Child Protective Services laws and agencies are abusive to families and children. This site provides support and information to parents falsely accused of child abuse by Child Protective Services.

FightCPS does not advocate or condone violence or illiegal activities of any kind.

FightCPS is intended to help people learn enough about the law to be able to successfully defend themselves and their families against false accusations using legal documents and strategies that put parents in a stronger position when they go back to court.

For more information, see the FAQ.

Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.

Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.

Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.

Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.

Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.

CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.

Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.

It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Site mission: To provide information and support for families attacked by Child Protective Services and child welfare agents, especially those families facing false or trivial accusations of child abuse or neglect; and for researchers working to protect natural family rights.

Family Rights v. Child Welfare

Is One Family Rights Site Enough?

This morning I found a comment on this site from a future child protective services social worker, and was amused when this person got to the point of telling me my time would be better spent by trying to get more money for child welfare!

“Perhaps you could direct your energies into encouraging more funding to go towards our child welfare systems (not just CPS), which are currently grossly underfunded . . . .” — Future CPS Worker

Sounds like good work for a socialist. (I’m not in favor of more funding for child welfare programs, especially if they are run by the government.)

Well, everyone has a calling. My calling is to help parents get through their child protective services (CPS) cases and hopefully get their children back. I’ve learned through twenty years of anti-CPS activism and advocacy that I cannot do everything. So I definitely believe that one site isn’t enough.

There are 1001 different things this site could do to focus on fixing the child welfare disaster, but I’ve found I can focus on only one thing, and that is to help parents prepare for court. The courts are heavily weighted against the parents. Constitutional rights aren’t honored. Parents usually have no experience or training with court cases. And worst of all, their court appointed attorneys aren’t doing an honest and motivated job of helping parents fight their child protective services cases.

Because I can’t do it all, I’m asking YOU, the victims of child protective services, to start your own family rights websites. You are welcome to link to them from this site. I have a special place for your links:

Your Favorites: Websites, Blogs, MySpace, Facebook, YouTubes, etc.

If you don’t know how to start a website, please check out my suggestions on this page I wrote for writers needing websites: Creating an Impressive Writing Website. I used to work as a web designer and put all my ideas for creating a professional-looking site on that page. (I’m also a writer/novelist in my spare time so that’s why the slant went to writing.)

I don’t want to have the ONLY site like this, or even the best. At this point in my life I’d take great joy in seeing dozens of such sites pop up to help people. A fact: I probably won’t always be here! We don’t want the family rights movement to disappear just because some old-timers die off. It really is up to you newbies to create your own activity in the family rights movement, to learn from those who were here before you, to choose your own specialty and to excel at it so you can help others.

I started FightCPS by providing links to helpful information all over the web. The site grew as I trained myself and learned more. I’d already had paralegal training and decided to provide sample legal documents. I have been totally blessed by the help of some outstanding advocates with a similar passion, who have filled the message board forum here with helpful legal information. I see this site as often the first place someone will find when looking for help with a CPS case. Hopefully these people will either join us here on the message board, or find links to other sites that will become their web-home while they’re dealing with CPS.

I diverted myself into collecting news stories that showed that children are not safe in foster homes. That need was later filled by Suncanaa’s stellar website: In Memory of Children Who Died in State Custody – a great example of a site that specializes in exposing ONE ASPECT of the child welfare nightmare…. and because it specializes in one aspect, the site owner can focus and do an expert presentation on that issue. Now instead of posting everytime I see that a child was injured or killed while in foster care, I can just link to Suncanaa’s site and there’s the information. Case closed! It is obvious that children are not safe in state custody foster homes.

Another site that focuses on just one thing is ParentalRights.Org – a site that is working toward the passage of a Constitutional amendment that will protect families. By focusing on that one aspect they are making great strides toward an end to the child welfare nightmare.

I hope by examining these two sites you’ll see what I mean by specializing. If you try to do it all, you’re less likely to do anything perfectly. But if you choose one aspect, you can create a real opportunity for change.

