Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.
Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

I just learned about this site. I have three girls that were stolen by the CPS. I lost my rights and my girls were adopted by the foster parents. I have just learned of abuse in the home. Sexual abuse that has led to one of the girl being a “cutter”. Also she has tried to commit suicide. There was a report filed by her to her school counselor, only to have the police tell the accused parent, and send her home with him. I can not find anyone that will help me! The whole area is close knit and a lot of things “wrong” go on in this small town. Why can’t I get help for my girls, and get them out of that place? I feel so helpless and need help for my girls! Someone please help them, and me.

Today cps took our daughter from school with no previous findings of abuse. one of our family members has called cps three times with false accusations. We have cooperated the first two times resulting in the case being closed. This last time we feel we are being harrassed. We have done nothing to deserve this, nor does our child deserve this. We were given a letter with a court date for this monday. Can anyone help us?

I haven’t had the time to share the good news that as of May 12th I got my son back!!!!!!!!!!!!!!!
The judge did not agree the CPS had due cause to take my son out of the home. And that there was not any mental/emotional abuse and damage. I do though have a protective order because I continue to have the opinion that MY SON DOES NOT NEED THERAPY. So we are forced to have to go to a therapist till that therapist deems my son not needing it!!!!!!! Therapist’s have to much control-not good, not right, not Constitutional!!!!!!!!!!
My prayers and love go out to all of you in much harder and torturing situations with CPS.

I need a lawyer to help me appeal my CPS case. We’ve been locked in this hell for 16 months now. Neither my husband or I are allowed to see the children. They put the children back with their biological father that is severely abusive! He has 3 felony convictions for intentional injury to a child, but because he said he was sorry, it’s ok to put the kids with him, now. He’s going to end up killing my babies! PLEASE if you are in TX and you can help me, contact me. I will only have 21 days to appeal as of July 15th. Please pray that I will get my babies out of that situation and home. Pray that I will have the strength to endure this all to the end.

There is an attorney by the name of John Zenir out of Mineola who handles these cases, both privately and as an 18B attorney.
He has a very good reputation. I do not know what he might charge. But you might want to google him and give him a call.

I just have a few quick questions for a lawyer, I’m not sure we need representation yet. Someone called and made a false report on us about drug use and that we deal drugs out of our apartment. Need to know what our rights are, what has to happen for them to be able to take the kids from us. We are in NY.

5 years ago i learned my now ex husband was molesting my daughter who was his not his bio child.. i did not know until my daughter told someone at school and they called cps.. i didnt kno where my daughter was because she didnt return frm school that day.. i searched for her but could not find her until i got home an found a card that stated that i needed to contact cps.. i was terrified that something had happened to her an i was not by her side as she went through it.. when i contacted cps they instructed me to come to the office and to bring my then 2 yr old son ago with us. upon arrival we where questioned as if it something terrible had happen.. i was lost an kept asking where was my daughter an what the hell happen to her!!! they stated that she said she had been raped and molested.. i fell to my knees and screamed out wht the hell is going on!!! i begged to see her and i asked who did she say did this to her.. the said my husband did it.. he immediately said there was no way.. i was lost mentally at that point an could not think straight.. a detective went on to get in my face and tell me that i knew that he was doing this to my daughter.. he threaten me physically and said he was gonna ruin my life.. i honestly didnt know what was true.. all iknew is that if was true i am 100% with my child.. they snatched my son from my arms and left papers on the counter an said we had to be to court the naxt morning.. that was the beginnig of the end.. they locked my ex husband up.. and thats when he confess to molesting her.. i died on the inside.. i had already lost custodt of my kids.. i was tricked into reliquishing my rights because i was told that i would never be able to have any other children an d it would stop the process of my brother adopting them.. at that i was divorced an was in a new relationship with new husband who is currently serving in Iraq.. well, they ended up taking my kids out of my brothers home after 4 years, unannouced.. now they refuse to let anyone in my family see or hav any contact with them.. my daughter is now 11 and my son is about to be 7.. i had contact an regular visits up until this happen.. i am distraut an clinicly depressed now.. i lost a child last year, and had to bury him.. i have a 3 year ol in my home an im 6 months pregnant.. my house is not a home and my life will never be complete until they return.. me and my husband have vowed that we will not stp until they are home.. my husband is a 3 time iraq war vet.. we are young and just lookin for a very good lawyer can help us.. we are willing to pay.. can somebody please help us…

I am a 28 year old mother of a wonderful 9 year old girl. I am in desperate need of some help. I will do whatever it takes!!!! I am almost out of time. I have completed everything on my “service plan” and still they are saying come september they are moving to terminate my rights. This was not an abuse case. I have never and never been accused of laying a hand on my daughter but they make me seem like Andrea Yates. Please…..I will do anything!!! to have my little girl back…ANYTHING!!!! thank you….

