Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

CPS took our youngest daughter away from us, when our 19 yr. old daughter said a lie about me sexualy abbusing her and her younger sister and to find out it was a friend that was doing sexual abbuse not me. But they (CPS) won’t return our daughter and it has been a year now, we are about to go to court again with no attorney for our side and we are going to lose our parent right to our youngest daughter. The oldest daughter was been hurtful and curle to her youngest sister and hurtful to us, too. Now she is about to have child of her own now.

Hi,how are you? We have adoped three girls from the foster care system, as we all know these kids come with some baggage. Well, what was once a happy family turn into the worst nightmare one could ever imagine I have spoke with people regarding this case and no one,(NO ONE)! can help, Or even wants to touch it. WHY! I have a problem. My sons stepbrother abused him, and cps did nothing. I got a court order stopping the boys from communicating. My son is reporting to me that he is still seeing the boy. I reported it several times and cps is doing nothing. My son is 6 and the boy in question is 13. already this year, my son has reported that this child has slapped him in the face and left bruises on his wrist by grabbing him. This is scary. He molested him the first time, and I just know that something else is coming and cps wont listen. What do I do?

If you have a court order (I am thinking that you are in family court over a visitation dispute) then enforce the court order to prevent contact between your child and the child in question (am guessing that it your husband’s wife’s child? )
You can enforce the order through the court.
But please, try to leave CPS out of it.
They do not help.
They will only make it worse for everyone in the family including you and your child.

I have ten childern that I”m fightting for in ILL. There ages range from now 20 to 7 they need my help but I dont know who can help. I have been fightting this for about 6 years now. I just got one email from one of my kids she is 11 years old told me she was scaredshe did not want to be adopted. I have emails from my childern tell me things. I want to get them back , yes i neead a good lawer that is not scare to fight this. I have lost everything trying to fight this. I have a 16 years old thats now has baby because the CPS did not do there job by doing what they was suppost to do. And they said I was a bad parent but the oldest child never had a baby beening with me. I have fost parents will not let my children see each other nor me or talk to one another. They are broken up in mant differnt homes. Pease help me if you can thanks so very much. I want to tell other mothers to keep the fight up God is with you on this !!!!!!

NYS lawyer needed!! Our civil rights have been violated! We had a CPS worker in SLC divulge to an uninterested 3rd party that we had an open CPS case. We have written proof from the 3rd party which includes the name of the CPS worker that provided the information. We have not been able to find any assistance in our county and none from any state agencies that we have been in contact with.

Shawna, try googling Gary Preble… he is an attorney with a web page about CPS defense in Washington state. If he can’t represent you, maybe he could give you a referral. Also, get in touch with your state Senator, Pamela Roach. She has a blog on which she shares information about CPS. Two other resources: http://www.washingtonfamiliesunited.org/ and http://washingtonstateextendedfamilies.com/ … they may be able to refer you to a good lawyer too. Good luck.

Our son Cameron passed away at 2 months old. His IDENTICAL twin dalton weighed 3 more pounds and CPS has taken him from us. We are in South Dakota…
They were born 8 weeks premature for labor inducaed out of fear that Cameron’s heart rate was so low that he would pass away. He weghed 2 lbs 13 oz at birth. Read about some of his several medical conditions that caused him to pass away at http://www.jfdv.org

I lost my 6 adopted children after I broke my leg and my ex-sister in law (who is on disability and used to be a therapist) alienated two of my daughters against me while she was caring for them. Under her influence, they reported that I had abused them. (The girls have special needs; both have low IQ’s; one is bi-polar, the other psychotic, and my sister in law needed money. I believe she wanted custody for the stipend income the girls would bring her.) Despite the fact that that they gave conflicting information and that the other four children did not report abuse (or witnessing it as the two girls reported they had) I lost my children forever.
I was never charged criminally in this situation. However, in Utah, if CPS does their investigation and decides an allegation is supported, they tell this to the judge and the judge agrees. When I tried to defend myself, I was threatened with life in prison because…in Utah, whatever is said in juvenile court can be used to build a criminal case. In my heart, I knew they probably would never be able to successfully prosecute me as they had never arrested me in the first place. However, it was so frightening to be threatened that I ended up pleading the equivalent of “no contest” to an amended petition. This petition said I acknowledged the girls said I had abused them but they had never reported any abuse prior to staying with their aunt. (I never admitted to abusing them because I didn’t. I also refused to sign a “treatment plan” admitted I abused them because it was a lie. Of course, this made me seem unamenable to treatment.) The judge accepted the amended petition and then immediately found me guilty. When I tried to defend myself a second time, I was again threatened; the prosecutor even talked to my family and friends who were there to testify on my behalf. She told them that I could spend the rest of my life in prison and I needed to “take the plea”. They are witnesses to the duress I was under. I agreed to undergo psych testing, but CPS told the psychologist that I had admitted my guilt but refused to accept responsibility. I only found this out after I had passed all of the testing and I asked the psychologist if he had other questions or concerns and he asked me “Why did you plead guilty?” CPS also lied and told my daughters’ therapists that I had plead guilty, so of course I was never allowed to see my children.
This situation is a travesty and my attorney said this is happening all of the time. If this had not happened to me, I would not believe it was possible.
I am college educated. I do not use drugs or alcohol. I’ve always worked in the human service field. I was a foster parent for 10 years. NEVER was I ever accused of abuse until I broke my leg and was going though a divorce.
I’m a writer and a part time radio talk show host. However, I do not have funds to hire an attorney to clear my name and try to regain custody of my children. (My former attorney was court appointed). I have privately spoken to legislators and two attorneys. They all agree there are problems with CPS but no one wants to take them on. And quite frankly…this whole thing is a huge embarrassment to me. To think that I am a convicted child abuser…even if it is only in juvenile court..it’s horrible! I have always had a good reputation and my integrity has never been questioned.
Even so, the biggest travesty is the actual abuse that has been suffered by my six special needs children because of their separation from me. Especially my two youngest boys who are now 7 and almost 10 years old. One ended in a psych ward because he became so angry after repeated requests to see me. The other became so angry because he wasn’t allow to see me that he started breaking things at the shelter. I don’t know how they are now, but they are always in my prayers.
Luckily, my two birth children are grown (ages 21 and 19) and they have been a huge support to me. They even went to court in the end to try to tell the judge that the allegations against me were untrue and that my daughter can verify that her aunt tried to alienate her against me. However, again, when they tried to do this..I was threatened with arrest and I was so frightened that I relinquished the rights to my children. This has been hard on my birth kids as well as they have lost brothers and sisters that they love.
What can I do to get help? I just can’t believe this is happening in America today. Child abuse is a horrible thing, but when people are so evil to influence children to create false accusations against others, this minimizes the problem of TRUE abuse of children.

I am a little unclear about your post. It seems that you are looking for a New York State attorney, right?
If so, what is the relief you are seeking?
From your post, I gather that a CPS employee in Utah (Salt Lake) divulged an open case status to a NY State CPS worker? Another party?
Please advise.
P.S. I am not an attorney but I do know of some in NYS.
I may also be able to advise as to the government agency to complain to regarding the leaking of confidential info if that is the case.

