Child Protective Services laws and agencies are abusive to families and children. This site provides support and information to parents falsely accused of child abuse by Child Protective Services.
FightCPS does not advocate or condone violence or illiegal activities of any kind.
FightCPS is intended to help people learn enough about the law to be able to successfully defend themselves and their families against false accusations using legal documents and strategies that put parents in a stronger position when they go back to court.
For more information, see the FAQ.
Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.
Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.
Site mission: To provide information and support for families attacked by Child Protective Services and child welfare agents, especially those families facing false or trivial accusations of child abuse or neglect; and for researchers working to protect natural family rights.

Fighting Child Protective Services False Accusations

June 14, 2009
From the inception of the FightCPS.Com site in October, 2000, I was aware of North Carolina CPS abuses and always have thought of North Carolina as one of the most corrupt states (for child welfare) in our country. This impression comes because there have been many North Carolina residents online complaining about child welfare injustice there, whereas for other states like North Dakota or West Virginia, you rarely meet anyone with a complaint.
For example, the Candace case: A five-year-old girl was ripped from her loving mother because mom couldn’t find a ride to go pick her up from Head Start on time one day. Candace was adopted out to a nurse practitioner who took her to Colorado for “rebirthing therapy”… which caused Candace’s death at the age of ten.
Now another ten year old child needs to be rescued from North Carolina’s child welfare industry. He belongs in the state of Texas and his father has court documents to prove it. But North Carolina not only won’t let go of Joshua William Smith, they seem to be hiding this child. The full story is on the Stop Corrupt DSS blog. Here’s the link: Where is Joshua William Smith?

I am in shock. It is not just New York illegally reaching across the United States kidnapping children for federal monies. We need to nip this in the bud NOW. It is hard enough dealing with the illegal acts of CPS in your own home but being kept indefinitly in another state is beyond stressful. We need everyone to help us get an agency ie. Children’s Rights, Children’s Defense Fund ect. to take these two cases to Supreme Court and try to get the law ruled unconstitutional or application of law so that Congress is forced to add checks and balances to the law in every state. Please everyone contact or write every agency possible and I will do the same. I need this person to contact me, I wrote on the blog so hopefully they will get the message.

In Batte Creek mich they finally took all rights away. I no longer as of may 2009 can not see or call my grandchildren. They said that some asst principle to the jr high was going to adopt the youngest 2 and the other is placed in star commonwealth. It is a shame, because they knew that my daug. was closed head injury and they tricked her into signing away rights illegally. They told her that they would let me grandma get them and they went to school an removed them, because of a false inncodent 6 mos prior. All lies, but they know I can not afford an attorney. If i could i would pay a little at a time from my disability check. Please help . pray for us all please….. f

If anyone has CPS issues in the State of North Carolina I need to hear from you @ 757 722 0480. That the child wealfare funding manual on the NCDHS web site, is contrary to family unity, family reunification, non-fostercare place, goes against relative placement. Where the incentive funded by the U.S. Department of Health and Human Services foots the bill in the background of N.C. CPS cases and the incentive is for DSS Social Workers to engage in misconduct, Where the Judge keeps the case open and going for extened periods so that the STATE of N.C. can collect more fendera dollars, at the child and familes expense. That the Court appointed lawyers in N.C. are funded via IDS indegent defensed funds services “cash cow” in draging the CPS case out over 15 months in milking the N.C. child welfare System. The N.C. Guardian Ad Litem System operates the same why in getting its’ funding from the U.S. Justice Department. The best way to fights N.C. CPS is to file a civil rights complaint with U.S. Department of Health & Human Services. 61 Forsyth Street, SW. – Suite 3B70. Atlanta, GA 30323. (404) 562-7886; (404) 331-2867 (TDD). You may file a complaint for yourself or for someone else. ANYONE CAN FILE! – Anyone can file written complaints with OCR. Please help my husband and myself. He has 3 children from a previous marriage who were neglected. We got custody of them 6 years ago. We worked hard to educate them and give them a better life. their mother has done everything to destroy their connection to their father. my step daughter and her mom came up with these accusations of sexual abuse against my husband and NC CPS took the children from the home and placed them back with the negligent mother. my husband is facing serious criminal charges as a result. I am a preschool director and these charges are ruining my chances to have a home preschool by association with him. this apparently has not been challenged in nc and a lawyer we tried to retain would not touch nc dss. please help. he has also been descriminated against for being Latino.