Crystal, first remember that whatever the social workers ask for is not the final answer. The JUDGE makes the decision about TPR and that is the person you must try to impress. You do that with LEGAL PAPERWORK & DOCUMENTATION. This site can help you put together some of that paperwork. Register at the message board for feedback on your case. Don’t expect a lawyer to help you. You must learn to type out this legal paperwork yourself to present YOUR side of the case to the judge in a form he can’t ignore. Hire an expert witness who is willing to testify on your behalf. If your attorney isn’t doing anything to help you, tell the judge. You can appeal on that issue.
There is lots you can still do to fight this TPR threat in court but you must be proactive and wise… and must be willing to do it yourself (through your tears. through your pain.) …as nobody can do it as well as you can.
These cases are decided on “A preponderance of the evidence.” If you’re not submitting any evidence and the social workers are, who will win? My suggestion is to blast them with your compiled evidence in a way that can’t be ignored. Show them the room you have ready for your daughter. One mother took in a CD full of photos of her home and managed to get all ten of her kids back.

I need a CPS defense lawer state of IL. I had all ten of my childern taken YES 10 CHILDREN from me. I know alot of things they put in courts papers was very wroung, things like children was involed but was not even born yet. I have been gow this for 7 years now. My rights have been taken away from me with of the children. Its alot of things that is wroung in my case. I am currently looking for a dedicated pro- bono lawyer that fights for the cause, reform and with purpose. I have been doing all the petitions for my daughter and have pulled it out of state court into federal. My daughter has a learning disability and for the sake of her children cannot litigate on her own. This case is explosive and the laws broken are massive which means with the right lawyer there is plenty of opportunity for good caselaw. A child was literally not legally kidnapped and this case reeks of massive cover up and conspiracy Judge, court clerk and DSS lawyer all began acting on a case that was not in court til the following day when petitioner was instructed to file an out of jurisdiction custody petition believing there was an existing order of custody and she was there to modify it. Two of her children on vacation with her were removed. The third was intercepted across the country brought across state lines to a state he had not been in for over 18 months. There was no custody order and they never had jurisdiction even for an emergency because third child was on his way home. Basically New York snatched a child from across the country with the only intention to place them all up for adoption. Proven federal monies are only drive in this case besides cover up. Excellent case for the driven lawyer. I am more than willing to do all research and writings or whatever. With the “won money” we want to start a lawyers fund for parents fightiong CPS. Please if you know of any agency willing to fight with us on this in New York let them or me know. I don’t want them to do this to anyone else. Kidnapping across state lines is a felony and FBI wants state to investigate first or federal court to make a ruling. CASE LAW is the only accountibility afforded us.

Met a girl online. Went to Florida with her and her children, spent 2 months there. Her daughter (6) and son (4). Was in middle of divorce. Daughter called me daddy constantly - I loved it ..but it bothered me because I had my own 3 year old son that I was missing. I mistakenly asked her not to call me daddy (it was too fast for me - i regret that). And I returned home to straighten out my life on the other end. My girlfriend returned home by car, sent the children home by plane with thier grandmother. We reunited. The grandmother and sister of my gf would not allow my gf to see the children. They were essentially “kidnapped”. Then Rape accusations upon the 6 yearl old girl appeared. Then MY sister called her sister with a “nasty gram” - and her sister slapped a restraining order on my gf! She didn’t even know about the call - had nothing to do with her. Then we ended up in court, probate court of all things, the case went on for almost 8 months… meanwhile my gf and I got married - She could only visit the children. Then , because they were going to loose and we were going to get the children back, they ran to CPS and CPS jumped on the allegations … My gf and I had since gotten married. We had a baby on May 4th. We were alerted that there was a CPS thing going on (by a good doctor) so we had the baby out of state (In Nevada - we were living in San Diego). We returned ..then on mothers day - CPS and a slew of cops came and STOLE OUR NEWBORN BABY! WOW! 6 DAYS OLD on MOTHERS DAY! We were devistated. Then we recieved the “charges” from CPS. Child beating and rape by me - and her allowing it. NON-SENSE! I left the state out of fear! Since then, both children have ADMITED TO LYING ! The 6 year lied because she was mad at me for leaving (I was coming back to her - but needed time). The 5 year old lied because of the attention he saw his sister get ! Wow! Both children have come clean about it.
But the children remain in the custody of a MAD WOMAN, who just 2 years ago slit her wrists and is diagnosed : “some type of schizophrenia, schizoaffective disorder, manic depressive or bipolar”. And this woman is determined to keep them. They are NOT her children!
Our court date is July 27. Virtually EVERY LINE in the ROTTEN CPS REPORT is a PROVEN LIE! ALL OF IT! All we have is a public defender
We can EASILY WIN this and get our children back to their mother and I. We are San Diego area - Please? We have SO MANY BLATANT Lies from CPS - Documented LIES ..the social worker KNOWS about it - but doesn’t care! If someone, anyone in the area can represent us during this trial - WE WANT TO SUE CPS when its over with. You have to read all the data to understand how WEAK AND PATHETIC thier “evidence” is. They have NONE! Only LIES which we’ve PROVEN, line by line, to be LIES!

