Child Protective Services laws and agencies are abusive to families and children. This site provides support and information to parents falsely accused of child abuse by Child Protective Services.
FightCPS does not advocate or condone violence or illiegal activities of any kind.
FightCPS is intended to help people learn enough about the law to be able to successfully defend themselves and their families against false accusations using legal documents and strategies that put parents in a stronger position when they go back to court.
For more information, see the FAQ.
Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.
Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.
Site mission: To provide information and support for families attacked by Child Protective Services and child welfare agents, especially those families facing false or trivial accusations of child abuse or neglect; and for researchers working to protect natural family rights.

Fighting Child Protective Services False Accusations

August 23, 2010
I just read the website of a woman running for office here in California. There was nothing, and I mean nothing whatsoever, to indicate her position on child welfare issues.
That’s probably the case with most candidates here in the USA. Though child welfare injustice is one of the BIGGEST and MOST IMPORTANT issues in this country, considering the suffering and injustice, few have the integrity to talk about it and try to do something to end the horror that is being inflicted on American families.
I vow today to never vote for a candidate who isn’t brave and truthful enough to stand in favor of ending child welfare injustice. Anyone who isn’t trying to help families isn’t man or woman enough to get my vote. Avoidance of this issue is simply unacceptable.
How about YOU? Are you going to vote for spineless clowns? How about all those incumbents who couldn’t be bothered to help you in your time of need?
Here’s what I wrote to the woman’s campaign team:
“I don’t see anything on _____’s website to indicate that she has any empathetic understanding of the needs of the poor and downtrodden. She certainly hasn’t been there or done that. And there’s nothing to state how she feels about the child welfare disaster. See http://www.fightcps.com — millions of families destroyed without benefit of constitutional protections, and it seems she just doesn’t care. And what about the state sovereignty movement? How does she feel about the USA’s tenth amendment being grievously violated? This is 2010, way beyond 1984. We need leaders who are aware of the real issues and willing to do something about them. Please tell me what _____ plans to do to help victims of unjust, evil, corrupt, unconstitutional child welfare laws.”
Co-workers in the child welfare protest, victims of child “protection” agencies, please take time, from now until November, to visit sites of candidates running for office in your areas, to write to them, to let them know how you feel about child welfare issues.
These people have got to wake up, and WE THE PEOPLE need to let them know that upholders of injustice are not respectable enough to get our votes.
“All that is necessary for evil to triumph is for good men to do nothing.”
Candidates: If you’re worthy of leadership, show us.

I’m glad you brought this subject up Linda. Several weeks ago I was at Karen Handel’s website, she was running for Govenor of Georgia, and I didn’t find anything at her site about this issue. So I sent an email. Although mine wasn’t laid out as nicely as yours I plainly asked what her views were on the subject. I wondered if I would get a response and doubted I would. I did though, several responses. Each one wanted me to contribute to her campaign in some way and the issue was never addressed.
Here is something else we don’t really want to think about but I believe it is important and please remember, not every foster/adopt person is a bad person okay? We know that many of them are though and yes many do this for monthly checks. I wonder if anyone has ever thought about, what if, and it could happen, but what if Due To the shape of our economy, the federal government stops the monthly adoption checks? The group I just mentioned, those who do it for the money, what will become of the children they have adopted?
If anyone in Georgia would like to attend an in person meeting please email me asap. There are two of us gathering as many as we can together to meet within the next two weeks for our first meeting. Also If you are from any other state I strongly encourage others to try and set up something as well. I don’t think just one state will make the difference since it is happening nationwide. We need to band together and put our ideas out on the table. It’s time to move on it, for some of you ‘again’ and that’s another reason why we need to try different avenues. I really don’t think it needs to be put off much longer as the situation as is can only get worse. As you meet, whether on line or in person, keep in mind there are many different players and CPS are not the only ones that we are up against.
I consider this an urgent issue and yes it should be the most important issue facing American families today. I believe once everyones eyes are opened to this travesty and they realize that ‘It could be them next’ then it WILL be the most important issue facing American families today. Families filled with American Voters!
Thank you,
Callie Thornton

Thank you for your challenge to any and all readers to confront the candidates for any office with this question. I did that very thing with one particular candidate before our state’s primary election. I was both surprised and gratified to hear back from her that she is very aware and concerned and has a definite “plan of attack” on the problem–one that makes sense. She, like most citizens, was unaware of the extent and depths of the horrors of the system until she had numerous conversations with someone she worked with who had first-hand experience.
Sadly, any other candidates or current office holders we have contacted at either the state or local level have not responded at all. As far as I am concerned, they can all start looking for new jobs!

