California: Class Action Lawsuit Planned
This is from activists who are planning a CPS/DPSS class action lawsuit against Riverside County and the State of California for kidnapping children without cause:
We are organizing a class action lawsuit against the State of California, and all parties involved in unlawfully detaining and holding our children against our will, and without cause. We have documented the deep, embedded corruption in the “social services” agencies in California, specifically in Riverside County, conspiring with hospitals, schools, pediatricians and the court system to take possession of our children, without cause. We have already filed three lawsuits, and are looking for other families who have also been annihilated by this Evil. These are the reasons you should be part of this lawsuit:
· CPS manufactures multiple nonexistent/fictitious abuse case scenarios to offset true statistical abuse case information.
· CPS concurrently processes these children from foster care to Adoption, in order to obtain perverse monetary incentives in the form of bonuses.
· CPS provides a market to neighboring agencies and the courts (Judges, psychologists, visitation monitors, court mandated behavioral class instructors, court appointed legal counsel, etc…), in order for them to financially benefit from the foster care/adoption system they themselves perpetuate.
· CPS victimizes innocent families, and draws them into a corrupt system to utilize their children as pawns for this corrupt child commerce.
· CPS is utilized by family court officials and attorneys as an adverse tool to extricate children from one parent to the other, with reference to “parental alienation syndrome,” where in truth, the CPS caseworkers are the ones initiating the alienation of these children from their own birth parents. Caseworkers are never allowed to testify in court under the cloak of “CPS Authority” due to possible misuse or conflict of interest related to right to privacy laws (Very convenient)
· CPS utilizes unlawful & coercive measures to persuade vulnerable parents to submit to statements of nonexistent abuse and false “Case Plans,” forcing desperate parents to “plea bargain” to a CPS fabricated crime, for the return of their children from foster care.
· CPS fabricates false allegations and most of their “investigations” to purposely mislead or misdirect a case.
· CPS intentionally fails to Criminally prosecute Parents accused of child abuse, since in the majority of cases, no initial crime has been committed. However, CPS continues to claim a crime has been committed, as THEY abuse/neglect our children.
· CPS knowingly abandons children into the foster care system, conscious that some individuals in these homes physically and/or sexually abuse those in their “protective” custody. CPS ignores crimes committed in foster care through failure to investigate.
· CPS fails to question these individuals for their abusive conduct, whereby, if it were a birth parent or not a foster care parent, these individuals would be prosecuted to the fullest extent of the law in criminal court.
· CPS misrepresents themselves in positive personas by omitting, altering, and falsifying documents, so as to mislead the public and or government of their true actions as listed above. Thereby publicly grandstanding,displaying an inaccurate social martyrdom for the well being of children.
The Police should determine if children need protection from their own parents, since child abuse is a Criminal offense.
We dearly know, from our own personal case, the trauma and distress this thwarted government agency imposes (with no consequence) upon innocent families. In January 2008 the law office of Robert Powell won its appeal to the California 9th Circuit Court of Appeals. The case set a precedent by finding that CPS social workers are NOT entitled to absolute immunity for investigator conduct - particularly when they fabricate evidence, misrepresent evidence, and withhold exculpatory evidence. I also am a Father who was wrongly unjustified in 2004 in SAN DIEGO COUNTY when I actually did nothing for CPS to take my son away. In fact he was taken away from his mother who never told myself that my son was my son. After DNA tests that proved that I was my sons father I went and stepped up to take responsibility for my Child since it was proof he is my flesh and blood. But two RICH Lebians and what seemed an activist judge in their favor allowed them to legally steal him from his legal guardian my sons aunt, and when I went to retrieve custody of him i lost the case of unknown made up reasons. I have been waiting for my appeals in which the mistakes I made of filing legal papers to prevent adoption were inaccurate and I still have heard nothing form San Diego County.
You see how disgusting our system is? Praise GOD for PROP 8 passing. But let me join in the fight because GOD’s will will prevail and unitiy is better in numbers as we fight together against the red tape of communism and socialism that seems to show its ugly colors in our State and our bureaucratic Nation. We need to join in ranks to show thios red tape country that WE THE PEOPLE will not stand for injustice.

please help my 4 month was taken frm grandmas my 8 yr old from school i was never notified neither frm school or cps they had no wright took me 4 hrs to track my kids down they abducted my kids now i had to sign a form in order for them to be realeased to me. the place was extremly dirty took pics and film. my daughter tells us they thru my son on the floor to sleep… please contact more details scared dont even know if i should say anything do not want my kids taken away!!!