Seeking CPS/Civil Rights Violations attorney in SoCal.
12/07 - Requested new car seat from hospital at time of my son’s birth, as was instructed by my prenatal nurse. Hospital SW was suspicious and contacted CPS. I asked CPS worker what were the allegations, she refused to answer and stated, “You know, I wasn’t going to do this, but I’m going to place a hold on the baby.” CPS took my baby and older (12 year old) son for four (4) days, then recommended dismissal @ Jurisdictional/Dispositional hearing.
3/09, while exercising 1st ammendment right to protest a local business with permission from police, business owner threatened to maliciously report me to CPS if I didn’t leave his business. Police responded on one occasion and informed owner of my right to peaceful protest. Police returned later after owner stated that my son was outside in the cold without a jacket on. Police placed me under arrest for child endangerment and contacted CPS who again took my children into custody. I was released 12 hours later from jail on “OR” and instructed to remain 500 yards from business.

THE C.P.S. IN PASCO COUNTY FLORIDA JUMP THE GUN ON MANY CASES ALSO. MY X GIIRL FRIEND AND HER SISTER GOT INTO A DOMESTIC OUTSIDE MY HOUSE BACK IN APRIL, C.P.S. CAME OUT AND TOOK MY 6 YR OLD BOY AND MY 4 YR OLD DUAGTER. SINCE THE INCEDENT I HAVE HAD NO CONTACT WITH THIER MOTHER MY X, AND DID EVERYTHING THEY ASKED OF ME, I’VE SEEN MY KIDS 8 TIMES IN 75 DAYS, I’M ALOUD TO SEE THEM 1 HOUR A WEEK, AND THEY ALWAYS LEAVE THE VISIT UP SET AND CRYING,THEY WANT TO COME HOME. BUT I HAVE TO WAIT TILL MID JULY TO GO BACK TO COURT, TO SHOW THE JUDGE EVERYTHING I’VE COMPLETED. ANY ADVICE TO GETTING IN COURT QUICKER?????

I was forced into a private adoption because CPS was threatening to severe all parental ties between my baby and my fiance and me, because we were homeless. The CPS worker did not check out my families houses like she said she would so that my baby could stay in our family - she was sneakily trying to get my baby so she could put her up for adoption in foster care system so I opted for a better choice of semi - open adoption, rather than my daughter ending up in several foster homes. I just wondered if I could have had attorney’s assistance in keeping her in my family, while we got on our feet?

I would get a tape recorder, call the caseworker and ask her what else she thinks you could do to get her to return your kids, ask who decides if your successful, who can override her, for what reasons, when after this is done will she be returning your kids, and then send her a confirmation letter stating everything discussed in the convo. Give her 10 days to reply to your letter, or you will be submitting the letter to the court as fact. If she lies under oath in court you play the tape, and this will be something else you can sue for.