Linda ,very briefly, were do we look for candidates lists (if any) perhaps with the Secretary of State for the State level? I vouch to contact 20 of such candidates in the month of September . Milos

The big coverup! It hasn’t changed and never will because those in authority care more for their paychecks then those of the children whose lives are being ruined. My life was ruined by CPS and JILL JOHNSON , Riverside County California. I will always hold hatred in my heart for her. She is a liar and is dishonest with the system!
Comment by Bebe — August 29, 2010 @ 9:25 am
Amazing how much bad karma those CPS workers are bringing on themselves!
Comment by Linda Martin — August 29, 2010 @ 1:47 pm
Bebe, we are in San Bernardino County. I do not know that it is possible to say one county is any worse than another, but I can tell you the lying, corruption, and denial of justice is really bad here. There are more people in the system here who have angered, dismayed, and yes, betrayed us than I can even count. The pain seems like it will never be diminished. My heart goes out to you.
We do not personally know any of the other families in our area who have been through the hellish ordeal of this system. I don’t have a clue how to get connected with any others to have any meetings or conversations. Does anyone have a suggestion?
Comment by Linda D. — August 30, 2010 @ 8:20 am
Linda, you could place an ad in the shopping newspaper to find other victims of CPS in your area. Rather than include your phone number you could get voice mail or a gmail type email address to put in the ad.
Comment by Linda Martin — August 30, 2010 @ 9:44 pm
Well if it doesn’t beat all! Check out the email I recieved from Karen Handle (see my post above), Now this is the web page version but the email had my name under (first name)
Dear [[First Name]],
Steve and I so appreciate your calls, emails and letters. A close loss is always tough, but your kind words and uplifting messages brought smiles to our faces. We took a few days to catch our breath, get some much needed rest, and just reconnect with each other.
As we look back over the course of the campaign, we have absolutely no regrets. We truly gave it our all – just as we know all of you did. Going forward, I hope that you will focus on what was achieved.
While this campaign was never about gender, we did put a big crack in Georgia’s political glass ceiling. For the first time, a female candidate of any party made a run-off for Governor. We took on the establishment and called for a new way of doing things – with comprehensive ethics reform, smaller state government, meaningful tax reform, and a 21st Century strategy for jobs and education. We came so very close, and THAT is something in which we can all take great pride.
Many of you have asked me what is next. I’m going to take to the next few months to focus on that. However, I can assure you that I will remain involved in the political arena. The stakes are simply too high to stay on the sidelines.
I don’t know what path I will take, or where I will be called to serve. But before I can look ahead, I must call on my friends one last time. As we close down our campaign, we do have some minimal debt to take care of.
Our campaign never had the benefit of being the most well-funded. Ours was a grassroots operation of individuals like you who only wanted to see good government, a change to the same old way of doing things, and real leadership. Can I call on you one last time to make a donation to cover our last remaining campaign expenses? Any amount will help us close down our campaign and begin moving forward.
Thank you again for your incredible support and confidence – in me and in our campaign. When this campaign was launched, we all knew it was a very large mountain to climb. While we fell just short of the summit, there will be another day for me and for us, and with your help we can close out this chapter and move forward. Please make a donation today so we can do that.
Words cannot convey just how much your support and friendship have meant to Steve and me. We hold in our hearts the many wonderful memories from the campaign, and it’s your friendship that we will carry with us through the coming years. Hold your heads high and be proud of all that was achieved. We made history, but more importantly, together we had an impact! The future is bright and beckons all of us to our next challenge!
Sincerely,
Karen Handel

This ticked me off and I replied:
I have been finding these e-mails quite offensive. First of all, the only reason you people have my name and email address was because I emailed in with an extremely important question. One that if she had shown an interest in helping the MANY Georgians and MANY other parents and families throughout the nation, she may have won by a landslide! But she has worked close to Perdue in the past so maybe that was the reason she never replied.
I realize that these are form letters and no, I cannot and would not contribute to help her with her debt. There are thousands of us in Georgia who have something more important on our minds. We had just a slight bit of hope that maybe, just maybe, Karen Handel as Governor of the State of Georgia might have understood our pain and felt compassionate about our cause. This IS without a doubt, “THE MOST important issue facing American families today!”