Just a reminder-
Class-action suits mean that you give up any other rights to sue on your own, and if a settlement is agreed, you agree to that reduced amount as final, and forever giving up future suits for the same cause.
If you already have a suit filed, you do not qualify to join without dismissing it first.
That applies federally.

I’m a hard working father of two baby, and the cps took them away from me. I love my son more than anything in the world, and I would give up my own life to save there’s. Cps took away my two baby because they said that I fail to protect a minor. The hospital call the social worker because she tested dirty for drugs. I guess she use drug while I went to work. Life is so unfair, why won’t the cps give me my baby’s back to me. I beg the nurse, social worker to test me at the hostipal, but they refuse toNow the cps are calling me to start testing every week for six months. They are telling me that it is court order and that I have to go ” it’s court order”. We have not even gone to pre-trail yet. I can’t say to much because my court date is coming soon. I guess the next hearing date is about going to pre-trail. I cry day and night, and break down while talking to my custumer. The CPS took away my life when they took my baby. Why would cps take my one year old away from me. When I visit my son, he cry evertime when I say “bye-bye baby I love you, see you tomorowo .

I would also like to join this class action lawsuit. Not only has my family been destroyed by Orange County, now LA County has joined in because of my ex husband and his abusive girlfriends lying tongues. Her own child was taken away for abuse, my ex beat me and my children and has two priors for domestic abuse. I tried to get 8 restraining orders and was denied every time. I was forced by a woman hating Judge to give him my employment info for the third time and he got me fired from yet another job. He got custody of my three baby girls when I could no longer take it and tried to commit suicide, stupid I know but I was lost and had not recourse. Now he has CPS on his side and they are lying in court, making false accusations, have no substantiated proof other that his and his girl friends lies, and they gave my girls to him! I have not seen them in 6 mos. or spoken with them and he and his girlfriend leave horrible messages saying my kids are hers now and they don’t love me anymore! CPS has been in my home and torn it apart with a fine tooth comb and have found nothing to substantiate his allegations. He was about to go to jail for not letting me see my girls when in a last ditch attempt he filed a new CPS allegation saying my 9 year old has said horrible things about me, things that a nine year old could not possible think about saying! Now I have LA County trying to prosecute me for unfound lies, I am so sick and tired of all these damn social workers, I mean where the hell do these damn bimbos get their degrees???? More likely online in a quick course. But they are ruining my life and I want retribution!

My daughter was born premature in 1998 in a San Diego hospital due to medical issues with her mother. I stood by my daughters side until the day she was released. They stole her from my arms the day we were sopposed to go home and even as a Marine I was helpless to stop them. I fought hard to get custody jumping through all of thier flaming hoops and after a year I was finally given my baby girl back but not before CPS destroyed my family, my career, and my pride of serving this great nation. I can truly say that my wife and I had done nothing wrong and that all the allegations were false.
Its been 10 and a half years since that horrible day and the pain is still as real as if it was yesterday.
Some who read this may wonder why after so many years I would be interested in a class action lawsuit. Im watching now as my best friend is going through the same thing with her niece. Dad’s in Jail, Mom’s in rehab and the state insists that her niece stay in an overcrowded fosterhome even though she has a place to stay with family which is what her mom and dad want while they work thier issues out.

I left San Diego in 2000 to come to St. Louis but the CPS system is just the same.