Anyone who is reading this please let me know if you know anyone who can help. I am sending this email to request your assistance with our DHS fight. My children got taken away from the mother that raised them God’s way and did everything a mother is supposed to do love and protect a them. Dhs has given my kids to the very man who tried to strangle my daughter and beat my son on a visit to his house.First dhs gave them to his mother who walked out on her son and was also abusive on visits to my children. When I found out I stopped all their visits went everywhere for help Police,child abuse services and a child therapist. SUV founded what he did to my daughter but this man keeps getting away with all abuse. Dhs told me in 2006 when he strangled my daughter and beat my son that the abuse was unfounded they never investigated the father , if they did they would have seen his arrest record of terrorists threats towards my children and I his stalking arrest .Dhs said then that I had no choice but to take them to his scheduled visits I was mortified and went to all services to stop this NO ONE HELPED me to help my children . I took them back there and he went after my daughter AGAIN in front of me I jumped in front of her to protect her and he attacked me he was arrested the police saw this but after a year of courts he walked out free again. When I stopped their visits they started making calls to DHS and accusing me of things I didn’t do instead of DHS investigating properly I am taken to court and lose my children and have no idea why. Not one person ever spoke to my family friends pastor about me. My children told DHS and their therapist what they (father and mother)did but DHS called my children and I liars. I was mortified not even the judge let me defend myself.Even though I have evidence supporting what they have done to my kids. I was accused of things I never did if there was a proper investigation then the truth would have been revealed.I was never given the chance to defend myself or speak that is a violation of my constitutional and civil rights. Since these people have had my children they have abused them and neglected them by leaving them alone once last year the father left my 10 yr old alone at a amusement park while he went on a ride and when he returned a strange man was talking to my daughter. Thank God he was not a child rapist. The grandmother deprived my daughter from food saying she was too fat too eat . In the beginning of the school year my children were coming home to an empty house with the door unlocked all day and no one home, when they told the SW it was ok. That is neglect. When we went to our first court hearing this man failed 3 drug test but got unsupervised visits I passed got nothing and since have passed all their evals and test. but Not the father. Recent court DHS gave him custody. HOW. DHS is supposed to reunify with parents they have never tried to reunify my children with me the mother. Dhs has made so many false accusations of me its horrible that they do this to good parents.I have passed all test in 2 years and I still have supervised visits and still have no idea why this has happened.I had a dhs therapist come to court to testify for my behalf when dhs found out they restricted her testifying. This is happening to thousands of families. Our children are taken for money. Here in Philadelphia DHS gets 600 to 900 million dollars a year to destroy families many for false accusations. I am asking you help my children before they get hurt again. I love my kids and have never ever hurt them in anyway. I raised them the way of God and because of that I lose them. What kind of world do we live in when dhs can get kids for lying and profit. My children have not been able to see anyone in my family. My mother had 4 brain tumors a few months back I begged dhs to let my mother see her Grand kids before she went in to surgery she could have died. Thank god she didn’t they called me 3 days after her surgery. My mother has seen them once in 2 yrs and they stopped her visits because at dinner(at supervised visit) we said prays and she begged God to bring her grandchildren home and prayed for their safety. So her visits were canceled. I am writing letters now to all senators ,governor, congress in hopes that we parents can save our children before they become a statistic. I asking for your help. I am a Philadelphia Guardian Angel and have been awarded from the Vice president a few yrs ago for my volunteer work that I continuously do in the community.Please help me help my children. I am with Justice for Families and an asking for your help to bring my children home where they belong. I am a woman who has been stalked by this man on and off for 11 years evertime I go to court this man gets away with this. He has been arrested 5 times and nothing ever happens to him. We just went to court again for anther protection order and the Judge denied it even though i had witness to his stalking again. I have moved 4 times in the last 2 years. before my kids were stolen from cps I was selling that house to get my kids away from him. I get no help from police courts from his stalking . He continues to do this and get away with it. Need help and answeres about what to do to help me and my kids.

My husband has been accused of seual abise on our 13 year old daughter to is mentally diabled. My eldest daughter out her up to doing this once again. the firdt time she made a flase report was at her school against a in-law cousin the she changed her story ans said it was her uncle at her auntes house when she sent the night. which was a lie becuase she had not been there in years. this time its her father. My oler daughter is very disresoectful viloent and runs away constanly ans we have to constacnlt file reports to try and fimd her. this time I called the police on my eldest daughter becasue hse was beatinf her 10 year old sister. a week or 2 later DCf was knocking on my door saying my hiusband and 15 of his friends had been molesting our 13 year old daughter for some time. they took her first and then our other 3 children that were still at home. She DCF worker lied and said I had a black eye when she say me , as her reason for tsaking my children 2 weeks after she took my 13 year old . I need help we are in dependency court now. I have a lawyer for that. wjile she is a nice lady I dont think she knows enough or is to timid to help us. Please my children are my life and they stole them from me and place them with an aunte and her husband that don’t like us and they are mostreating my children trying to get them to cooperate with DCF and the DCF people are threating them too. My grandson is in imminant danger, living in a meth house with pedifiles. Out of desparation I called cps. The case worker decided that I was a liar, never did an investagation,called the claims unsubstantiated. Finally my son and the babys mother were incarcerated and I called cps again. Again she called me a liar. I then went to the judge and got temp. physical custody . As soon as the csp worker who refused to do her job found out the next day she bore false witness and distroyed evidence and took the babyand put him back in the meth house shaving his head because I was trying to do hair testing to prove they were smoking meth around him. They have obstructed justice, distroyed evidence, and bore false witness. Even with a court order they are now not allowing me to see the baby now except supervised visits. The other grandmother when I said that there is a history of incest in the family and that was my main concern, commented that she has watched me play with his “thing” when I change him. A lie from the pits of hell!!!!!!!!There has been much evtreme violence stalking, vandelism,harassment.ect. I do not know what to do. They refused to even drug test . How can CPS openly violate a court order? They have put my grandson in great danger.Where can I go/ What can I do?

I am in paramount california. I had the sherriff today at my door. I ask for the warrant and told them that could not come in withou one. They accused me of obstructed justice. I have 4 kids one is in foster care. I served the social worker with the affidavit and now she sent the sherriff with another false report. My children rights had been violated few times and my constitutional rights too. I even got beated up by the LAPD the first time they came in. I need help I have a 17 year old a 10 and 2 years old that now they want to take. They are afraid, and I am too. I don’t know what to do. Melissa, you are on the NY register until the youngest child in the household turns 28.
You can, as I am sure you already know if you have had a fair hearing, move to have the report amended to unfounded and sealed.
It is then expunged when the youngest child turns 28.
There is a provision in the law to have the record expunged prior to the age 28 rule if you can show by clear and convincing evidence not just a preponderance of evidence that the abuse did not happen.
To my knowledge, an Article 78 may take soem time to come to fruition and of course, rather than being heard by an Administrative OCFS judge, it will be heard in Supreme Court.