My kids were wrongfully taken from me and I am in need of a lawyer who can help me fight to get them back. I have been wrongfully accused by CPS and when asked why would you file something without verifying, I was told by the worker, I did not write the order I only wrote the last page. I thought people are suppose to verify evidents before making a final decision on anything and she claim we can straighten it out in court. Please HELP US we are in Atlantic County, New Jersey. Our Severely Autistic(100%non-verbal/in diapers) 9 1/2 yr. old Boy and Girl Twins have been “Horribly Physically Abused” on 2 seperate “Reported/Documented” times in a Foster Home. We are telling the “Honest Truth” here in our DESPERATE Calling for Anyone to help us file a Lawsuit against The State Of New Jersey D.Y.F.S. Our Twins, Jennifer Joy and Ricky II were “Finally Blessed” to Our Lives after 6 yrs. of Stressfull, Expensive Infertility Treatments ($145,000 cash). This involved 23 Inseminations at ‘The Women`s Center For Infertility’ in Philadelphia, PA (w/ 2 Fetal Loses). I endured numerous invasive procedures to raise our chances of having a Baby, “Our Dream.” My husband even underwent 3 painful Testicular Surgeries to correct a birth defect of a missing Vas Deferens and the other one was blocked. We then transferred to the ‘South Jersey Fertility Center’ in Cherry Hill, NJ, to be “Finally So Very Blessed” with TWINS as a result of Invitro with the I.C.S.I. procedure. Our “MOST PRECIOUS TWINS” were wrongfully , quickly taken from us on June 30, 2006 after a neighbor called the police to report us having a loud argument on our front porch (while both our twins were safe inside in the living room watching t.v.) I know this sounds unbelievable, because it is. We to this day, feel SO Illegally Treated and SO Inhumanely Treated, we are living a “Nightmare.” MOST IMPORTANT : We are in Dire Need of a Real Lawyer who sincerely Cares to Help in our pursuit to file a Lawsuit on The 2 Documented Incidents Of Severe Physical Abuse On Our Twins who at 91/2 yr. old are 100% non-verbal (in diapers) and can NOT Communicate Anything To Protect Themselves (they both attend a school for “The Handicapped.”) INCIDENT #1: In August 2006, while in summer school, during diaper changes, the school teacher saw “Severe Bruises” All Over the Entire Buttocks of BOTH of our children. I was told this by the School Nurse (who I personally knew since they were age 3). The nurse called me on a Monday to tell me that she discovered “Bad Bruises” on both of my twins and that as required by law, she already reported this to D.Y.F.S.( looking back, since my children were “already in D.Y.F.S. care, they ignore the Abuse when it happens in one of thier Safe, Loving Foster Homes, instead this Should Have been reported to Someone Required To WATCH FOSTER HOMES and D.Y.F.S., so thier is No Bias or Cover-ups.”) The next Saturday we had a visit with our twins at my mothers home (since this abuse incident, my husband and I have been estranged by my mother. Totally Unbelievable is she has “Bonded a Very Close Relationship/Friendship with the Foster Mother.”) After Hugging and Kissing our Twins “Hello”, me and my husband immediately removed thier diapers to see the Bruises for ourselves (a week after the school nurse reported them). We were “Completely Heartbroken” to see Almost Identical Horrible Dark Bruises “Covering Each Childs Entire Butt.” About 1 Month went by, then we recieved a letter in the mail from The State Of New Jersey stating that the “Alleged Incident Of Abuse Of Jennifer and Ricky Allen has been Determined Unfounded.” Then 1 1/2 yr. later my daughter was Severely Burned, The Second Incident Of Physical Abuse (that I will describe below) ALSO WENT “UNFOUNDED.” My husband of 19 Years were TRUELY Great Parents (we were not perfect,no one is), we were Truely The MOST Affectionate, Emotionally and Physically Parents That You Could Ever Meet!! INCIDENT #2: On Febraury 13, 2008, we had a 1 hour visit in our Family Home. My daughter had a “poopy” (she is still in diapers, and at age 8 during this incident), I had to wipe her behind and put her in a fresh Pull-up diaper. While cleaning her behind, I Discovered 2 Serious “Burns” On Her Butt! Then I removed her clothes (which I Never check my children for “Marks”, this was literally “By accident finding those Burns.”) I then Really thought I was going to have a “Heart Attack” when I Discovered “4 More Burns” All Over Her Back!!! All these Burns were similar in size and shape of a “Silver Dollar”. My husband and I were SO VERY UPSET and ANGRY. We were SO FURIOUS that this was done to our Daughter (who can NOT Speak or Communicate at all at age 9 1/2 now). Even though our twins have severe autism, they Both have Always been “Extremely Good, Affectionate, Well Behaved and Very Happy Kids (this is ALL TRUE). I can NOT at all understand why Anyone Would Hurt Them SO Badly and “Unbelievably Not be Held Accountable For Neither The Horrible Bruises they both recieved in foster care or The Severe Burns on My Daughters Back and Butt that she recieved in foster care. Within 5 minutes of discovering the Burns on my daughter,my husband called our lawyer (who has been Paid Alot of $ Money. My husbands Boss is wealthy, and he knows that we are Great Parents. He actually Found and Paid for our lawyer for the last 21/2 yrs.We have been to court 16 times so far. We can Not take it Anymore.We Truely feel even though this lawyer was “Paid For By Someone Else” we would rather have NO Representation anymore than for my husbands boss to be Literally Wasting his Money. Besides, we NEED to Go In A Different Direction. Our Kids WERE Abused In State Care.) In Hindsight, when we called our lawyer with this 2nd Abuse, she should have told us to IMMEDIATELY Call The Police To Report It The “Right Way!” Now Everyday, we rethink about this Horrible Night, and get So Angry With Ourselves That we Did Not Call The Police. The Foster Parents Actually Might Have Gotten Arrested. That same night, after our “Visit”, D.Y.F.S. took our daughter to the hospital E.R. (which we Also Should Have Done if we knew that “I was supposedly the first person to see these burns.”) Unbelievable and Scarey is that
The Whole Foster Family (who have been foster parents for 30 yrs., and they have 3 other Handicapped foster children), said they have Absolutely NO Idea that Jennifer had Any Burns on her Back and Butt or How she could have gotten the burns. “Unbelievable!” I Feel Literally Sick To My Stomach Most Of The Time Worrying About My Twins. The Foster Family, Of Course were for the Longest Time Trying To Insist that We Hurt Our Twins During Our Visit. The ONLY THING that “Keeps Us Living IS To Protect Our Kids”. We as Parents Have Been In Such “Incredible Pain and Depression from D.Y.F.S. Taking and Keeping Our Twins, Who we Absolutely Adore and Cherish. Then to Allow and Ignore 2 Documented Incidents of Serious Child Abuse on Our Handicapped/ Non-Verbal Twins that We Struggled 6 Hard yrs. Until GOD Blessed Us More Than We Expected, we had Twins.” To Hurt us Even Further, D.Y.F.S. “Suspended Our Visits with Our Children For Over 3 Months!!! Until they realized we NEVER Hurt Either One Of Our Kids. Our Lawyer all this time, we feel, Should Have Been ANGRY At The INJUSTICE Done To Our Children and Family. When ever we mention that there HAS TO BE a Lawsuit Filed Against The State Of New Jersey D.Y.F.S. for The 2 Reported Incidents Of Abuse on Our Children, she says “The State Has Too Much Power and Unlimited Resources.” My husbands boss has Paid This Lawyer Alot Of Money and we Fell So VERY Betrayed. Everyone who “Knows Our Story”, says that we have been “Screwed by the system, and that we Should Tell Our Story To The Media, and that We Have A Winable Lawsuit.” During this Entire Nightmare, D.Y.F.S. has Made us Do a Never-Ending Service Plan which honestly has made us Broke and Feel Even More Hopeless. Our Twins should NEVER have been taken from us in the First Place. There was Absolutely NEVER,EVER ANY Abuse or Neglect in our Home. They Try to “Validate” Keeping our Twins with Nonsense Reasoning. Our Lawyer ADMITS That For “Some Reason They Picked Our Family To RUIN.” We feel So Wronged By The “Justice System.” We Never Did Anything, Ever to Derserve THIS. The Judges, Lawyers, everyone involved In The Courtroom “Literally LIE To Each Other, and They ALL KNOW IT, and they Get AWAY WITH IT. To whom it may concern:
Hi my name is Christopher Thomas Alexander and I have a problem you might be able to help me with. See my problem is with C.P.S they took my son in November for a bogus reason. The reason is because i am with Judy how has an open C.P.S case and how has Bi-polar. They say she is a threat but i do not see her as a threat and for that they say i am unfit to parent see they got a call in October about me leaving my son alone with her and we asked her case worker if that was a problem and he said no. See Judy has Three kids her first two kids where taken for what I see as bogus reasons and she relinquished her rights to her older daughters because she did not feel she could provide for them at that time and she thought she was doing the right thing as she was not stable enough to support them. Then a year after that case was closed she had her son and C.P.S removed him at the hospital for no reason when she was told she would be able to take him home but on the day of them going home C.P.S came in and took him. Then we met and started dating i have seen her with kids and do not see her as a threat as C.P.S does. I had a Safety plan approved with C.P.S that my parents would check on Judy and my son when I was at work but then my parents had to move to Kentucky to help take care of my Grandparents so me and my parents set up another safety plan where other people would check on Judy and my son when i was at work but C.P.S did not want th hear about it and removed him from my care saying I was unfit because i do not see Judy as a threat. now C.P.S is allowing my son to move to phoenix with them and i lose my visits with him that are everyday now they will be ever other weekend instead of returning him to me and just starting another safety plan because they say i will not follow it when i was following the first one. I have done everything they have asked no matter how stupid it sounded and they are doing this to me. I mean my son has lost his mother a year ago to complications to a double lung transplant in January 2008 and now they are taking his father to and saying that it is better for him this way and i do not see that way. I see this as ruining his life even further. If you can not help can you please forward this to people that can and run this in your paper because what is happening to me is ruining my life and my wifes life.Our youngest child was just born on Mother Day May 10th 2009 and now cps wants to take her too for more bogus reasons.