OMG!!! I can not begin to express how happy yet sad and anger I felt as I read through the comments above… Unfortunatly yet thankfully I am not alone in what seems to be the hardest fight of my life. I have been fighting CPS for almost 7 years now, my boys were 1 1/2 - 4 & 8 when they were first taken from me now they are 8 1/2 - 13 ( in a couple weeks) and 16, my little family has been torn apart and destroyed robbed of precious moments that can never be relived, I have jumped through so many hoops for CPS & the courts I feel like a circus animal, Just when I have been assured of my boys returning home to me within such and such amount of time CPS seems to find something else to delay their homecoming. The last time was 3 years ago and I was waiting at the CPS office to pick up my boys for our 1st unsupervised visit in years when I see 1 of my sons who was moved out of the county due to and I quote “behavior problems” drive into the parking lot and right back out. I didnt understand this and I began to demand to speak to someone I call foster parents and there I sit waiting for an explanation as to why my 1st unsupervised visit is obviously not going to happen, I waited almost a week before I finally got a half fast explanation as to why I was not able to have a visit with my sons. After a little over 4 years in foster care and on the road to reunification finally I am told I sexually abused my boys, Needless to say I was devistated, not knowing where these allegations came from, I fought hard to prove my innocence requested polygraph test what ever I could think of to prove I did not nor had I ever abused my boys, at first it was my youngest saying things like remember when you sexed me up, and my middle son in the back ground of a phone conversation yelling at his little brother calling him a liar, to a week later my middle son saying he recalls uncomfortable feelings, my oldest son said they were lying and that I had never done anything to his brothers, and he never witnessed any inappropriate behavior from me. My oldest son testified in court and stated the same thing, the video interviews that were done with my 2 youngest were according to my public defender a joke and that CPS was grasping for straws. I figured hey this is it this is the last thing they can throw my way then they will have to return my boys and leave us alone. I could not have been any more wrong than saying 2+2=1. Cps tried to get me to plea to lesser charges of abuse and I would get 2 see my sons, (I went 2 1/2 years without laying eyes on my youngest 1year for the middle and the oldest and I never went a month without a visit,) I refused to plea to something I know I did not do and I went without seeing or even speaking to my boys for so very long because I would not plea. Finally they through the allegations out and I had to attend therapy with each son individually which was fine with me yet now I am known as the mom whom abused her sons yet does not remember, thats what was stated in the final court report regarding abuse and now no matter who I speak with CPS worker, lawyer, foster parent dont matter they all believe I abused my boys even though they have not a bad word to say about me they still believe I abused my boys and I blocked it out… the foster mom of my middle son is great her and I have a very close relationship and she goes out of her way with the courts and workers alike to help me and my son see each other as much as possible yet she believes I am guilty, since all this came about with the abuse allegations my youngest son has been moved in and out of I cant tell you how many foster homes only because there are so many and because CPS fails to inform me until weeks if not months later, not only has he been moved from home to home at 1 time with each of his brothers middle son and oldest (oldest being the 1 whom was placed 2 1/2 hours away out of the county couple years back) well now his most recent move was in the opposite direction from me and both his brothers out of county about an hour drive from me, he is 8 years old and was placed in a boys home which is a whole new set of issues since I just had my 1st visit with him there sunday since being placed in dec. right before christmas. I could go on all day with this, so hopefully I have broken it down enough to paint the basic picture. AND I TO WOULD LOVE MORE INFORMATION AND TO BE INCLUDED IN THIS CLASS ACTION SUIT….