I had a CPS case against me for cruelty to children (a foster child I was keeping got mad cause I punished him by taking his playstation and spiderman game for punishement and he got mad, started crying when his caseworker came, lied saying I took his game and spanked him!) I lost my job as an Officer because the case was not concluded in 30 days. 2 years later when it finally went to court, the child retracted his statement - I didn’t know this. But the DA approached my attorney and I at court and stated that he would throw out the charges and have my record expunged if I signed an agreement not to sue the state for wrongful termination and criminal prosecution - which I had been saying I would do. I signed the agreement and I held my part of the agreement and took a job as a teacher. But here 3 years later, I was informed by an agency that the local CPS is reporting that I had a substantiated case of Cruelty to Children. I am convinced that this is slander because the agency they reported it to made a decision to alter my financial circumstances as a result of what CPS said(they even put it in writing). I am looking for a lawyer to either represent me or at least give some advice on handling the case myself.

Regarding the above;
To Eddie,
If this is the case, wherein the criminal matter was expunged, the fact that your name remained on the child abuse register is part of the normal process as one law (criminal vs social service law) has nothing to do with the other.
I do not believe that you have a case for slander or libel but I do believe that you may have a chance to get your name removed from the child abuse register. The process to do same would depend upon your state’s statutes.
As Linda asked, please let us know the state in which this action was taken. I am in NY. If you are also in NY, I may be able to give you more info as to the laws governing your situation.

Joe, if you have a court appointed attorney you might want to try to get that attorney to work for you rather than for the county that pays him/her: Make your court appointed attorney work for you… but my intuition is that if you do this you should go easy on the attorney so you don’t anger him/her.

I have a 5 year on going case. my attorney refuses to do what is required or requested of him. I tried to go Pro-se but have been denied self council. this is the second attorney I had the first one verbally attacked me in the hall before a hearing. it is in the determination part of the TPR however I am looking for an attorney for the appeal stage as I doubt the judge will leave my rights in place but is rather waiting till the adoption waiting period is here (next month) to deliver his judgment. also have a solid case for a counter suit dealing with this.

Make Your Court Appointed Lawyer Work for YOU… I know time is getting short for you. My children were each served a Summons to appear in court today. 2 different Sherrif Officiers hand delivered them specifically to my 8 and 10 yr old.
In the packets is a request for MY income and assets declaration.
There is a seperate packet for myself but it was not delivered due to me working at the time of delivery and not being home.
These packets state that my children ace been neglected and abused. They state two other court dates that made this determination. I was not aware of any issues. They have a continued court date although I have never been informed of any such previous court hearings.
It states “facts” that I and my sitter spoke to and admitted neglect and abuse of my children to a person we both do not know and have never heard of.
The packets have incorrect ages and birthdates of my children.
These packets state that I admitted to an unsafe home for my chldren.
My children are now again terrified of these so-called adults.
My daughter wants us to run away from them. She wants to be home-schooled so she won’t have to deal with them.
I “ass”ummed everything was done and over with after getting ab order of protection against the caller of the false allegations.
Because my children will not talk to strangers (that do not know our safety “password” and I will not allow anyone in my home without a warrant, these allegations and “facts” are completely false.
When I told my sitter that her name was on the petition, she was angry because DCFS NEVER came to talk with her so all of these “facts” are bogus as well.
DCFS has put a block on my child care subsidy and now I can’t receive help with child care payments while I work unless I allow my children to be Wards.
The confidentuality of both WCCC and DCFS has been breached.
I have all documented proof and my children’s word. I have police records, hospital records, work records, payment records to my sitter.
My 8 year old started having night tremmors after DCFS went to his school and started hanging out at the playground. It became too much for him that he was hospitalized for a week.
This is the true abuse. When an 8 and 10 yr old child regress back to a scared infant because of someone threatening them at home, school, play and at the home of friends.
DCFS never talked with my neighbors, never asked my security measures, no calls to my sitters. DCFS has never entered my home.
They are relying on anomyous tips that I leave my children alone.
I have never lost custody because there is no actual proof. I have either been home, had a sitter at my home or the children go to a sitter. and this has been on EVERY visit from police and DCFS.
The last investigatio did not give his real name. nor did he offer his last name. I had to request after the 3rd attempt to enter my home, a copy of what I was being investigated for.
I was nevered offered services. The investigator said that he needed to do a safety plan beforehe could tell me what services DCFS could offer me.

I just stumbled upon this site while looking for information regarding my daughter’s and son-in-law’s disorder. My grandchildren were taken today after numerous attempts by herself, my son-in-law and myself to let my daughter’s CPS worker know of the anger management she needs. She was told by some workers that it would not fit into her schedule. Now my grandchildren are in the system and our hearts are breaking. They need a lawyer. They need help.