Fast forward to this past saturday 9 may 09 we get arrested because the prior monday they had a grand jury which us or our lawyer didn’t know about and they filed felony charges against my wife and my self and we were suppose to be in court on 05 may 09 which we weren’t told about. The lawyer we have is about worthless and doesn’t return calls and seems like he is afraid to go to court and doesn’t tell us about meeting that he sets up with the county and because of all of this we are financially drained and trying to pay our house and car payments and various other bills we can’t afford an attorney that will actually fight for us. The best part is that as far as we know the charges state that the day of incident is the day my daughter was born. We need any help that anyone can get right now the only one that’s helping is our caseworker from foster care who has been doing everything to get both kids back and then it got screwed up because of these charges the very government and country that I have volunteered my life to defend and have gone to two different wars defending it and fighting it’s enemies has turned it’s back on my family and failed my family once again and has cause great trauma to my two year old son who still doesn’t understand what’s going and sees his parents get arrested

I always knew life wasn’t fair but I always thought the truth mattered. I have always been patriotic. I am a US Veteran. 2 Days after 911 I called ever recruting branch in my hometown trying to get back in. I would die for my country…even after the recent events that make me question that thought pattern…I will die for my children and I will die for my country…
DSS (CPS) took our son Dalton after his 3 pound smaller IDENTICAL twin was taken from us. I want to believe they really care about the welfare of children but they get ALOT of federal funds by taking children from the home and even more for the adoption process. It seems like no matter who I contact in South Dakota or outside that no one wants to help. There are so many of these cases that without money you have not many options…It seems the poor people are the ones that they target. If there is anyone out there that is willing to refer someone to us or us to someone, if there is any justice remaining in this country, if the truth really does matter to anyone, if any of this matters to anyone and wants to help innocent parents not become the true victim then someone please help us. God there has to be someone out there that cares and that can help

I am in dire need of an attorney in the Prince William County area of VA the lawyer we have now has pretty much taken our money and not done a damn thing to help us and 6 1/2 months after the CPS got involved and we were told that there were not going to be any criminal charges against us they filed felony child abuse charges against us after we have started to get our kids back. like I said I’m in dire need of an attorney that will actually help since the state has destroyed us financially with having us go to all these appointments so we are kinda stuck with this guy since we don’t have a high income being active duty.

I tried to enforce it but I cant prove this. I am working with the bruises this boy leaves on my son, and my sons word about what happened. I have had people camped out in front of his house, but nothing yet. Thats why I asked what I can do. I tried to get a restraining order, but the court revoked it. I tried for emergancy custody, but the court revoked it. I tried to call cps, and the ignored me. I feel like my son is in danger, but I am at a loss as to what to do, and he has his court ordered visitation time at specific times, and the judge warned is that we are to follow it religiously. Now what?

You should have your divorce attorney work on this. In my humble opinion, keep it in the confines of divorce/visiatation -please please please keep CPS out of it.
They will only make it worse.
Possibly even filing an action against you. Just read the stories o nthis site or actual case law and you will see what I mean.
Apparently, when your child visits his father, a step sibling “abuses” him.
Ok, then move for visitation sans the step child.

I am starting to run out of time, I have most tapes from the court proceeding since my husband was his own lawyer. My name is Lori Crumb and I am having an on going issue with CPS. They are forever threatening me, alleging neglect. I am a proud Mother of 6 wonderful children and ever since they were taken from me because an ex boyfriend tried to kill me in front of them, I have been relentlessly harassed! After being separated from my children for 8 agonizing weeks, I finally listened to my court appointed lawyer and plead guilty to charges of neglect for “allowing” domestic abuse to happen in front of them. I completed all the court conditions of a years worth of family counseling and domestic abuse counseling. Now every few weeks they come knocking on my door. I can’t take this anymore! Just today I picked up one of my sons from school because he was ill and I was in the kitchen on the phone when I saw flashes from in my living room. When I went in to investigate there was a CPS worker taking pictures! They had just walked right on in!!! When I told them to leave they said I was not being cooperative and they would use this against me! HELP!!! I am now afraid that they will take my kids away again. Is there any pro-bono lawyer out there that can help me stop CPS from constantly harassing me???

