Child Protective Services laws and agencies are abusive to families and children. This site provides support and information to parents falsely accused of child abuse by Child Protective Services.

FightCPS does not advocate or condone violence or illiegal activities of any kind.

FightCPS is intended to help people learn enough about the law to be able to successfully defend themselves and their families against false accusations using legal documents and strategies that put parents in a stronger position when they go back to court.

For more information, see the FAQ.

Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.

Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.

Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.

Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.

Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.

CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.

Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.

It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Site mission: To provide information and support for families attacked by Child Protective Services and child welfare agents, especially those families facing false or trivial accusations of child abuse or neglect; and for researchers working to protect natural family rights.

Medical Records – Is Your Hospital Asking To Release Them To CPS?

I received this in email from Diando this morning:

My daughter went to get an MRI yesterday and one of the papers that they tried to have her sign was a release of records to CPS. She of course refused to sign it.

I think people need to be aware of this and read all the fine print when filling out forms from medical treatment. If there is something to that effect in the paperwork have them make sure to mark through it and clearly state that they do not have permission to do so.

Thanks, Diando, for letting us know…

  1. D.Y.F.S. here in New Jersey have people that work for them that give up the hospital/doctor records of the mother and children by using fictitious names via fax. In New Bruswick New Jersey, Robert Wood Johnson release YOUR confidential information without your consent to the D.Y.F.S. (C.P.S.) under the false name of ‘Child Health Program’ 301 Blairs Rd., Avenel, NJ. This is the physical address for Grocery Haulers a.k.a. as ‘Pathmark’ !
Parents in New Jersey DO NOT use Robert Wood Johnson for ANY prenatal/post natal services. Your records WILL be in the hands of The Division of Youth and Families before you blink an eye….then they will come to take your precious babies!!! The Deputy Attorney General Susan B. Pietz tries to prevent parents from obtaining information from the hospital to show that their cases are built on lies. If a parent contacts the hospital, the records department contacts D.Y.F.S. who then calls D.A.G. Susan B. Pietz who tells them not to release your records because you have a D.Y.F.S. case. It’s done to prevent you from discovering the truth. Now you know the truth.
I can prove what I say – they cannot!

  3. It’s scary whenever someone asks you to sign something. And it’s scarier when it happens inside the hospital where people should be safe and protected. Thank you for sharing this very important info to us.

  4. Oh wow! I am having a baby, and my attorney says they won’t have my information. I will remember this thank you so much!

I was a nurse in NM, and never seen this happen, just to let you know, if anyone from there reads this.

  5. No one should EVER sign something that they haven’t read thoroughly and understand every detail. You can trust no one, even if it’s the same doctor or pediatrician that you have had for years. If you don’t agree with something, put a line through it and initial it with the date and time. Write next to it that you do not and will never give permission for things like that. Even if it looks legit. don’t believe that a company like the above mentioned is on the up and up unless you know for absolute certainty that the company is what they say it is and that they provide the services that they claim to provide. You can also, (and I strongly suggest,) write next to your name, “all rights reserved,” after all, your signature is more valuable than you realize.

It’s always nice to here from you, Diando. Thank you sooooo much for this information. I will make sure that all of my friends know about this.

  6. HEALTH RECORDS AND PRIVACY

The medical releases ( which hospitals and birthing centers employ ) have often been drafted by attorneys.

Do you have a personal attorney advising you when you give birth?

We are giving up more privacy protection, because of the need for greed.

    HiPAA ( hip ah )

Hold off on signing anything. Excellent advice.

Remember that hospitals, too, are losing staff. Health care costs approach 20% of our economy.

  7. Thanks Fern. My attorney is aware, because when I found out, I wasn’t sure what to do. He says they cannot take the baby unless they have a court order, or if I do drugs. Which, I have not or ever have.

I will be reading and have read everything that I sign or signed. I am a RN myself, and had to ask some of my fellow nurse friends what would happen. They also said, due to the circumstances that it wouldn’t even be in my medical chart.

I know for sure that I do not want any Social Workers visiting my room. That is a given.

  8. Hey Badd addiction, or anyone else for that matter, have you considered having your baby at a birthing center with a midwife, or having a home birth with a midwife? I had my second child at a birthing center with a midwife and it was a wonderful experience. A birthing center would be safer as far as allowing Cps access to you or your baby.

