were put in foster care for three months and were then returned to us. Our case is now closed and I wanted to ask a question… My youngest broke her arm while in foster care, do we have a legal case against CPS and NY’s foster care system? I asked a few different lawyers this same question and they either said “no, I’m sorry but CPS can not be sued” or “CPS is designed to help children who NEED their help and in situations where they make mistakes the law provides them an escape rout that prevents them from having to be accountable” some simply gave me the run around. Could you please give me some feedback?

Erik, most lawyers won’t consider a CPS related case. Maybe they’re on the system’s payroll one way or another, and you waste your time trying to get them to help you. The responses you quoted are LAME and EVASIVE. I think you just asked the wrong lawyers for help.
Instead, why not try going to the courthouse and looking at other cases filed against the Department of Social Services. Also try courthouses in nearby counties. And try the federal courthouse. All these types of cases are public so you can ask to look at them and write down the names of the lawyers who fight CPS in court.
Choose a lawyer from another county than the one you want to sue, if possible. Once you know which lawyers go up against CPS you’ll have a better chance of getting someone to consider your case.
In most states CPS can be sued - and I know of cases in NY state. You may have to file in Federal Court on Constitutional Law issues.

My boyfriend and I got involved with C.P.S, due to a girl who was 15 at the time decided to call and make a report of false information. She stated that my son was beaten by his father, while her mother and I was in Florida on vacation. Came home to my “friend” the mother of the 15yr old girl, taking my son to children’s hospital. There they (c.p.s) placed a hold on my son from there it lead to my son who’s only 2 at the time being adopted. All due to a 15yr old girl making false accusations. I believe that the mother of the 15yr old coached her into doing this. Now my family is torn apart, because C.P.S believed a 15yr old girl. From there C.P.S made up the rest of the lies! They do nothing but LIE, LIE, LIE!

We ( me and my boyfriend Kevin Krantz) have been having some problems with the cps (child protective service). It all started when we came here from Louisiana and our son came early (August 3,2007). He was at 30 weeks when he was born. I was sick with bronchitis at the time and coughing alot, which was what the doctor said caused it. I tested positive for THC (marijuana) in my urine which they took out of my catheter without my permission. My dad died back at the first part of June (June 6) and I took a couple of puffs off of a joint, not knowing I was pregnant at the time. I didn’t find out I was until the first part of July (July 9). At about 11pm that night 2 cps agents showed up (Mr. Ruben Villegas and a Ms. Theresa Julio). They asked me all kinds of questions, which I answered. Telling about what had happened. They asked if I would be willing to take a urine and hair test, and have Justin (5 almost 6) tested as well. I said yes to mine, and I reluctantly said yes to Justin’s, figuring I had no choice. They told me I had 45 days to go to take the tests, even gave me a safety plan saying this. Then they asked if they could interview Justin, to which I said yes. Which is in the safety plan also. Next Mr. Villegas came and talked to Kevin telling him the same things, wanting him to take the same tests, which he agreed to. Mr. Villegas gave him the same amount of days to do his as he had given me for mine. Also telling Kevin that I had admitted to smoking two joints a day since I was 16, and that is not what I told him. I told him that I had smoked two joints a day since I was 16, but only until I got pregnant with Justin. He did his interview with Justin that same day saying that he could not certify Justin’s interview because he had no clue what was going on. He also interviewed Kevin’s dad (Ron Krantz), and took some pictures of Justin and Kevin. When I got out of the hospital (5th) he said that they had made a mistake in giving the 45 days, and started pushing for us to take the tests sooner. He also asked for the number for my middle child’s adoptive parents, telling me that Kevin said he had the number, which he didn’t have or say. I want to know what the adoption has to do with anything, we did that for the benefit of her and Justin because we couldn’t support two kids at the time. He called me on August 9th leaving me a voicemail stating that if I didn’t take myself and Justin for the drug tests by the following Tuesday, which was supposed to be a voluntary, that they would have to remove Justin from my home. I had already called my sister (Angela Brenden) and asked her to come get Justin for a little while, to put him in school and try to keep him out of some of this mess. Cause it is my felling that my son is an exceptional kid who is oblivious to what is going on, and I don’t want him to be messed up by all of this, which I told Mr. Villegas. On the 10th my sister arrived to get Justin, and she took him that day to get his drug screens. The lady at the testing place said that they couldn’t test him, saying that he was too young for the urine test (had to be 10) and that his hair was too short for the hair test, that it would irritate his scalp( was the same length when he was interviewed by Mr. Villegas). She called his supervisor and told he that they couldn’t. So because they wouldn’t do it we called Mr. Villegas’ supervisor (Aurora Acosta); he was out of the office that day; and asked what we needed to do. She said that we needed to come into the office and sign some paperwork so Angela could take Justin with her and that they could do the testing in Nebraska. So we went to the office, and he tells me that I needed to sign this paper voluntarily placing Justin outside of my home that they would do a background check on Angela and let us know Monday or Tuesday if she could take him with her. I refused to sign the paper without it saying that he was to go only to Angela. In which ended up in a argument with him and his supervisor, because they said that since they had decided to place Justin if we (me & Justin) didn’t go for our tests they were going to remove him from the home the night before. But Justin went that day and I still had the weekend and two days to go for mine. Mr. Villegas also tried to make what I was doing as me just trying to make it easier on myself. So we stepped outside of his office, and they ran their checks on Angela. Then we went back in his office and he told us that the police check came back with nothing, but they still had to wait till probably Mon. or Tues. for the cps check to come back (still trying to get me to sign the paper). And yet again we ended up in a fight with Mr. Villegas, because he started threatening me, telling me that when Truman’s drug test came back that the safety plan would change. Come to find out they already got Trumans’ urine test back and it was negative, so they asked for a stool sample test. Asking me if I made the decision to send Justin because I was worried about his drug tests. If I was worried about his test why would I have had Angela take him to get his tests the day before he was suppose to leave. Then in the next breath he started to tell me that he had no intentions of taking my kids, that he new I was a good mom, stating that he knew this from meeting Justin and from what the nurses at the hospital had said about how me and Kevin was with Truman. Next he started telling us about a case he had where the people tested positive for cocaine and they had done everything they were suppose to and said that he was about to close their case. He even went so far as to tell me that if he took them that it would be too much paperwork for him and showed us the case file where he had removed the kids. So I decided not to send him with the promise from Mr. Villegas that Justin would never see him again unless by chance he was around when he need to talk to me or Kevin. We did ask him to finish his checks though. Then we left the office and went home. He called on Tuesday and told me and my voicemail that Angela was cleared ( still trying to get me to sign that paper). I went that day and took my drug tests. The next Monday he started calling Kevin’s job asking them to have him call him pushing for him to take his. I called him a little after that trying to find out what the next step was, and he told me that he hadn’t got the results of my screens back yet, that he would let me know in a couple days, and that Kevin needed to take his test by Monday of next week. Now Kevin is a truck driver and doesn’t know where he is going to be from one day to the next, so how is he going to commit to that. He also stated that after he got mine and Kevin’s tests that he was probably going to refer us to a sap (substance abuse professional). I found out the next day that Truman’s stool sample came back positive. Also that them taking the urine the way they did was illegal, and that cps gets paid for every child they place in foster care.
Any advise?????????????????