I am a mother of 3 kids 7,9 and 12 my daughter was fondaled and the DHS came in my home ONLY because I asked them to come so that I could get them to investigate the alleged pepertrator since he was out around ather kids, instead now they are all after me. i have been working with them for almost a year now and have complied with everything they have asked. one day out of the blue these 2 other workers that I have never seen before showed up at my door saying my house was filthy and it was none of the such she took pictures of the few dishes that i had in the sink and in the girls room where they had been playing school paper,colors and a back pack was on the floor.A few days later she came back bringing the sherriff with her telling me to sign this so called safty plan I told her that i would take it in the morning to my lawyer and let him look at it.She then pointed her finger in my face and said YOU EITHER SIGN THESE PAPERS OR I’M CALLING THE JUDGE TO REMOVE THE KIDS OUT OF HERE TONIGHT, being scared and threatened i signed.This saftey plan consist of getting a new fridge,and while I was under the influence of mind altering substances(alcohol and illegal drugs)I will protect my children from sexual abuse.This really makes me angry I have never done any drugs neither do I drink AND I always protect my children.the next week she came back over and threatened to take my kids once again because she claimed I was in violation for not getting my sons meds (adderall) infact I took my sons script to the pharmacy 2 days prior I tried explaining to her the process that it takes to get his scripts because the dr only comes once a month.She was irate with me saying WELL WHOE’S FAULT IS THAT OVER AND OVER. she finally calmed down and left.the next week she held a meeting at the school (FAMILY TEEM MEETING)I’m still not understanding what is going on because i have done nothing wrong and i feel like they are violating my rights.I am a white lady that lives in a african american community and when i asked what is all this about DHS stated that the people of this community do not approve of where and how you live.Well its not the black community because i have asked if they had a problem with me. it’s the white community I guess.Back to the meeting their were pricipals, sherriff, DEA, teachers, counselors, and preservation , On my side I had my family and freinds black and white. when the meeting started the DHS worker that talked so horribly and threatened me was telling everyone what the meeting was about and she passed this paper around that everyone had to sign and stated that all this was confidental and that they were setting up this meeting hoping that angel will agree to except what they have to offer instead of going to a judge and making her do it under an order Before the meetting I prepared a speech telling about myself and expressing my concerns on how this lady spoke to me and treated me I had statements backing me up on the allegations I also told everyone in their how she threatened to take my kids for no reason several times,,,at this point the meeting was almost over I had agreed to work with preservation and anything they asked me to do,,,, but i also asked for an unbaised investigation and i asked that the state to give me a drug test to prove them wrong also I stated that i no longer wanted the that lady on my case and they stated that they were going to remove her so that she has no dealing with my case anymore after I made my speech even during this whole process this hateful DHS WORKER made smurks rolled her eyes and still would not hardly let me voice my opinions the DHS worker ran out crying went straight to the judge to get an (informal adjustment) and came to my home that same day and they now are making it where I cant leave the county.they said that my sister and her husband and 3 kids that had been living with me for 6 months now had 1 day which was that day to move out and this was approx 4:oo pm when the order was handed to me the DHS worker said that unless i follow this order the kids will be removed and this matter will be viewed every 3 months. If anyone can please help me from the DHS trying steal my kids for no reason if you think this injust in what they are doing please feel free to write me. do you think that this is violating my rights? Friday afternoon, CPS knocked on my door. Apparently I have been reported as being some kind of a lush who is on pain meds on a daily basis while breastfeeding, and my son is underweight and does not eat solid foods.
None of this is true, except the fact that my 2 year old son is still breastfed. He does eat solid foods all the time. He is in about the 30th percentile for weight, but his pediatrician is not overly concerned and no monitoring of his weight is needed.
I feel like I am being punished for breastfeeding my son.
Here is the situation. I am a mom to four great kids who have all been bf. On May 4 I was rear ended in my minivan. I had severe neck and back pain which had me in the ER on the 5th. I was given a prescription for vicodin. 20 pills. I only took these at night after my son was asleep. I no longer need them, so I am not taking them. My son sleeps through the night.
I am 32 years old and I do enjoy a glass of wine, or a mixed drink at night after the kids are in bed. This is not on a daily basis.
I am also a full time student, and a stay at home mom. I really would not be able to function if I was high on vicodin or drunk every night.
I have NO idea who would even think those things about me.
I was told by CPS that I would need to have a drug test. Of course I said no problem, as I am not on any drugs. I am now in the position of waiting for a random test which I hear will not be pleasant.
I am lost. I am just so scared and feel like I am so alone.
Why should I have to take a drug test when I had a prescription for the vicodin? And I am not even taking it any more??

Phoenix, AZ - We are currently fighting CPS as they have ’stolen’ my grandson Isaiah from our loving arms. He suffered complications at birth and was finally diganosed with Cerbral Palsy when he was about 8 months old. He was referred for several services from the Department of Developmental Disabilities - somehow they dropped the ball as his support coordinator went out on extended medical leave. We made several requests to DDD to provide him services. We finally met with his support coordinator’s supervisor as we were beginning to get ‘pushy’ to obtain services. This woman that had been to our house TWICE and another therapist from the Foundation from the Blind decided to call CPS and make false allegations that we are all alcoholics and our home is a hostile environment.
CPS only took my grandson not my 3 year old grandaughters. They detained us at the CPS office while they went to our home and stole him away. CPS supervisor threatened to hav e us arrested and the police actually took out their handcuffs!! They forced and tricked my 19yr old daughter to sign the form giving the state temporary custody while I was in the other room.
My daughter has a court appointed attorney which is useless - He refuses to make an appt with her to discuss her case - ‘Just do whatever CPS wants…’ how classic. He refused to submit a Declarations of Facts / Ommission and Corrections form. “I don’t do those.” He further refuses to gather any information to defend my daughter and our family from these downright vicious LIES.
Why should he care he still gets paid right?
We saw my grandson about 2 wks after they took him - he had scratches on his arm - welts on his little bottom (diaper rash?/filth) and he smelled like he had not had a bath for DAYS. Of course the CPS worker did’nt find anything wrong with him. We took pictures though.
If I had of known about the 4th amendment they would have never got past my driveway!!.
We really need a lawyer who will stand and defeat these heartless, ignorant state employees but of course if you are the working poor and have no money - then what?
Any suggestions would be most welcome.

You need legal counsel NOW. Personally, I would not submit to any drug test administered by CPS. Go and get your own through your own family doctor and get an attorney now.
If you do not have the means to hire a private attorney (though it would be worth your while to do same). Look into any non profit group in your area that may be able to represent you. Look to Law School law clinics.