Write letters to the Governor of your State,Senators,Congress. Give it two weeks and write and call intill you get a answer to your questions. Someone will call for you on your behalf. You always be honest with Someone who is willing to help you and your Children Case. You can always go above your case worker Supervisor. Go to the top of the Cake. That would be head of DCF in your State. Document all your visit with a camera/video camera. Put them on notice in writing that your Fourth Amendment right is to take pictures of childrens cuts, and bruises. And Make A dvd cd. Save it for Trial and send it to someone that is willing to help prove your Case. In the State of Florida It only takes $250.00 to file a lawsuit againt everyone involded in a childs removal.Your Children are well worth it! We all need to come together and fight these Wolves! Scott, actually, I agree with you. The federal legislators are almost ALL corrupted as soon as they get elected. That’s why I hope all INCUMBENTS will be voted out and new legislators elected – and if they’re LIBERTARIAN they will do something about CPS intrusions into people’s lives, because CPS is totally against Libertarian principles.
The best time to talk to politicians about CPS is BEFORE they get into office.
Comment by Linda Martin — September 3, 2010 @ 10:38 am
Linda,
I have been reading your website for a number of months now. My husband and I had sole legal custody of our grandson since 2003 and raised him from birth to eleven years of age and had legal guardianship of our granddaughter also since 2003 and raised her from one and a half to six years of age and the biological father of the grandson called DCFS with false allegations two years after he lost a custody petition in 2007. Long story short, we were “ousted” from the courtroom; it was turned into a custody case and our grandson is now in Indiana and our granddaughter is with her mother in the same city we are. I followed your advice about requesting a hearing and have gotten nowhere with that as “they” have never heard of that; never done that before! I have contacted our senator and he has not done anything constructive except to tell me that “I should write a law”. DCFS obtained a report from the custody evaluator who had not once, in four years ever mandate reported any abuse and her report did not contain any incidents of abuse but was “history” of over 25 years ago. The state’s own advocacy centers said that there was no abuse but the children were taken anyway! What can we do now? How do I go about getting that “hearing”??
Comment by Janet — September 7, 2010 @ 6:03 pm
Janet, this is complex; you might like to register at our message board and post in the Grandparents area…
The administrative hearing is for active cases; is this an active CPS case? Even with active cases they often require that one of the parents file, rather than the grandparents. CPS workers will claim they’ve never heard of administrative hearings, but if you go to the welfare department you can get the form… or write to the hearings department of the State Department of Social Services.
Comment by Linda Martin — September 8, 2010 @ 11:43 am
Linda,
Thanks for your response. No, this is no longer an active case. My purpose in obtaining a hearing is address the policies that DCFS did not adhere to and the federal mandates that were violated. I know that we are not going to get our grandchildren back but I want to STOP DCFS from doing this to other families! The frustration and heartache about what has happened to our grandchildren and our family is almost too much to bear and I have to do something!! Thanks for your help.
Comment by Janet — September 8, 2010 @ 4:56 pm
Janet, have you spoken with your state legislators to see if a law might be made to protect grandparent rights in your state?
Comment by Linda Martin — September 9, 2010 @ 10:40 am
Linda,
I have not done that specific thing but there are laws on the books for grandparent’s rights in my state of Louisiana but, this is so much more than grandparent’s rights!! I was informed by a very reliable source that more than half of the children removed from their homes is done because of a custody evaluator’s report and the law that I did “write” has to do with not allowing DCFS to obtain a custody evaluator’s report IF that evaluator has not been a mandatory reporter of any suspicions of abuse of the children involved prior to the report of allegations. The evaluator in our case had been in a partisan relationship with the biological father for over two years before she was re-ordered into the second custody petition filed in August of 2009. What do you think? –could the law for grandparents be that: after they have obtained sole legal custody of a child, that the custody should be permanent? I doubt that a proposal like that would make it as a law in this state but I will write my senator if you think it might be something worth persuing—let me know what you think or what you have heard from other grandparents who had custody of their grandchildren.

JUSTICE FOR FAMILIES AND CHILDREN
Comment by Deborah Young — September 10, 2010 @ 3:48 am
Janet, I don’t think you could use the word ‘permanent’ since circumstances sometimes change; however there should be a way to protect children from being taken from their grandparents.
A few years back there was a case here in California (Riverside County) in which the grandparents had kinship care of their 2yo very beautiful granddaughter. Then the parental rights were terminated for the 2 parents, and within a few days CPS caseworkers were at the door to take away the little girl, who was given to a lesbian couple to adopt and raise. The grandparents did everything they could to get their granddaughter back. As I recall, nothing worked. I am guessing that once the parents’ rights were ended the caseworkers no longer considered them to be grandparents.
Comment by Linda Martin — September 10, 2010 @ 1:38 pm
Linda,
The most tragic thing about out case is that we HAD legal custody and the biological father abandoned his parental rights by not establishing any relationship with our grandson—he saw him in Shreveport (where we live) only a handful of times in seven years!! The event that started all of the custody business was that we wanted to adopt out grandson so that legally we would be able to obtain VA monies for him through my husband’s VA status. THAT is when everything “hit the fan” so to speak and now our grandson is with this person four states away and we are not allowed to communicate with him at all!!
The child protection agencies do not seem to care about what “family” is all about when what they do and continue to get away with is their own form of “abuse” and it tears apart families deliberately.
I will continue to think about writing my state legislators about the grandparent issue.
Comment by Janet — September 10, 2010 @ 4:54 pm

NOW IS THE TIME FOR FAMILIES TO STICK TOGETHER AND DEMAND A HIGHER STANDARD!! I hope others will be inspired to get involved and write their government officials. My family is going through a CPS ordeal here in North East Texas. A good Attorney who will fight for you is an average of 10k..which we can’t afford to pay. Right now I am with a court appointed attorney. Please pray for my family that the truth will be revealed in our second court appearance on OCTOBER 6, 2010 and the children will be returned home.