Hi Maggie, You responded to me a couple weeks ago. I contacted the Zenir guy, sounds very helpful, but too expensive for me. I got an ACOD on the fact finding hearing, and I lost my fair hearing, now I have to do an article 78 to appeal the fair hearing decision. CPS is closing my case and said I take care of my son very well. Why do I have to remain in this registry? My legal aid lawyer told me that he is the judge on these hearings and he had a case that he heard that was identical to mine. He said he expunged her from the registry. He said if he heard the case he dont believe he would have made the same decision as my judge? We are going to loose our newborn forever.
Simply because WE DON’T HAVE THE MONEY to FIGHT in time. I have found no way to get the Jurisdictional Hearing pushed out. Or this upcoming Settlement hearing (what ever that is.). I’ve spoken to 3 lawyers savy on Juvenile court. The MIN. retainer I found was $6,000 ! Everyone I know is busted broke or simply doesn’t care.
The “public defender” REFUSED to reply - Phone calls, emails and mails. NOTHING.
We asked him to file for discovery so that we can start on filing Motions to Strike.
*AND* it appears we need TWO damned attorneys - one for me and one for my wife! WTH! I’m not David WreckAfella - So I am stuck with a MASSIVE PILE OF LIES from CPS and losing my newborn daughter based on the whims of this PSYCHOTIC social worker and a PYSCHOTIC LYING BABY STEALING family member.
I’m so sick. I can barely move anymore.
I don’t know how to file this stuff myself - I have the “JV-569 Proof of Service - Request for Disclosure” form (required with the “JV-570 Request for Disclosure of Juvenile case file” form) and simply do not understand how to fill it out

You could attempt to handle the Article 78 on your own but in my personal opinion and to my knowledge, going pro se in Supreme Court is not such a hot idea.
I do not know of anyone who has won this way.
You might try contacting CWOP in NYC (Child Welfare Organizing Project). They are not attys but they advocate for parents fighting social services. They might be able to hook you up with a legal aid group.
I might also approach Touro and Hofstra law schools to see if their law clinics might be able to help.
Also try NYC Law Schools for their law clinics (NY Law, NYU, Fordham, Columbia, Brooklyn Law School).
Article 78 filings have very strict time limits attached. Keep track of your time here.

I believe the state statute has recently changed wherein, if you were cleared in family court, your name is automatically cleared from the register.
Ask your legal aid atty about this–it is very very new.
Go to NY Laws. Scroll down to SOS -Social Service Laws. I don’t have the exact section right now.
This change in statute, if it may be applied to your case may negate the need for an article 78 -or- perhaps in can be used in same to amend and seal your register listing.
Please ask your legal aide atty about this.

He is the only attorney I can think of on Long Island who is skilled in this area.

I have been denied the opportunity to defend myself from a conviction of child abuse/neglect.
I have been denied transcripts of the court case which I was convicted.
I was denied access to the process which this happened.
There is now a petition to take my children of which I have been served a summons to appear.
I have kept the papers and files of all the false accusations that were called in.
I have obtained an Emergency Order Of Protection against the persons that keep harrassing by making the false reports to DCFS.
DCFS has investigated me on several reports all coming from the same source. Police and hospital records show that abuse could not have occured at the said times and places. (I am in the process of getting the certified documents).
Claims that my children suffer from mental disorders are stated as facts yet my children are not on any medication. (there was a brief time that 2 of my children were after learning of false allegations against them)
Claims of signed releases were used to gather information yet no one has a copy of these papers.
Spelling of names, birthdates, ages and addresses are wrong in the petition.
Child Support and the subsidy I use for child care have already been informed of my children being WARDS (although they remain in my custody).
The summons was served on each of 5 children seperately and without an adult present.
The officiers that served my 10 yr old daughter did so by demanding she answer the door after peering into an open window.
(This child came home from the sitter 3 houses away to feed and water her puppy).