Can somebody please give me the name of an attorney who can help me get a false report that is currently legally sealed expunged? I am traumatized from the investigation which happened due to my ex-wife (wife at the time) having violent intrusive thoughts about me after my baby was born (she had post-partum depression). Her social worker filed the report out of malice because she was against men being alone with a baby and she took my ex-wife’s violent thoughts and added my name to them (all can be proven in affidavits). I need an attorney to remove this “blemish” from my otherwise “clean” record so I can get on with my life (I now want to start a new family but I am still traumatized from the investigation which took place over 6 years ago). I had an isolated incident of “domestic abuse” where I went to jail for defending myself. While I was outside, my then boyfriend, who did not live in our home, woke my 15 yo daughter to have to talk to police. She was listed as a witness. Btw, he is a convicted drug felon, while in jail, the cps search my home and questioned my children WITHOUT my consent. Twenty-four hours later, in jail, they presented me a paper to sign for consent to an investigation. They said If I didn’t sign they would put my children into foster care. There was a no-contact ordered on my ex and my 15yo daughter, as they didn’t show up for court as instructed by our local police dept. Had they had shown up, my daughter would have been home. I placed my daughter with friends, then filed a pro se motion and got her returned home. Cps was now angry. Also, they wanted me to sign their “case plan” which included classes which I cannot afford much less in need of. I refused and sent them(cps) a revocation of consent based on the Color of Law, as my consent was obtained thru duress. Cps had talked to my family, my children at school and even referred another agency to conduct checks on my children. This agency states if I do not allow them questioning of my children, they will go to the childrens school and conduct them there! My children have been thru enough! Now, to add fire to the fuel, they have sent a letter to my daughters (the 15yo) father who is now homeless and a crack addict stating that they can not find any family members for her and need to place her out of my home. They have not contacted me. To my understanding, a court date has even been set! June 1st at 9am!! I am a single mother, Paramedic and in Nursing school. I was lay-off last year but care very well for my children, but do struggle. Oh, the smaller daughter (9yo) has never left my home, and is not mentioned in above case. What do I do??? I feel violated by CPS and want to be left alone as the continued stress is difficult. Can anyone advise???

Continue to hold CPS to the line! You are already on the right track. On this site, read EVERYTHING on your constitutional amendments #4 and 14. You are going to need them right away! Know them inside and out before June 1st.
You do NOT have to consent to anything. However, please talk to your children just as you would about “stranger danger”. In most states, CPS can and will go to the kids school, and the schools ARE REQUIRED to allow CPS get to your kids!
My granddaughter was literally called to the office, placed in a locking room to sit. Then the principle, vice principle, school cop, nurse, school counselor and 2 CPS investigators entered the room, locked it, and refused to let her out for over 1 1/2 hours!!!! They kept telling her that until she admitted that her mother hits her, they would not let her go. She was so pressured and badgered that after 1 1/2 hours, she gave in and said “okay, she does” Is that what you want to hear?”
Trouble is, then they sent her under guard of the cop, to the hospital by ambulance for a check up, only to find nothing wrong. She had no marks or anything.
Now yes her mom slapped her disgusting mouth ( 1st time ever) for what she said! Anybody would have found it hard not to slap a teens mouth for those awful (pornographic) words. But that is hardly a reason to split up a family permanently! It did happen though!!!!
After 17 months, we, the grandparents, have total legal custody and a closed CPS case. That is another story in itself. Grandparents usually lose the grandkids forever.
The bottom line is to arm yourself with information. Knowledge IS power…truly!!!!!!!!!!!
And also arm your kids with power. Maybe not the legal knowledge as they are young, but certainly explain over and over again what CPS is going to do if they talk these people at all. And prepare them for the future. CPS had been pulling this stuff on mine for 4 long years! And they never got anything they could use until that day…wrong as it was.
Drum it into their heads…please!

My boyfriend called 911 saying I hit my son because HE WAS MAD AT ME. I never laid an ill finger on my child and there is no proof whatsoever that ANYBODY EVER HAS. I am not allowed to see my son unsupervised or sleep in the same house! My son Ocean was 6 wks when this happened. He is now 3 months. Me and the father have since then worked out our problems and if they would let me return to the home I could stay at home all day with him as I did before. The father has nobody to babysit while he works, so CPS is saying Ocean needs to be in one stable home. They took my son from me with no just cause, and now they are asking the fathers family to adopt him!!

The prosecutor is adiment on prosecuting us even though we did nothing wrong and because of this we have almost no money and we have wrote our senators and represenitives back home and they said they would love to help us since I’m military but since it is a state affair and not their state they can’t do any thing and the ones from Virginia won’t do anything either. anyone know of an attorney in northern Virginia that can help please pass their info on to us so we can save our family from CPS who wants nothing more then to keep our kids from us and got pissed when they found out that our kids were being returned and then all of a sudden these felony charges got brought against us even after the common wealth attorney said they weren’t filing any charges. thanks in advance

And boy, DCYF has challenged this courageous attorney for years. She really champions the *fit parent* who are often just overlooked by CPS. Usually these are Dads who are disempowered.

I’m posted for my sister, who does not have internet access. Nine years ago, she lost an infant daughter to CPS becuase she could not pay medical bills. She was told (erroneously) that her daughter died. In a fit of depression, and what she calls the worst mistake of her life, she attempted suicide. CPS took custody of her two boys. Her mother was given her oldest, white child. Both her mother and myself were denied even a homestudy or a chance to take care of her youger, mixed child. The reason given? He “needs to be with his own kind” and had to “go to a black family”. When my sister finally went through treatment and got her life back on track, she was immediately given back her older son. She was told by the caseworker that she would never get her youngest son back becuase she was white and couldnt “teach him about his black heritage”. Im not making this up. He has spent the last nine years in a foster home where he reports that he cries himself to sleep every night and the fostermothers daughter was put on probation for molesting him. But they are now living in the same home again. He outcried and CPS is finally looking into alternative placements. But, if my sister was deemed fit to get back her other child, whom she raised to adulthood since then, why werent BOTH children returned to her? I mean, either she was fit or unfit, why was she fit to raise one child but not the other? This cps worker was rascist plain and simple and its way past time that this situation is redressed. I live in YORK, SC and need legal advice from someone who will help. I have 10 wk old twins who have been removed from my wife and I home. I was told to leave the home and my kids could return with my wife, but it’s been 11 days and they are still not home, and i am not allowed even supervised visits with my twins, NOR my soon to be 10 yr old son who is perfectly healthy now despite also being a premature gastroschesis baby. My wife and I have absolutely NO criminal record, and our twins were 7 wks premies at 4 pnds. in 10 weeks they are both healthy an up to 12 pounds now, but i have pretty much already been “guilty” in DSS’s eyes even tho i have jumped through every hoop they put in front of me voluntarily with no legal council. My oldest son turns 10 in a little over a week, and DSS will not give me supervised visit with knowing this information no matter how much i beg them. Someone PLEASE help. Friday I put my 9yr old punishment (no games/computer) because he wasn’t doing well in school. Saturday morning I woke up to find that my child had run away (taking his game system with him). I was told the cops found him, never told his whereabouts, never given a name or number. After tracking down information through 311 and with the hepl of others, i got a number to where he is but was only told he was with acs and that a social worker would come to my house. I have been waiting and calling repeatedly to no avail. I was told by a friend that was a former police officer that my child should have been brought home to me immeadiately once they confirmed that he was mine. He should have never been brought into the custody of CPS especially sinc ethey found no evidence of abuse and he told them himself that he ran away because I wouldnt let him play video games. I find this to be so extremely unfair. If anybody has any information, a lawyer name and phone number or even an advocate please let me know. Thank you

