Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.
Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Fighting Child Protective Services False Accusations

Baby Alyssa had bone fractures, but why? Social workers reacted by taking her away from her parents, Dave and Tiffany Cuin-O’Shell. When they took baby Alyssa, Tiffany was hysterical. Wouldn’t you be?
That was only thirteen days before she died. Police officer Dave O’Shell, suspected of child abuse and expecting to be arrested at any time, apparently snapped. He shot his wife, then himself thirteen days after the Colorado CPS social workers violated their lives.
Only two days later the foster mother said at a court hearing that the child had something wrong with it. Genetic tests were ordered and it was discovered that baby Alyssa had spinal muscular atrophy. This prevents muscles from developing and caused her 11 bone fractures.
It was never Dave’s fault - he was innocent of the child abuse charges.
Tiffany’s parents fought for custody of baby Alyssa and were able to take her home, but her health deteriorated. She died last Tuesday and has gone to be with her parents.
This didn’t have to happen.

What a pity the police officer acted so impulsively. However, the child’s grandparents did have the ill child in their care for at least part of the 4 months she lived.
Many folks in CO assert that grandparents are shut out of keeping their kin. Talk to Christine.

Activist Fined For Playing Lawyer
The Colorado Supreme Court today upheld a $6,000 fine against Suzanne Shell in contempt of court proceedings accusing her of unauthorized practice of law.
Shell is a non-lawyer, who lives in a rural area near Colorado Springs, who feels that social services departments are routinely overzealous in going after parents in abuse and neglect proceedings. She was found to have crossed the line of unauthorized practice of law when participated in three different lawsuits with which she had no personal connection under a power of attorney, after already having stipulated to a warning in 2001 that this was unathorized practice of law.

Westword profiled this case and Shell herself, at length, in a February 2005 story.
At issue is when providing self-help resources crosses the line of state law and the First Amendment to become unauthorized practice of law and something that exploits consumers.
This issue is particularly sensitive because in abuse and neglect cases, as in criminal cases, parents have a right to a court appointed attorney. Shell’s advocacy has been a response to her claim that these court appointed attorneys aren’t doing a good job of protecting the rights of parents accused of child abuse and neglect.
While not a lawyer, Shell’s documents were described as too “sophisticated” to have been prepared by non-lawyers purportedly representing themselves in the cases at issue. Thus, Shell is in the awkward position of being more qualified to handle a dependency and neglect case than some parents trying to represent themselves, but is barred by law from direct involvement of the cases of people who seek help from her advocacy group.
The Colorado Supreme Court avoided many of the stickier questions presented by Shell’s larger agenda of advocacy, in a unanimous opinion written by newly appointed Justice Eid, by noting that Shell had engaged in practices like acting as a non-attorney to provide legal representation using a power of attorney, drafting documents in a particular case, and providing legal advice in a particular case when she had previously signed a stipulation with attorney regulatory officials stating that she understood to be unauthorized practice of law.
The Colorado Supreme Court addressed this point in its opinion stating (citations omitted):
It is true that some activities constituting the practice of law are difficult to disentangle from the exercise of free speech. However, none of Shell’s actions at issue in this case presents such a difficulty. Any impact on speech in this case “is merely the incidental effect of observing an otherwise legitimate regulation.”
Thus, the Court left unresolved the issue of when other activities of Shell’s organization, like providing general legal information, forms and advice on her website could constitute the unauthorized practice of law in Colorado, an issue that has been pursued aggresively in states such as Texas, but largely relegated to being too low a priority to use scarce resources to pursue in Colorado.
The Court also addressed procedural and jurisdictional issues in her case, but those lack the wide relevance of its First Amendment holding.

Colorado is the most CORRUPT HELLHOLE on earth. I despise living here & having been conned by my own mother into moving here, & ultimately having all our 3 children snatched by controlling lesbian feminazis. Suzanne Shell is a FRAUD. She never helped me. I don’t trust any ‘professionals’ in this state. We have been deceived way too many times. As the article states above: one is guilty until proven innocent & then it’s too late. Suicides are at an all-time high here. Too bad it’s not the corrupt DHS Nazis, corrupt lawyers or liberal facist activist judges doing it!

As for being qualified as a family advocate, I have my BA in Human Services/Management & can offer much personal experience, but I have to work 2 jobs to pay the outlandish child support so that the leeches caring for our children don’t have to.

It is important that everyone realizes that the best way to fight a CPS case is to learn the laws and do it themselves. Relying on “advocates” like Suzanne Shell is sometimes helpful for moral support… but apparently something she did crossed the line.
I used to try to help families one-on-one, but to tell the truth, it was difficult and draining, emotionally. That’s why I put my information on the web. Everyone is welcome to come to this site to learn techniques that may work in court, but I do not help anyone one-on-one anymore, and haven’t for quite a few years now. People write to me in email about their cases - and I wish they wouldn’t because I can’t help them that way. The best thing for feedback on cases is the message board.

Linda is right and I believe that Fern also stated this as well in quoting the adage, “God helps them who help themselves”.
There is no white knight racing forth to help -one must help ones self.
Linda has created an incredible site here.
We can give each other general advice and leads as to where to look but if you want to win—–you must be an active participant.

CPS doesn’t stop at children, they also attack families of disabled adults. I’ve been caught up in a legal battle over my 34 disabled daughter’s guardianship. The system of human services is the most corrupt I have ever had to deal with. If you fight the system they manufacture evidence against you.
