Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.
Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Fighting Child Protective Services False Accusations

The UN Treaty on Children’s Rights seems to be designed to destroy parental rights. According to Michael Farris, chairman/lawyer of HSLDA, the Home School Legal Defense Association, the Obama administration may seal our fate by accepting this treaty, giving more rights to children than to parents. When all parental decisions are subject to being reviewed by the state, we may be prevented from homeschooling, training our children in our religion of choice, or discipline. I can already imagine kids (especially teenagers) using this treaty to complain about being grounded or otherwise disciplined.
HSLDA is a Christian homeschooling organization. Though I’ve never been a Christian, HSLDA won a place in my heart for pursuing limitations on CPS investigators’ actions, forcing them to honor our 4th Amendment rights. HSLDA also recommends and pursues independent homeschooling rights which are vital to the well-being of the homeschooling movement, because independent homeschooling allows children to learn in freedom rather than be molded into conformity by state government school laws. Conformity destroys initiative, innovation, and imagination.
This treaty has already been accepted by every country in the UN except the United States and Somalia.
Michael Farris is also the president of ParentalRights.Org, where an article lists Twenty Things You Need To Know about the UN Convention on the Rights of the Child (UNCRC or simply, CRC.)

A New York based advocacy group called Children’s Rights is suing the state of Michigan in federal court on behalf of 19,000 foster children who may be endangered by maltreatment in the foster care system.
The Michigan Department of Human Services refused to provide documentation on sixty-seven foster children who died in state care there since 2004. At least three of those children were killed in state licensed foster homes. Circumstances regarding the other deaths are unclear as the state refuses to release records.
At a hearing on Tuesday, August 7, 2007 U.S. District Judge Nancy G. Edmunds ruled that an expert must be hired to assess the Michigan foster care system’s adequacy. The expert, Christopher Baird of the Children’s Research Center, will study 460 random Michigan foster care files
Judge Edmunds also ordered the state to release certain foster care documents by August 31, 2007.

In Orange County a mother has been awarded 4.9 million dollars in a case against CPS caseworkers and the Department of Social Services.
The mother, Deanna Fogarty-Hardwick, who lives in Seal Beach, claimed that CPS workers took her two young daughters in February 2000, and ‘intentionally misinformed the court’. The children were 9 and 6 at the time.
The kids were place in Orangewood Children’s Home for a month, then in a foster home for two months. After that they were placed with their father for two years. The parents now have joint custody.
Caseworkers failed to inform the court that the children were emotionally distressed by being separated from their parents, and refused to place them with relatives, whose Kinship Care rights should have been honored.
Jurors in this case wanted to send a message to social workers by awarding such a large amount of money to the mother.
The Director of Social Services was surprised, saying that he cannot recall ever seeing such a large settlement award (4.9 million dollars) but stated also that the caseworkers named in the lawsuit will keep their jobs, and that he supports their decisions.

Some might think a couple who adopted eleven children out of foster care were philanthropists, but when you realize they got adoption subsidy payments of $4256 per month, it is hard to see mere kindness as a motive. And with so many children, a Norwalk, Ohio couple apparently didn’t know what to do, like the old lady in the shoe. So they kept some of the kids in cages made of wire and wood.
Last March a judge decided to terminate their rights to all eleven children, ages 2 to 15, after he determined that at least eight of them had been abused in the Gravelle home.
According to an Associated Press article dated February 15, 2007, Michael Gravelle said, “What do you do with these kids?” He said he prayed for an answer and built cages at the suggestion of social workers. His wife, Susan Gravelle, said the children were never confined as punishment. She claimed the cages were there to protect them. She said one of the children wanted to jump from a second-story window.
Two of the eleven children wrote statements that were read in court. A boy wrote about how grateful he was for his new fosterers. “Because of them I don’t have to steal food,” he said. “I can use the bathroom whenever I want. Never again will I have to sleep in a box.”
A girl’s statement read, “Mom, you walked around like you were God, then whenever you did go places you were Mother Teresa taking in the poor black kids that no one wanted.” She also said that the Gravelles “are grown adults who know the difference between right and wrong. So I ask that they get as much time in jail for as long as my siblings had to be in cages.”
A social worker and others testifying for the Gravelles said the children’s behavior improved because of the cages, which were painted bright red and blue, but the sheriff said the cages were urine stained and lacked pillows and mattresses. One boy claimed to have lived confined to a bathroom for 81 days, and an expert for the defense claimed this imprisonment helped the child.
In any case, the decision has been made. The Gravelles have sentenced to two years in prison because they adopted so many “special needs” children, that even with $4256 in adoption subsidy payments every month, they didn’t know what to do. Michael Gravelle said when they got into foster-adopting they felt “led by the Lord”. Perhaps if they hadn’t adopted so many kids, it wouldn’t have led to this.

If you’re a parent living in the USA with young children, and if you don’t know what the Fourth Amendment is, please pay attention. This information could save your family.
The Fourth Amendment states that government workers can’t enter your home without your permission, unless they have a warrant based on ‘probable cause’.
Here’s the exact text of the Fourth Amendment:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
It has been established that this protection applies to Child Protective Services (CPS) caseworkers just as it applies to law enforcement officers. Despite the clear text of this section of the Bill of Rights, many caseworkers still think they can force parents to allow them into their homes.
Recently, near the end of January 2007, a child protection caseworker showed up at the door of a Michigan homeschooling family. She would not read a paper the mother handed her regarding her rights, and yelled at the mother, insisting that she should be allowed to enter immediately to do a “strip search” of one of the children. She was basing her intrusion on an anonymous tip stating that the children listened only to Christian music, that they “ate their cheerios dry”, that their only socialization was through the church, and that the mother pinched and hit her children in church to keep them quiet.
Since when is listening to Christian music or socializing in church a form of child neglect? And eating dry cheerios - is that a crime? If the caseworker had kept her complaint to ‘pinching and hitting’ she wouldn’t have lost her credibility and we wouldn’t be laughing at her now. However remember, this was all based on an anonymous tip, and who knows what the motivation of that phone call might have been?
The mother contacted an attorney, Chris Klicka, of the Home School Legal Defense Association (HSLDA). He sent the caseworker a letter regarding her rude and unprofessional behavior toward the family. He noted that she obviously hadn’t received the social worker training in the Fourth Amendment. A year and a half earlier HSLDA helped pass a law in that state which requires all caseworkers to be trained in their “duty to protect both statutory and constitutional rights of those being investigated.” Klicka also informed the caseworker that she would be held liable for violating the family’s civil rights.
Meanwhile the mother responded to the investigation by getting a statement from her children’s doctor indicating that her children were not abused. She also got letters from people who stated that they were good parents to their children.
The caseworker continued to try to interview the children and strip search them, and threatened to get a court order to do so. Klicka informed her that she had no ‘probable cause’ for a warrant because anonymous tips don’t qualify as credible evidence. The caseworker insisted she would get a court order, but instead, a few days later she contacted the family saying she would drop the case.
I guess she finally figured out what the Fourth Amendment was, and what ‘probable cause’ meant.
HSLDA, the Home School Legal Defense Association, serves mostly homeschooling Christians, but will provide legal defense for any homeschooler regardless of religion, so long as the dues are paid. This defense extends to homeschooling families facing accusations and investigations from Child Protective Services. HSLDA lawyers have been instrumental in going to court for homeschooling families with CPS problems, and have managed to establish very positive case law protecting anyone facing false accusations of abuse. For that, HSLDA lawyers should be praised by all families, forever.
