Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.

Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.

Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.

Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.

Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.

CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.

Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.

It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Join a Massive Writing Campaign: CPS Caseworkers Should Be Tested

I just got an email from Cindy (last name withheld) who subscribed by email to this site’s blog postings. She read my last post - the one about parents and drugs, and had this question, “…Don’t you think it is time that we mandate random drug screening for all CPS workers and contractors?”

That’s so true, Cindy. It is LONG past time. And I believe we can do something about this.

CPS caseworkers and social workers DO need to be tested for drugs. They also need psychological testing. They need to be screened for past legal offenses. They also need to be licensed.

Who agrees with that?

So here’s what we can do. Let’s go to work writing letters to our state legislators asking them to introduce legislation requiring that all CPS employees having any contact with children be investigated for past legal problems, psychologically tested, drug tested regularly, and licensed.

Let’s tell our state legislators that we’ve been victims of bad social workers who should be screened out if they have psychological or drug problems. Any social worker or caseworker that lies in a report to the court is obviously mentally unstable. These people should be weeded out of the social services jobs, just as we wouldn’t want unstable people getting law enforcement jobs.

Tell your state legislators to read the comments on the guestbook pages here on Fight CPS so they can see what a huge problem false accusations are. Nobody tells it better than the hundreds of people who come to this site due to victimization by bad social services agents.

Any suggestions or comments on this writing campaign are welcome.

If you write a letter to your state legislators, you’re welcome to post a copy of it here in the comments section.

Keep it brief and to the point. Your legislators are more likely to read a short letter than one that is many pages long.

LET’S KEEP THE HEAT ON THEM until something is done about this travesty of unstable and incompetent social services caseworkers. Only our state legislators can help us on this one. I’ll remember to bring it up from time to time and hope that many of you will get positive responses from your state legislators that you can share with us.

Dangerous Federal Legislation: “The Mother’s Act” HR 20

I received notification of this in email today (Thanks Charlie Wittman!)

YOUR URGENT ACTION IS NEEDED on a bill quickly moving through Congress called “The Mother’s Act” (H.R. 20) that calls for pregnant women to be screened for mental disorders and new mothers to be screened for “postpartum depression,” resulting in their being prescribed dangerous antidepressants or other psychiatric drugs. A Senate Bill and a House Bill were introduced this year. The House Bill is right now in the Energy and Commerce Committee and a vote is expected within days, whereupon it will go to the House floor next week. The bill provides more appropriations for NIH to conduct research into “postpartum depression” and biological treatments (drugs).

To protest this bill, write to your legislator.

I see this as a way to implement The New Freedom Act, forcing psychological testing on all women who become mothers in the USA. CPS workers will probably have access to these screening results and children will most likely be taken from parents either on the basis of screening results, or because mothers decide not to take medications prescribed as a result of these tests. This act opens the way to massive abuse of child-bearing women in the United States, and their children. Please urge your federal legislators to vote against this bill.

Texas: Katie Wernecke and Family Are Suing CPS, Six Social Workers, Nueces County, and Two Deputies

Katie Wernecke, 14, was taken from her family by CPS two years ago, not because she was being abused or neglected, but because CPS agents and doctors didn’t agree with her parents’ decisions regarding her cancer treatment. At the age of 12 Katie, a resident of Agua Dulce, Texas, had Hodgkin’s disease. Her parents sought an alternative treatment for her. That right was denied to them.

CPS took Katie Wernecke from her family and forced her to undergo court ordered medical treatments. A judge allowed her to go home in November 2005, and though the family is grateful to have been reunited they believe their Constitutional Rights were violated. The lawsuit, filed by a Frisco, Texas attorney, is based on violations of the Fourth and Fourteenth Amendments to the US Constitution.

The Fourth Amendment protects citizens from unreasonable search and seizure. CPS child detentions are considered a seizure. The Fourteenth Amendment protects property and legal rights, and ensures that citizens have due process rights.

Many people have sued CPS in Federal Courts based on the violation of these Constitutional Rights.

The Fourth Amendment to the US Constitution:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The Fourteenth Amendment to the US Constitution:

Section. 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section. 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.

Section. 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Section. 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Section. 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

Kentucky: The Truth Comes Out

Sadistic and criminal aren’t words usually associated with social workers. But they come to mind while reading the results of a yearlong investigation into a Kentucky child-protection bureaucracy that was allowed to go rogue.

Social workers gave each other nicknames like “The Queen of Removal” and “Terminator” and laughed as they stripped children from their parents.

Workers and supervisors lied and falsified documents to cover up their misconduct and misled an accrediting agency. Those who protested or tried to report the abuses were targeted for retaliation, while some of those responsible were rewarded.

Not all, or even most, of the social workers in the eight-county Lincoln Trail area, based in Elizabethtown, are guilty of the abuses of government power detailed by Inspector General Robert J. Benvenuti III.

And such abuses are not confined to Lincoln Trail.

But that’s not much consolation.

It underlines the “luck of the draw” quality of life-changing decisions being made about children and their families. “Kentucky’s Other Lottery” is the apt title of the report by child advocates that launched the Inspector General’s investigation.

The good news is that the scathing review was commissioned by the state Cabinet for Health and Family Services, which administers Lincoln Trail and the rest of Kentucky’s community-based services offices.

If the cabinet is willing to air its nasty linen, maybe it will also deal aggressively with the problems the report revealed. A lot of people are watching to see how the cabinet responds.

Kentucky’s social workers expose themselves daily to great danger for little pay while making difficult judgment calls on which the safety and well-being of children hinge.

Social worker Boni Frederick was killed last year while supervising an in-home visit between a foster child and his biological mother.

No one is criticizing the judgment calls required in the course of a day’s work. But what developed within Lincoln Trail was pernicious and rotten — an “attitude of supremacy” toward clients and the public, according to the IG’s report.

The report identified 13 possible criminal violations that were turned over to a local prosecutor, along with various violations of cabinet policy.

The inspector general also issued a list of recommendations, some of which would require legislation and some of which the cabinet could accomplish by itself.

A blue-ribbon task force was already at work on reforms aimed at correcting abuses in the processes for terminating parental rights and adoption.

But no amount of legislation or reorganization can clean out all the rottenness that this investigation exposed.

The responsible parties should be held accountable.