  9. Just an update. I had my baby, he is home with me.

The admitting nurse did report me to social services in the hospital and said that I smoked marijuana during my whole pregnancy. I didn’t find out till the next day after my c-section. Of course they did a tox-screen and it was negative for me and the baby. They don’t need permission to do a tox-screen if they feel their is danger to the newborn. I don’t do drugs. She must of assumed that all persons who have CPS in their life are drug users.

So me being a nurse, have requested for her to remove that information from my admission paperwork as it could follow me around everywhere! All I have to say about her is *&^%$! lol… The father, family, and friends aren’t too happy with this nurse and if it was someone else they would probably have her fired. I am not sure what the outcome for her will be, but hopefully she learns that not everyone who has a DCF history is a drug user.

The hospital’s social worker just confirmed my case with DCF and that was it. It is closed. She didn’t feel the need to file a 51A as the nurses and doctors spoke highly of me as well. I also have a Home Health Nurse come in as another resource to prove that I am a good mother.

The thing is they can’t report you if you didn’t do anything and I don’t know if it is different in every state. But, they have to open a case for EVERY child before they take them. They can’t just take them because you have a history. That isn’t what they do here.

    Comment by bdaddiction — April 28, 2009 @ 4:13 pm

  10. You have to remember nurses and doctors are mandated reporters. Even if you had your baby at a birthing center the midwife can report you or check with social services. Futhermore, the doctor at the baby’s first visit can too? What if you had a history and you indeed were guilty of something. Not everyone is innocent with CPS, even though they aren’t the best service to deal with. The nurse could lose her license if something happened to the baby. Especially, if she knew that you indeed had a history.

As my attorney says, “Just don’t mess up, you are under the spotlight now.” and the Social Worker at the hospital said, “It will follow you everywhere, but when you prove otherwise it usually works out for the best.”

My thing is honesty is always best, I have nothing to hide. When you hide it just makes it worse.

    Comment by bdaddiction — April 28, 2009 @ 4:18 pm

  11. Basically, I wasn’t upset at the nurse for calling the social worker at the hospital. I was upset that she lied in her notes stating that I smoked marijuana my whole pregnancy.

It made her look stupid when both the baby and I were negative. Seriously, what a joke!

DO i HAVE TO DO WHAT SHE SAID? mY HUSBAND IS WILLING TO GO TO COUNSELIMG AND MARRAIGE COUNSELING? MY DAUGHTER DID NOT WITNESS HIM EVER HITTING ME. I DO NOT WANT TO DO THIS, I AM BEING FORCED. PLEASE HELP ME.

    Comment by leslie R. — July 4, 2009 @ 1:35 pm

  13. Leslie, if that is what she’s saying then yes, if you want to keep your daughter you may need to divorce your husband. Many people lose their children because they can’t protect them in a domestic violence situation. I suggest you see an attorney for help with this case as soon as possible. You’re in great danger of losing your child. I’m sorry, but as one who lost mine for eight months due to domestic violence, I feel I have to warn you this is a very serious situation. Good luck.

  15. I am currently being investigated my CPS because my daughter broke her arm and said that her daddy made her do it, they assumed that meant that daddy did it. in the investigation the social worker contacted my childrens (I have 2 other children who are not part of the investigation) and was given information about the last time they were seen by her, and times they were sick and even that one of my boys is behind on his vaccinations (because he was sick I did not take him in to get the shots, I was informed not to do it during a cold or any other illness, also because I didnt want the symptoms from the shots to make him any worse, he is only 6 months old). The social worker said that the doctor has to give her information during an investigation but I feel that my childrens doctor patient rights were violated. I was never asked to give permission for them to get any information from the doctor, the social worker did it behind my back. What can I do about this, if anything?

    Comment by Kayla — April 25, 2010 @ 10:30 pm

  16. Federal patient privacy laws (HIPAA) keep patient records private from almost everyone except HHS (health and human services) workers. It is another fraud enacted at the federal level to violate us by giving government agents more rights to look at our records and talk to our doctors than our own family members have. Everyone thinks that was about patient record privacy. There was a small clause included giving HHS access. The public needs to wake up and realize the federal government is overstepping its bounds in every way possible. All this (and all of child welfare as we know it) would be null and void if the tenth amendment of the US Constitution were being honored. That’s why I support the state sovereignty movement.