It is standard practice for ACS to take children on a Friday and keep them.
You can and should go to court to demand a hearing to have the child returned. You should do this as quickly as possible as the longer they have your son, the more damage will be done.
Please tread carefully. Do not trust ACS.
Whatever Peter costs or any other able lawyer you find, use them. It is important to nip this thing in the bud. ACS is caught off guard when an attorney is involved at the getgo.
Stay calm. Use the law, the law can and will aid you. ACS does not follow law, they are too arrogant to do so.
Please join the message forum and I will give to you all and any info I have on ACS and their workings.
I will also help in any way that I can to assist you in mounting an argument to have your son returned.

I am also having a problem with Childrens Services and the removal of my 6 children. They will not even return my children that weren’t even part of this case. My kids are 7 7 9 13 15 16. I used a belt on my 9 yr old. My 16 yo wasnt even home and the 15 yo and 13 yo was but wasnt even apart of the complaint nor were the 7yo’s. I have since read things one line that they shouldnt have done but did. I have a court appointed atty and isnt doing what i feel he should he was supposed to ask for the return of my 3 older children when we went to court and didnt and didnt even try. CPS even stated that the 13 15 & 16 yo are able to know abuse leave or get help. So then why are they not home? There is so much more as with everyone its a nightmare. I am in SE Ohio. Even if someone could even walk me thru all this I would be forever greatful…But if there is an atty available to represent me i would love it but like I said if you could just walk me thru all this I would be so greatful. Side note my 3 younger ones dad and his parents are mentally abusing my kids and he also took our son picked him up by his shirt collar and threw him into a chair telling my kids u will never see your mom again or live with her either if i see your mom out i am going to break her legs. His mom told my 9 yo that she was going to choke her if she didnt stop doing something and put them in foster care and make sure they were all separated…I have made CS and the GAL aware of this as well as the kids told them CS asked them the children if they thought it was a safe place to live and the kids said no but they are still there whats up with that…I wont go on and on but if anybody would like to know more or chat or has any advice please email me at hoopn.it.up at gmail.com

Arkansas 8th judicial needs an attorney for a class action lawsuit that has been filed pro se by Aimee Hankins, and so far has at least 7 persons adding their complaints. This is regarding false cases built by DHS (CPS) to remove children from their homes. In our case, they were not successful, but we went through almost a year of near panic and anxiety, not to mention the money it cost to fight them off. Reading these posts is heartbreaking. I am in desperation to find a laywer with the balls to fight the CPS case against me and my son, concerning his 30 mth. old twins. At the end of April, 2009 CPS took the twins away because they say I am a danger to them. I told someone I had a vision of the boy in a school picture and my hands were reaching out to him. This person reported me to CPS and said I was trying to strangle the kids. I have vehemothly denied this statement. Just went to court and no laywer, so Judge just shot me down real quick. I now have my name on a perpertrator list. Where is the justice? Judge would not allow me to have a jury trial either. This is just such an injustice and I really feel the court and cps has violated my Constitunal Rights. Please if there is anyone out there that can help me in my area, I would appreciate it. I live in Coryell County.

I have a relative that is 17 years of age and has 3 children. Her mother is in jail and she’s been shelters, sleeping in cars, because there is nobody to help her. Her on father and I would not call him that because he is not. The 2 older kids are with there sperm doner, but the baby is with her, now cps is taking her baby because she cannot provide shelter for her? This makes me sick to my stomach that this country has turn into this. And my research on cps turn my stomach. My conclusion is that cps is not here for children but to destroy children which our government can care less about. please respond to me as what route she needs to take to fight this fascism.

My 3 month old son Ocean is now in full custody of my boyfriend. I am not allowed to see Ocean unsupervised or sleep in the same house all because we were arguing and he got mad at me and called 911 saying I hit my son. There is no proof of these false allegations, CPS keeps passing my case around from “supervisor” to “new caseworker” like a freakin hot potato! It has been 2 months now! My boyfriend has to rotate between 4 different babysitters, cant afford daycare, and they’re about to put Ocean in FOSTER CARE because he is not in one stable place!! ALL BECAUSE OF A BOGUS PHONE CALL!! I need to talk to a lawyer to see if there is any appropriate paperwork that can be found/filed to allow me to live with my son again without having to go through the bs of the court system. I never laid a finger on my son, theres no proof that ANYONE HAS, and if I could sleep in the same house as him as I was before, he would be in one stable environment, which is the only thing CPS is insisting on. Aside from counseling obviously.

Im Jack from York, SC posting an update on my previous post from may, 24. Sadly, NO lawyers contacted me about my case. Not sure why, but never the less no one did. I found out that the police closed their case 2 days after the accident, but somehow DSS lost or didnt recieve the report (what a coincidence) So i got the detective to e-mail AND fax the report over to them, and now they are saying my children will most likely be returned home TOMORROW!!! It does seem like DSS was neglectful, and they prosecuted me immediately, but they have found their error and my caseworker is now trying to correct it. What should have been over in 3 days (when they recieved ALL reports from doctor/police) took over 15 days, but i am exstatic over getting my kids back. I will continue to pray for all of you to recieve the justice you deserve, and your children who have to endure CPS/DSS procrastonistic horror that they call protective services. Jack

I have been fighting CPS for over a year and half now. My husband and I have done everything they have asked for and they promised us that on June 1, 2009 we would get our son back. I get documents in the mail 2 days ago and we goto court monday telling me that they are not going to give my son back. That we nonchalletly did our stuff and they we didnt seem like we cared if we got our son back and also that we still have not admitted that we did something wrong that they feel that its in the best interest of the child to let his grandparents adopt him. This whole case was built on lies from my older kids that were also takin from me and given to there Dad and I have no visitation with them at all. The Sherriffs department did the investgations and told CPS that none of it was true not to take the kids and they waited till his day off to take the kids. They never came and talk to me in person just 5 minutes over the phone and they never came and talk to my husband and they never saw our house NOTHING!!! We have never been charged with anything and now there saying there not gonna give my son back to me and I need help desperatly!! My court apointed attorney is not helping like he should be. PLEASE HELP!!! I just want my son home!