Wow.
I am living in one of the most corrupt cities in the Country. Austin, Texas. My ex is multi millionaire that assaulted me in Jan 09. He was arrested and hired the OJ dream team. From there his case dismissed and then hired two of the largest legal firms to take my child. CPS was called out after the assault according to the police record. But no file found. I had a nervous breakdown after seven year of post divorce abuse, CPS was called out by him and I have no home, child, help, anything. These attorneys are on every non profit for battered women and family violence centers board and contributions and accolades. Its been 8 months since i have seen my girl. PAS

Jackie I am so sorry to hear about your ordeal. I have written every governor in the USA and the White House and the US Texas Reps along some various other people. You should do the same, it may help. I hope everyone who reads this will write letters to anyone whom they think will listen!! I encourage everyone to write letters to the editors of the major newspapers in the country and area wide newspapers where they live. If enough of us protest they can’t ignore us forever!! we have rights too!! Remember that the most powerful tools any person has is their voice and right to vote!!

I am going through a similar ordeal in which I was falsely accused. I lost my children. I have spent many thousands of dollars defending myself. Meanwhile my childrens psychological torture continues at the hands of these DHR bureaucrats. The judges, social workers and therapists sit around and gossip and snicker. All the while they are “looking out for the childs best interest.” May God require it of them soon. God Bless all of those whose families have been ripped apart by this system!

I truly feel for everyone going through this struggle with CPS. I never thought it would happen to me but I’m going through the exact same thing. My mother called CPS on my ex because she did not look healthy and was not taking the best care of her daughter. She thought they would help her, instead they jailed her for neglect, took her daughter, and took my son because they “did not want to separate them”. I was in Virginia in the Army and found out my child was in custody when I got out. It’s been five months and CPS has not returned my son and made false allegations that I “knew or reasonably should have known” about the neglect. I completely agree that WE THE PEOPLE need to stand up, exercise our Constitutional rights, expose the government for what they truly are, and appoint new officials to lead our country as the past ones have failed us. Individual citizens are vulnerable, though together, there is no power except GOD that can hold us down. It is time for a change and if it takes another American Revolution, then so be it!
Comment by Brandon — September 30, 2010 @ 2:14 am
Brandon it disgusts me that they would victimize you and your child like that for a lot of reasons! I agree that something needs to be done!! You are right that alone we will not win but together, we can be unstoppable!! All parents regardless should ban together to help stop the corruption. It will never stop until we do!!!! Lets start a nationwide petition to be taken to the White house or something!!
Comment by tara — September 30, 2010 @ 12:52 pm
I was seventeen years old when I first became aware of CPS. I had no clue what they did. My first impression was that they kidnapped my younger sister from school and did not tell her parent’s. That was over thirty years ago; that’s how long I’ve been trying to educate the public. Both the Republican and Democratic parties are to blame!

I have a long story but to put it short . I am a mother of 4 and cys has 3 of them my son is now with his dad so they couldn’t take him from us. But let me tell you what if it is not one thing it is another with those people . The reason the first took my one daughter out of my home was cause i pissed the case worker off and wouldn’t agreee to sighn for 6 more months and she stood in my house and said your forceing me to build a case against you and im takeing you down . Well she did she tried to say i was not medicating my daughter cause even after i told her she was not going into the doc app with me she threw a fit like a child and my mom said let her go . And if i wouldn’t have left her go in i wouldn’t be where i am now. Now i have none of my kids and there is no reason . Just went to court last month and still couldn’t have them back cause i moved not cause it was a medical reason cause that was not an issue cause they were wrong . But cause i moved from the house i was in for 4 years cause my landlord sold the house . Cys does not care there is so much more to my story and my kids are liveing in a kindship home with there dads family who they do not know as much as my husband and who was denied to have them . And the reason was the dumbest i have ever heard in my life well your house is not stable . I had a lawyer he didn’t do anything but screw me over so i hired a new lawyer . And the judge i have is biest she use to be my dads divorce lawyer and even admitted it in court and my old lawyer still wouldn’t ask for a new judge . So mean while my kids are going thru so much un needed stress and my one daughter has issues as it is . But yet they say they are there for the best intrest of the children yea ok .

There are a lot of groups in California. What part of the state are you in? Try our message board too… there’s a section for every state there.