Jessica, I suggest you register at the message board where you can get ideas on how to deal with this from other parents going through the system: Fight CPS Message Board.
I read your entire post and think it is terrible that they would threaten to take children over a marijuana issue but I’ve seen this kind of thing happen many times over the years. I hope that you get to keep your kids and that you never use marijuana again while you’re raising them because the kids are so much more important. So long as CPS pursues this issue, it isn’t safe to use while parenting.
How could Kevin be a truck driver and marijuana user? Don’t the trucking companies do drug testing? (I know they do, because my boyfriend is a truck driver.) So I don’t see CPS’s point in getting more testing done for Kevin. That’s just abusive on the part of CPS… and there’s no court order in place forcing this issue.
You see, that’s the thing that confuses me. They have you running scared, trying to do everything they ask because you’re afraid they’ll take your kids. But there’s no court order! The kids are not in any immediate danger! And they can’t take kids that aren’t in immediate danger unless they have a court order to do so.
I can’t advise you as I’m not an attorney; it would be best if you could get one now to be an intermediary between you and CPS. Sometimes a good attorney is the best thing, to discourage them from harassing you further.

On Feb 15, at about 4 pm, I got a call at work that my 6 week old baby had stopped breathing. So, of course I started driving like a mad man to get home, just like most dads would do. All the while I was praying and trying to contact someone on the phone. My girlfriend came on the line crying and said they were at the hospital. I raced up there and saw the doctor trying to keep my baby alive. Then, two Bakersfield detectives walked up and said they needed to talk to us. So, I went into a room with them . I told them I don’t know what going on that I was at work Then she went into the room with the detective. I then called my sister and she was crying while saying that she was trying to keep the cops from taking my 10, 7, and 5 year girls to Jamenson Center. I told her I would be right there. I ran out, got in my car, and headed to my house. The detective called me a few minutes after leaving the hospital and told me to get back to the hospital, “NOW!” he said. I informed him that I was going to my house. He told me again to get back here, “NOW!.” I said, “#### you” and hung up the phone. He called again and said get back here, “NOW!”. I said, “NO!” and that I was going to my house. He then told me to get to the hospital or to the house. He followed with, “anywhere there are cops.”
I parked my truck down at my brother’s house and walked down to my house. Approaching my house, I found my kids standing out front in the cold and wind with their aunt. The detective made them stand outside for several hours. My 5 year had been sick and I asked several times if I could walk down to my brother house with her. My sister asked if she could take the girls to her house, around the corner, because it felt as though the 5 year old was getting warm with fever. She offered to have an officer follow her so he could make sure her house was clean or whatever. She just wanted to get my girls out of the cold and get some tylenol for my 5 year old. The detective would not let us in the house to get anything. He also would not let my sister take the girls to her house and take care of my sick child. They made her wait another 3 to 4 hours before going to the Jaminson Center with a police escort. When my sister went inside with the girls crying hysterically, she asked the person at the window for some tylenol because my 5 year old felt so hot. They took her temperature and it was at 103 degrees. At which time the Center would not except my 5 year old without a medical clearance. So, my sister took her to KMC (the only place the cop would let her take her), again escorted by the police. The police sat with my daughter and sister until 1 am and escorted them back to the Jaminson Center again. Meanwhile…
After the detective sent my sister to take my girls to the police station, as she pullled away, a cop grab my arm and told me on the ground. So, I let them handcuff me. They put me in the back of the cop car and pulled the car right in front of my house . You could hear the cops laughing and having a good time. The whole time I am sitting in the back of a cop car like I did something wrong. I sat and watched everyone stare as the drove by, all I could think about is my baby boy and my three girls. It was about 1 and 1/2 hours later when we finally headed to the police station. When we got there they put me in a small room and cuff me to the wall. I asked why they were doing this to me and they told me that my girlfriend just killed my baby. I knew that wasn’t true, she loved that baby way to much. They questioned me a long while before cutting me lose. I walked out of the station alone, they arrested my girl friend, and took my kids.