Last june, my wife which I was seperated and living apart from, left a bottle of equate allergy medication on the floor open next to her bed. Our 16 month old daughter got into the bottle and ingested a fatal dose. She got to the hospital in time to save her, but she had 13 seizures and almost died. When CPS investigated, my wife changed her story multiple times and this caused suspicion and eventually a criminal investigation to be opened. When we were intervied by detectives, our stories didn’t match. She said the pills were on top of the fridge and our daughter knocked them down with a ball and opened the childproof cap herself. I said I didn’t know what happened; that I was just visiting and was going off of what my wife told me.
Unfortunately, she gave me a different story than what she gave the police, and we were both arrested on B Felony Neglect of a Dependant Resulting in Serious Bodily Injury. She sat in jail for 20 days. I sat for 10 months. While we were in jail, CPS placed our daughter in foster care. Soon after, we signed papers to have her placed with my mother in law, who’s never liked me, and has been trying to get our daughter from us since she was born. She’s barren but wants more children, you see. Later on down the line, I signed a paper giving my mother in law guardianship. At the time, it sounded like a good idea, but now I regret it.
When my wife finally admitted via plea agreement to a D Felony Neglect of a Dependant charge in March of this year, I was offered - and took - a plea agreement for D Felony Obstruction of Justice (because I didn’t know what the hell was going on, and that’s a crime) and was released April 1st.
Since then, I’ve been in light contact with my wife. Divorce is imminent if for no other reason than her Neglect felony may stand in the way of my getting custody of my daughter again. I have been working as a live in nanny for my nephew since the day I was released.
Now, the problem is that my mother in law, even though my wife admitted in a court of law and out of it that what happened was her fault, has decided not to let me see or talk to my daughter. She claims that she believes that I tried to poison her because I don’t want a child. Needless to say, that is complete bull shit. I haven’t seen my daughter in over a year, and the last time I saw her, she was connected to a bunch of wires in the ICU in a drug induced coma. Now she’s refusing to let my soon to be ex wife see or talk to our daughter because she is in contact with me.To make matters worse, my daughter and mother in law live in Zion, IL, A good five to six hour drive from here and neither of us have a license.
What I’m looking to do is move to have CPS place my daughter into temporary foster care locally and remove her from my mother in law’s custody on the grounds that as per the case work, the ultimate goal is reunification with the parents, and as it’s been so long since she’s been around both of us, she’s going to need to get used to us again.
I really have no clue on how to go about this, but her plans are to have both of our parental rights terminated and adopt her. Anyone with any information, advice or references to research is welcome to contact me at the above email address.

I need help fighting cps in Erie County in Buffalo, NY. I need an attorney willing to stand up to the caseworker and bring to the judge’s attention the cps worker is not doing her job and is in fact withholding the kids from being returned home without reason. Jennifer-jmr1 at buffalo.edu

I’m a desperate mother whose baby son got removed last year around Aug 20. My baby was only 10 months young then. Now I only have 3 months to fight for him to come home. I’m very anxious. I’ll have to file 388 petition myself in Court if I can’t find a lawyer. Because Judge needs to know my progress and I do NOT have any drug or alcohol problems, nor do I have mental illness. Only because my ex-husband constantly force his Domestic Violence on me. So the CPS removed my beloved son. I’m a new immigrant from Asia. I don’t know much of Dependency Law. I am currently under investigation for “child abuse”. My daughter has been removed from my home and placed with her paternal grandparents. Her father can see her at anytime. I see her 2 hours a week supervised in their home. I passed a polygraph test and I still can not get her home.
Any help or direction would be greatly appreciated. I am in the suburbs of Philadelphia, Pa.

Tina, have you been writing your own legal documents to take to court? There are samples in our legal document library here on FightCPS.
Whoever has the most legal paperwork and documentary evidence is likely to win, so make sure you’ve got plenty on your side. Cases are won by “preponderance of the evidence”. Make sure you have documents showing you completed all the court’s ordered services.

In July of 2003, our niece and nephew came to live with us. Ma DSS through an ICPC sent them to us. This placement was for adoption.
In September of 2005, there was an anonymous phone call placed by a neighbor with a son, claiming allegations of abuse and neglect. We only have one neighbor with a son. This boy is definitely not an upstanding individual.
NHDCYF started an investigation. My nephew was the only one that was alleged to be abused. NHDCYF social worker Sofie Morrison interviewed my nephew. He denied the allegations.
Without probable cause, evidence, or any type of court order. NHDCYF worker called the Kingston, NH police. The child safety officer, LT Joel Johnson, was the one in charge. LT Joel Johnson, acting on his own, decided to expand the investigation. There was no probable cause or court order to justify this action.
He decided to interview our own two children without notifying our attorney.
Seeing as the interviews just proved that you had two terrified children, LT Johnson decided to do a “well being check” on an eight year old girl and a ten year old boy. There was no medical personal involved. The only ones present was the acting principal of DJ Bakie, and the male guidance councilor
Ma DSS social worker Helen Weitz came into NH while the investigation was going on and removed our niece and nephew. During and after the removal Ma DSS decided not to follow any of their own foster care rules.
Now this is where it gets crazy. NH wrote an Adoption Home Study. When the NHICPC office said they were not going to send it to Ma, the Salem, NH office sent it anyway.
The allegations were deemed Unfounded. Cathy Grondine of the Salem, NH DCYF office said we could not appeal the incorrect documents to the NHAAU. At the same time Ma DSS violated pretty much every law on removal of foster children and the ICPC rules. Ma. never notified us of our right to a “fair Hearing”.
We petitioned and received a hearing with the NHAAU. NHAAU ruled that the Adoption Home study was unlawful and ordered it vacated and destroyed.
In the Ma. Fair Hearing, they used the Unlawful Home study against us. Also two of the Ma social workers lied under oath, on who closed the ICPC.
No it does not end there. We appealed the case to the Ma. Superior court. The case was put on the X-track (365 days for judgement). About a week after the time limit expired, the judge (who has made rulings on this case within the year) announced that his wife works for Ma DSS—–ethical?
The next judge assigned to the case ruled that the NH home study was unauthorized and should be removed from the fair hearing (and any info obtained by the home study). He then remanded the case back to fair hearing office for a new hearing.
The fair hearing office ignored the court ruling and the court refused to enforce their own decision.
We have not seen our niece and nephew since the beginning of 2006.