Last June. Which would have been 2008, My now 2 year old daughter was taken by cps for a near-drowning incident.
Her father was in Iraq at the time, and was sent home and told he was brought home to get custody of her, nearly
6 months later he FINALLY got custody of her. Cps has been telling me that if her father and I can come to an agreement
on a parenting plan that they will back out of the case, and close the dissolution. Which that happened today, they
did not agree with our parenting plan, and denyed it. They used the fact that my ex of 5 years ago had assualted me, and
also that I had a criminal record, from 1997-2006 (*I was ages 11 to 20*) I am now 23 and there have been NO criminal
cases since then!
I dont see how they can use this against me, and considering it has been ALMOST a year since this Cps case was opened,
I dont understand why they are still not approving unsupervised time.
Cps also realized recently that I am expecting another baby. She is due in July. I believe that they are only keeping
this case open so they can gain custody of her when she is born also. Now, I dont know much about the laws on them being
able to take this baby, it is a different dad and a different case.
My question for an attorney is, Will they or can they take this baby from us? What would happen if I had her in a different
jurisdiction? What would be some services I would have to do? I will be calling an attorney if they show up at the
hospital, I just want to know what I am in for before it all happens.
I am now 34 almost 35 weeks pregnant, and am due on July 5th, but have had preterm deliveries with my previous children. I
am residing in Washington State.
Please send me a recommended attorney, or knowledgable attorney in this aspect.

She goes back and tells DCYF everything which is supposed to be confidential between Attorney and client. She used to work for DCYF. Most of the court-appointed Lawyers in these cases do nothing for the oparents because they are being paid out of the DCYF budget. There is a group of us in Nashua who are going up against DCYF at this time. We have reported all of the fraud and corruption and an investigation is underway. A dear friend just had his parental rights stripped and his daughter adopted out from underneath him. We believe this was not done legally.
1. The child was removed from custody because the mother was in a car with her cousin - both were drunk. The child was with them naked, no diaper bag and the car seat was not strapped in. They almost hit a police car. The father was at work and had no idea this had happened. The police did not contact him. Nobody contacted him. he was never given the opportunity to come and pick up his daughter. CPS removed custody of both parents. (even though they were separated at the time)
The mother falsely accused him of DV and he is currently serving time on violating a protection order - because she came to visit him in jail.
The child was placed with the maternal grandparents who live in a house with a maternal uncle. All three are reported alcohol and drug abusers (as is the child’s mother). A babysitter reported that the child was underweight, showed signs of neglect, was often found dirty, and smelled heavily of smoke everytime she was picked up.
The family reported to the babysitter that the child had been adopted and had a picture of a baby’s room that the adopted family sent them.
This was all “before” a court date that the father attended where he was told there was a claim that he was not the father.
A paternity test ensured that he was indeed the child’s father (which btw was never reported to him - he never heard back from his court appointed attorney - He never received the results of the test. The family told people the test results and they reported back to me) He repeatedly called CPS to find out what to do next, but no one would accept the charges.
The family kept telling people that CPS assured them the adoption was finalized and the child would be removed “In a week or so” all of this was occuring while the father’s parental rights were still intact.
He began writing letters to CPS because no one would accept his calls. Suddenly without warning on 5/27 he was removed from jail and taken to court and his parental rights were stripped. The court stated the baby should not have to wait until october when he wll be released from jail. This was a new judge, not the judge he had been in front of several times before. He did not have time to call in witnesses to prove he had arranged for a home for himself and his daughter, was working on a business from jail and had a way to provide for his daughter and so on.
His court appointed attorney simply told him - “Hey, at least you don’t have to pay child support.”
Please HELP! He wants his daughter back!!!

Need help in Colorado!
Infant daughter of a friend was taken while he was at work (by fault of mother). he was never notified by police.
We believe an approval for adoption was given while his parental rights were still in tact. They were under the assumption he was not the biological father. Then a cover up and scramble to remove his rights ensued.
He did not recieve adequate counsel, was not allowed to build a case or present proof of competency or provide character witnesses.
he did not recieve court dates until the morning of the actual court date.

IT WAS SO BAD THE STAFF SEEN MY SON IN THE ROOM WITH THE PERPETRATOR AND DID NOTHING AT ALL. NOR DID THEY REPORT IT TO THE POLICE. IT WAS WHEN MY SON CAME HOME THAT HE BROKE HIS SILENCE. My son was removed from our home on December 19, 2008 due to allegations from DSS CPS Baltimore County alleged child abuse. I have two children, CINA petition was filed on both on December 15, 2008 by social worker who testified on behalf of punitive father (not on Birth Certificate) and did not disclose to the Judge the CINA report information which clearly stated both parents were incapable of caring infant son, Mother mental health issues and Father admitted to Drug addiction to the worker, no employment and no custody or visitation of two children fatherer. DSS CPS was allowed to misuse CINA petition in order to change custody contrary to the Law. This is systhemic injustice to say the least. I was told if I did not tell my public defender that I would dismiss the exception hearing for CINA that DPD filed that I would not ever get to see my son or have custody. I was devistated and so scared I followed their instructions. I see my son 3 hours a week supervised. I am fighting with all my might and my family members as well. A protective order was file on 12/19/08 stating I tried to run my mother over with my son in frt seat. Never witness, no police report and it is not true. There are many allegations that were never proven and the day of th FPO my attorney asked if there were any reports that he needed to review so that he could properly prepare my case the social worker stated it was in her office on her laptop and the Judge did not disclose the document written by CPS to my attorney. Social worker never liked me, she was cruel, rude and odious and always made statements that I was sick and floridly mentally ill. She lied on my 10 year old who can testify to many allegations that were not true, as well as, tried to get her removed but the Master’s denied CPS twice and that is why this social worker unethically skated and told the petitioner to file for a PO, told him what to write and how because she knew that PO supercede CINA petition. My 10 year old is an honor student with perfect attendance and does not fit the perscription of an abused child. If child abuse was suspected why were’nt both removed? where is the report from hospital? doctor? where are the investigation files? where is the prove of the allegations? Rule 801 hearsay plays a big part in this and I really need a lawyer’s expertise. I know with all the research and supportive documentation that I have we can get my son back to his home and family. Please help ME!

I am in need of a CPS defense atty. My ex is using the CPS to get ahead in the current custody battle. He was losing, and he has made 6 prior accusations, all found unfounded. Now, he has made yet another, and this time its being taken “seriously”. The social worker interviewed my ex, and interviewed my kids, but she has not interviewed me, or my husband. She sent a different worker with a list of a few questions, but will not come out here. When I asked her what her plans were, she outright told me she intended on placing my kids with my ex, and i was going to get supervised visits… all without even interviewing me. There is 1 bruise. She told me outright she believe there was something going on in my home, and that she was placing the kids with him. My ex was currently being investigated for having munchausen by proxy.. and she said “ill make a note” and hung up! Everytime my ex has brought them in to be evaluated its been at least 24 hours since in my care, and Im the one being investigated.
I need an attorney, and I need one now.. anyone know someone I can get in Milwaukee County?