I am looking for individuals in the state of North Carolina willing to sign a petition against the outrages of Child Protective Services. You can see a copy of the petition at http://www.thepetitionsite.com/292/petition-for-audit-and-reform-of-nc-child-protective-services. I am more interested in getting people to sign a physical copy. If you are willing, please email me at stoporangecountycps@gmail.com. If you will provide me your address, I will mail you a copy of the petition, signature sheet, as well as a stamped and addressed envelope. When you have signed the sheet (and hopefully shown it to your friends, too), simply place the petition and signature sheet in the envelope I provide and mail it back to me. I am trying to collect 50,000 signatures in 6 months. To do this, I need your help. We can only protect our children by organizing together against this dangerous and illegitimate agency.
Again, please contact me at stoporangecountycps[@]gmail.com to request a copy of the petition or if you have any other questions. Thank you very much in advance.

Hi, my name is Erika. I have four beautiful children who have been illegally stolen by Caldwell County, NC CPS. First, my oldest three children were taken by CPS in Caldwell Co. and I did everything they asked and more. Then I got pregnant and had my fourth child and I was then living in Catawba Co., NC. Cps in Catawba Co. opened a case but let me keep custody of my new baby. Caldwell Co. would not transfer my case to the co. I was living in. So I had custody of my new baby and was taking her to visit my other children at CPS. This is what I don’t understand how that was even legal. I was good enough to have one child but not all three. So I had my new baby and when she was five months old, Caldwell Co. CPS ceased reunification on me with my oldest three kids. On the day of my termination of parental rights hearing, the social workers and their attorneys took me in a conference room and threatened me into signing over my parental rights. CPS and their attorneys stated that if I didn’t sign my rights over to my oldest three children then they were going to terminate my rights that day and then my new baby would be removed from my custody also. So they gave me 15 minutes to decide and they promised that if I did sign over my rights that they would let me keep contact with my children. So, I was scared to death and I signed my rights over not knowing what the consequences were. So then about two months after that, CPS in Catawba Co. filed a petition to take me to court supposebly because I was getting on going reports to CPS, which I know was a lie. So I moved to SC and then came back for court. That morning a different judge heard my case and ordered CPS NOT to remove my baby and gave me permission to go back to SC with my child. CPS waited until that judge went home and the courthouse closed, not even 4 hours after the judge entered his judgement, and CPS called the judge who took my other three children at 5:41 pm and had her overrule the other district judge and remove my baby. So I filed a complaint with the Judicial Standards Commission in NC and they opened a investigation on her and then said they werent going to take any legal action against her. My baby is going on two years old and CPS requested the judge to be the one who overruled the first judge and gave them an emergency removal of my baby. So, as you probally already know that judge nevered returned my daughter and never gave me a chance instead she gave guardianship to a woman from the daycare my children were going to for years and gave my three oldest children to her daughter and they were adopted out. So I need any help and advice I can get on what steps I can take to get all my kids back!! I need a lawyer, I live in SC now and my children are still in NC. I have the money to pay a good lawyer who can help me get them back. Anyone who can help or has any advice please call me or email me at : (828)514-5692 or graggerica[@]yahoo.com thanks so much!!

CPS will is discriminating against us and will not allow us to adopt a child in our county because we hired an attorney to represent the foster children we had in our home. Even though we were cited as excellent foster parents that went above and beyond
for our foster children, CPS has told us they cannot be unbias towards us because we hired an attorney, therefore, they have blocked us from every being able to adopt a child from the system. We only hired an attorney so the TRUTH would be exposed in court. Little did we know that foster parents are not allowed to present evidence or witnesses!

Searching for an attorney to take our case. Our family website is http://www.bringingryanhome.com
Our case was explained in the documentary “The Child”. We are in Buncombe County NC and our SSI medically disabled son spent months in fostercare after we were wrongly accused of MSBP. All of our evidence is audiotaped.