I had a friend come and get me. I got home and called the hospital. They said I needed to come to Madera, which was over 100 miles away. I went and got my car from my brother. As I was talking with everyone, I found out that the detective was telling everybody that it was shaking-baby syndrome. As I left my house, I was pulled over and my car was impounded. I called a friend and he brought over a truck for me to drive. I drove up to the hospital. Frist, I had to talk to a cps worker. She said I could see my baby, but my girlfriend had a stay away order. I am not a cry baby, but I could stop crying in this case. I talked to the doctor. The doctor informed me that he was breathing on his own, but it doesn’t look good. I said to the doctor, “it wasn’t shaking baby syndrome, right?” The doctor informed me that there was no wrong doing. Relieved about that, I went and bailed my girlfriend out of jail. The first thing she ask is, “how is the baby?” I had to tell her, “not good.” . We went back to the hospital to see the baby and we were in there for about 10 minutes, when the staff told me that I could stay, but my girlfriend would have to leave because Kern County has a stay away order on her. She was crying and ask why, the baby needs me. We both felt that if the baby was going to make it, he needed his mother, his only comfort zone. She has never left his side since he was born. They wouldn’t let her stay. Two hours after they kicked my girlfriend out of the room, he stop breathing on his own. My opinion is that he heard his mom’s voice, felt her touch, and smelled her smell and when it was gone again, he just gave up.
Now, I have lost my baby and CPS has my three girls.The DA didn’t pick up the charges the detectives arested my girl friend for.They was just trying to make a crime out out of it. Bakersfield finest .So no charges against me or my girlfriend and cps still won’t give my kids back to me.

Ted this is horrible I hope you and your girlfriend get your three girls very soon, this is just another sad event on behalf of law enforcement and cps. I hope you sue them, because no body deserves this kind of treatment, you might be right about your son not making it because they kept him from his mom. My son was in foster care they returned him right away because he was not eating even though he was still getting my breastmilk, he probaly just want to be in my arms, just as your baby wanted to be in his mothers arms. When is the department going to realize that most children are better off without cps involement or I should say care.

My daughter was illegally removed and we were separated based on lies a pot smoking cocaine addicted alchoholic woman who did not want her own children told that i was prostituting my daughter and putting her on drugs while i did it.I,until i get a lawyer who will take the case,not allowed near my daughter,I am considered a danger to her and she”s in states hidding.While this has gone on my identity was stolen,II was followed,warned Iwas followed and told over and over you can not fight the system.Still want to sue the Child C.P.S. and Texas for emotional damages to my daughter and I,for a letter this womans son wrote from teaching how to steal the inside ,homes,vehicles ect…San Antonio Law would not even acknowledge my legal report.

820.21. (a) Notwithstanding any other provision of the law, the
civil immunity of juvenile court social workers, child protection
workers, and other public employees authorized to initiate or conduct
investigations or proceedings pursuant to Chapter 2 (commencing with
Section 200) of Part 1 of Division 2 of the Welfare and Institutions
Code shall not extend to any of the following, if committed with
malice:
(1) Perjury.
(2) Fabrication of evidence.
(3) Failure to disclose known exculpatory evidence.
(4) Obtaining testimony by duress, as defined in Section 1569 of
the Civil Code, fraud, as defined in either Section 1572 or Section
1573 of the Civil Code, or undue influence, as defined in Section
1575 of the Civil Code.
(b) As used in this section, “malice” means conduct that is
intended by the person described in subdivision (a) to cause injury
to the plaintiff or despicable conduct that is carried on by the
person described in subdivision (a) with a willful and conscious
disregard of the rights or safety of others.