I’m a proud mommy of 4 and a baby girl due literally any day. Last week I asked my dr about a rash on my son’s face and she declared it to be a slapmark. We’ve NEVER hit our son in the face!!! They took him and placed him in my husband’s parents home saying they would try to clear this up asap b/c the dr didn’t even take a pic! It’s our word against hers! And she left the practice since then. They are now saying they can’t give us an answer about our son until they see the autopsy reports saying that 2 of my children died from SIDS. I have a court date for july 22 with the judge son has been gone for six months and i see him once a week and hes in a different county than us his parents. Our panel review was a total sham, we realized dfacs lost all of our information. Please help me. I live in gainesville ga and I’m desperate .My son is two years old and i didn’t do any

Are there any attorneys in Washington State that are willing and able to fight CPS?
I have a court appointed attorney that won’t do anything for me.
My son has been hit daily in foster care. He has been yelled at almost daily in foster care. He has heard numerous negative lies about me and his father.
He is 9 years old and knows what is true. We all want to be a family again.
I have 3 grown children and 4 1/2 grandchildren. My husband has 2 grown children and 5 grandchildren. We have never had a problem with CPS before.
But now they have our son. We have been fighting re-unification for over 15 months. CPS keeps making up new lies and false accusations.
We jump thru all their hoops and they put up new hoops.
I just want my son to come home where we can protect him from all the abuse that he has suffered at the hands of CPS. They don’t believe that he is being abused.
Help me please.

I live in Brazoria County (south of Houston) and my friend’s baby was taken from her and put in foster care, and she has done everything according to the service plan, but now they’re telling her that she can’t have her baby back until they baby’s father (whom we want nothing to do with) completes the plan too! We know that he will NEVER complete the plan! Also, her appointed attorney refused to help her (she sat and did nothing in the court room while the judge lambasted her over lies in the reports, even lies we had PROVEN) so she fired the attorney and now the judge won’t give her a new one and refuses to listen to her when she goes to court!
I will gladly send the full story to you if you leave your email address…we need a lawyer who will take this case pro bono or with only $900 down because that’s all we have

Roxi - she should be writing her own legal documents to place in the court case file — especially since the judge isn’t listening to her! He has to read any affidavits you submit! Samples here: Legal Document Library.

There is alot of wrong things going on in my case. Cps has my children because of a GAL who filed a private petition against us. This GAL also requested that my children be given to specific foster parents whom she knew wanted to adopt the children even though the plan is reunification. But the thing is I have other family especially their grandmother and uncle who want custody of these children . This is family that have good backgrounds. And the foster families and GaL are purposely trying to keep these children away from their family. Dont families like grandmothers and aunts and uncles have rights to these children? What can we do? Please help us. My brother and I live in Arizona and my mother lives in Tennessee. thank you, Kathy

I have had my son taken because the cps says I failed to protect him from his brother who is 20 and mentally ill, and my 5 yr old says that his brother was doing bad things to him, the cps took what the baby said and turned it on me IT is a nightmare now they have him at Shodair hospital in the residential therapy unit for 3 months and they want to put him in a foster home so foster parents can teach me how to parent my child! I am 44 and have had 7 children, our public defender said we better give the cps temporary custody if we didn’t the judge would rule in cps favor I NEED HELP. EMAIL ME IN DILLON MONTANA, DESPERATE TO GET MY SON I HAVE DONE NOTHING WRONG.

Also the big brother is not even being accused of anything it has been 1 1/2 months and the reason they took my son is because they said he was in danger, well why isn’t my step son in a mental institution? they we’re just using that to get my kid, now it’s my yard isn’t safe and I need to put in a better toilete and I am just now able to go to helena to visit my son for the first time in over a month this is a crock.

I Need an attorney to help me with CPS. I just tried of CPS running all over me and other people. I live in Texas. I have had to deal with CPS a few time but nothing has ever been found against me. They now want me to attended a family team meeting, but they are unwilling to tell me what it was or why they think it is needed. I just did not have the list of medication with me when I took my kids to the Dr and didn’t remember all the medications they where on. I was running late and did not want to miss the appointment. This is why they are messing with me. I did what the lady said and put the list of medication on my cell phone. They have many Dr and a few different medications. PLEASE HELP ME AND MY FOUR KIDS. I going nuts dealing with these people and I want them out of my life for good.. PLEASE HELP ME!