On Tuesday June 2nd 2009 a New Jersey D.Y.F.U.S social worker went to our children’s elementary school detained and questioned our two children ages 8 (girl) and 5 (boy). I do not know how they were treated or what they where asked during this inquiry, who was present while they where being questioned or why couldn’t they contact a parent before they did anything. The social worker then came to my residence entered our home and informed us that they where investigating an “Anonymous” complaint that we where neglectful drug addicts. These allegations are baseless and unfounded. My wife and I live and breath for our children. We are loving, kind and supporting parents who put our children first. Now we must comply with their orders and sign papers admitting something that is untrue and insulting. I can not defend my family with my basic legal knowledge all I know is that I am an American and I have constitutional rights that no Government can impede upon and there are other Americans that will help us protect our rights. Please contact us ASAP we are under great stress and don’t know where to turn for help. God bless American …… Thank you

My three boys were taken from us on october 9th. After my youngest son passed away in his sleep at nine months old. Even though this was caused by SIDS. They harrased us while we were at the funeral home arraging my sons funeral. Then on March 9th my daughter was born were the took her from the hospital. So now they are blaming us for Hunters death aznd saying we are unfit parents because we could have prevented his death.Its been 8 months now with no progress. I need to find legal help for my daughter who is beings accused by her boyfrieds daughter of neglect and abuse. My daughter has done nothing to this childl; she has only ever wanted the best for this child. There are three younger sons who have been removed from the home because of the accusations this girl has made. How can you defend yourself against something that never happened?

I am looking for an attorney who is willing to fight for my constitutional rights that have been violate by CPS and local law enforcement. I live in Allegan County, MI. I have spoke with a few attorneys in the area, but have not found anyone who is willing to fight. Is there someone who is willing to fight, but won’t cost me everything? Jefferson County Colorado - Need an attorney to appeal the revocation of parental rights and removal of a 1 yr old daughter.
Mother had daughter taken away due to endagerment - Father was at work and never notified or given chance to pick up daughter. Before situation could be settled - father was incarcerated. Judge stated that the daughter should not have to wait for father to finish sentence (13 mos) and treatment program (probation/classes 24 months). This does not seem in accordance with state statute which states rights can be removed if parent is not eligible for parole or release in 36 months. He will be out on Oct 4th.
Also he did not receive adequate legal representation from court appointed attorney and no one explained the process or his right to appeal to him.

I live in NYS, Erie County. Can you sue a CPS worker? We’re recently going thru Hell here with weekly home inspections and such because the CPS worker came to my door with police and actually arrested my husband. The guy came to the door with 5 cops, forced their way in and began gangbusting throughout my house, claiming that there was cat feces and urine and all sorts of ridiculous stuff in the house and that it was unsuitable for the kids, who they took away. They were returned within a week but my husband is still going through criminal court on charges of child endangerment/neglect and in order to keep my kids I must endure WEEKLY home inspections–the woman Constantly smells cat urine, and I shampoo the rugs daily, and wash the floors with bleach daily NO CATS!! Kids rooms never had feces or urine, and neither did the house!! This CPS worker CLEARLY lied to someone to gain police action since he’d not been in the house At All until the day he showed up with cops! Is there legal action I can take once this ordeal is overwith, if it’s ever overwith?? This man, by charging my husband and indicating our case, has ruined any chances the 2 of us may have of finding work again! We’re going to be labeled Child Abusers until my 5yr old is 28!! This is going to be a wonderful find on background checks by future employers! We’re also thinking of moving away soon to seek employment/start a business in a state where it’s easier to do so, what is this going to do us?? Will we be able to move away without someone gangbusting our house again? I REALLY need some advice here. I have a lawyer, but he says that this will be resolved easily and I should drop it when it is resolved. I really don’t want to! He made us a spectacle in front of neighbors and traumatized my kids, who saw their father tackled by police and arrested when he walked into our house after being called by a friend who saw the commotion! I appreciate any advice on this matter. I’m scared and confused! Thank you.

He made False claims to gain access to my home. And all this was based on an anonymous call from someone who isn’t required to leave a name, phone, nothing! In other words, you can play games with people’s lives and not have any responsiblity for ruining a family! I really want to sue this person for the harrassment and the false arrest, tresspassing, Anything! I live in Buffalo, NY.

Hi, my name is Melissa. I am fighting CPS right now. I just had a fair hearing and I lost it. My legal aid lawyer said he knew a girl that had the same situation as me and she won her case. Now my name is in the child abuse registry. They told me I can appeal the decision and take it to the supreme court. I need a lawyer, can anyone help me?

CPS basically has immunity.
But there is a procedure to have your child abuse registry files either amended to unfounded and sealed and/or expunged.
Much will depend upon the criminal court determination and/or family court determination.

I have been forced to deal with the so-called Child Protective Services for almost three months, and it is really causing my wife and I a lot of undue anxiety and fear.
They say that they are part of investigation into an accusation against me and activities in my home.
The police, prior to CPS ever showing up on the scene, came and did an investigation of the home and the property. They found it clean, and they closed that case concerning that incident. I have the police incident report and its status as being closed right in front of me.
CPS has since come to my house on three occasions, each time “requesting” that my wife, my children and I all give them a urinalysis. No warrant. No allowing us to stand before our accuser. Telling us that they just want to prove our innocence. What ever happened to being deemed innocent until proven guilty in a court of law by a jury of your peers?
Now, they claim to want to close the case… on the condition that I give them yet another urinalysis. These are random, and we are on attempt #4 by them as of this morning.
They use threatening tones, talk about “moving forward” on account of my non-compliance with their subsequent demands, but never tell me what “moving forward” entails.
All of this puts us in a horrible situation. The Constitutional rights of privacy and of being secure in our person are being trampled on and my wife and I are terrified of what may happen to our three beautiful, happy, and godly children, Samantha, Athanasius, and Ambrose.
I don’t know where to go for advice. We just feel lost, abused, and very confused.

3 weeks ago coming up this thursday, my parents filed “neglect” charges on me, the next day [friday] when i dropped my son off at school and went to pick him up, HE WAS GONE. my son, 6 years old, was taken away from me over night. i have NEVER even “smacked” my child, let alone be accused of “neglect”. im horrified!!i am SO lost and SO hurt, i now feel so depressed and alone inside… i miss my son so much, i’ve NEVER been away from him EVER!! and am now only allowed 1 hour a week to see him. i truly believe that my parents did this to me because finacially, they are losing everything, their home, cars, everything, and now they are considered his “foster parents”…i really need some legal help.

Jeremiah, I’m glad you’ve now found the community of families online who are fighting against false CPS accusations. You can get more feedback on your case through our message board. There are also many other sites you’ll want to look at such as AFRA. In your case I suggest you get a lawyer right away. You’re so right that the requests for drug testing are unconstitutional, but if you refuse, the caseworker might go to court because of your non-compliance. You need real legal help… no matter what the cost. That’s my opinion; I’m not a lawyer and can’t give legal advice.
The number one thing that can get a caseworker to drop your case before the children are taken away - is a good lawyer on the family’s side.