  1. Linda,

Your website is what gives those in a hopeless situation hope to fight for what is right. Please keep doing what you are doing. I agree that you can never have too much information and I also am grateful for the webpage of parentalrights.org. You know that my sister passed away during her case so my journey in life is to help other parents in their struggles, although I am no where near qualified to do all that is necessary. I have often suggested your page as well as other pages with good information and advise to parents trying to fight for their children. I try to bring awareness on my facebook page about the dire need our nation has for change/reform of this failing system. Until you have been involved in the system or know someone who has you really have no idea. I have many friends on my facebook and so many have commented with such awe and disgust that I know I have made an impact for the positive. Thank you for helping those who surely need someone’s help. God bless you for all you do~

  3. Terri, if you can’t visit with your children, then put up a website telling them your side of the story and how much they mean to you. Hopefully they will see that and realize how crazy this all is.

  4. When I had a CPS case, (for “raising your voice” at a 15 year old), the stress was so horrific that I almost died from heart failure. Being branded a child abuser when you are not one is enough of a shock and a stress factor to kill you, never mind that your kid disappears into the system. Then the grief almost kills you, too.

  5. Your site was one of the first and better ones I ran across, and it would have been helpful if I had been able to find it prior to going to court. I had no idea how dishonest the county personnel would be. I think that ‘s one thing people really need to know. When CPS comes after you, they play by THEIR rules.

  6. I need to find an advocate in the state of Nevada I seem to have an attorney who only emails me (rarely) and never calls I seem to know more about what’s happening then she does, she should know that my child already has spoken to his Cap ( child’s attorney) and that my child wants to see me, after he told his “father” he did not. I need someone to guide me through this B.S process

  7. FREE, PRO BONO SITES FOR THE CHILDREN:

    No, not for the parents.

Go take a look at Lawyers recommended on this Website.

There are plenty of law schools in the US where the KIDS ( basically ) can get free representation.

I have posted many such URL’s.

Basically, current thinking is that stranger foster care Linda terms “fosterincarceration” is intensely damaging to YOUR CHILREN.

Diane in NV—possibly you can find someone at a law school or clinic.

Remember, attorneys need to learn to be advocates, and not just mouthpieces 4 DSS.

KIn do have RIGHTS, BUT CPS will NOT inform you.

  13. Hi,

I agree 100%, that we need more sites like this one covering the full spectrum of social ills for the victims of abuse of power.

My wife and I have also felt the sting of the Frankenstein Monster known as child protect agency. We are in the process of fighting for our family rights.

I am in development stage on a website aimed at providing some solutions that may help those who feel powerless, empower themselves.

Fightcps.com is an excellent site and we need 10,000 more sites like this one waking us up to the problems of the system.

  21. The more doesn’t necessarily mean the merrier when it comes to fighting CPS… but the more that are out here trying to band together and the larger our base camp becomes, the louder our voices will become until it is a deafening roar which cannot be ignored.

Drop me a line and let me know how I’m doing Linda! It’s a far cry from the site 15 years ago, that’s for sure! LOL….

From one seasoned soldier to another, God bless you for staying true to your vision and for your unwavering sacrifice and dedication to this national dilemma!

  22. @Future CPS Worker: “Perhaps you could direct your energies into encouraging more funding to go towards our child welfare systems (not just CPS), which are currently grossly underfunded . . . .”

First, if CPS weren’t so quick to remove children on frivolous charges, perhaps they could work within their budgets to rescue the children who really need help.

Second, that money is taken from taxpayers, many of whom already struggle due to such a high tax burden. If you care about kids, why would you want to further burden parents?

Third, social workers in my state start at around $20/hr. If there’s not enough money to fund the services you want, how about cutting that in half? Seriously, plenty of people have to get by on even less than $10/hr. If nothing else, this would separate the people who really care about kids from those who just want a cushy government job with great benefits.

Fourth–and this is perhaps the most important question I can ask you–what are you going to do, when the day comes that you know a family did nothing wrong, but your supervisor tells you to take their children anyway?