My daughters children were removed from her home on September 17, 2009.
There were no marks or bruises on any of the children.
CPS went solely on the statements that my daughters oldest child made to a neighbor.
CPS did not contact any family members or any of my daughters friends or neighbors who were at their home on a daily basis. They did not contact all of the teachers of the older children.
I and many of my daughters friends and neighbors wrote statements regarding the care a treatment of the children. The cps investigator omitted vital information from the statements and/or misqoted them.
On december 11, cps removed another child from the home… My newborn nursing granddaughter, born on Nov.30,2009.
Prior to removing the infant, two social workers came to the home and said the baby was being well taken care of and there was no reason to remove her from the home. At that time they also stated that they did not think that any of the children should have been removed from the home.
When the investigator removed the infant she told my daughter that because the baby was nursing, they would give her more frequent vists so she could feed her baby. They also said that she could drop off breast milk for t he baby.
She was granted only one visit per week, and later found out that they were throwing the breast milk away.
There are six children involved here.
Gina age 15
Jazmine age 13
Aaliyah age 10
Ravyn age 3
Jadyn age 1
Andrea age 4 months
The older children just three years ago were saying pretty much the same things about their father and stepmother in order to get to live with their mother.
My ex son in law, the father of the three older children, has a felony coviction for insurance fraud
We gave cps a copy of a police report from when I called the police when my ex son in law was waving a gun around in front of me and his children and even held the gun to my daughter head.
The children spoke of their father spanking them with a belt and hitting them with the belt buckle and spanking Gina with a wire hanger, They also said that their step mother had choked Jazmine.
But. the cps investigator did not put any of this in her reports and these three children were placed with t heir father, by the way does have a history with drugs and hangs out with a known drug dealer.
They had my daughter and son in law go to anger management classes, parenting classes, counciling and drug testing, even though neither of them do drugs or have any history of drug use.
They have had more than 50 clean drug test, but still they make my son in law test.
The court ordered generalized visitation for my daughter and reunification, but the reunification worker has been to her home only one time and does not return phone calls. At the time that the reunification worker visited my daughter home, she told my daughter and son in law that if they called her more than once a day, or contacted her supervisor, that she would make their lives a living hell.. she did this in front of a witness.
The judge also stated that CPS had indeed broken the law in this case, so why are my grandchildren still in foster care, about to be adopted out.
They have instead, cut my daughters visits with her children.
I asked to see my grandchildren and was told by the reunification worker she would get me the paperwork to have a background check done on me so I could visit them, but she never did so I have not seen any of my grandchildren since they were taken.
My daughter keeps asking what she has to do to get her children back, and keeps getting told to do what she is doing.
The paperwork she received, is confusing at best… in one place it says the children will be returned home march 23, in another place it says the three younger children are in pre- adoptive homes, in another place it says t he children will go home in July.
Since being taken, the infant has had a diaper rash that was so bad it took a 350.00 prescription to take care of it… she now has a herniated navel, and has had several very bad colds and the flu.
Ravyn and Jaydyn have had several illnesses too.
Aaliyah has a condition that is causing one side of her face to be paralyzed.
While with their mother , these children were very very seldom sick.
Every attorney we have talked to says that the children should never have been removed from the home.
But there isnt any money for this fight, this family was struggling already to keep roof over head and food in tummys, but they were doing it.
please, is there anyone that can help my child.
Today she filed an appeal, but we desperately need some kind soul to help this family.
I believe their rights have been violated and also mine as a grandparent.

i’m mother 3 boys kidnapped from me do to young on afdc and i was bipolar.i would like be part of lawsuit. they were remove from me in 96 and they i did every thing power to not give back they adopted out even those i did everything told me do.the baby i going be aported by aunt .it was put in writing if for some reason didnt adopted him i could get him back.i in count paper .they lie.they would n’t do what told.there were lots lie told about me.they try say i herione.i never touch stuff.last son he was 8lb 10 .they told me my boys couldnt call me mom.they would let me talk to woman who was aported boys.they went behind my back adopted boys out.i never abuse them.bob bishop did everything he could to make life tough.they told me my boy would be adopted in heart beat.it would no problem.i had a inverder for my attony ask me if he ever made sexual avancement me.because way he actied.cps work agaist me.i even try get lawyer he did nothing.i paid him 2500.he did nothing he.then after happen youngest .he told it going 10000 to keep fighting.i didnt have money.they took baby away they said 4 trace pot i didnt even do pot.i do like drug patches.i went over right away had a other drug test neg,then i also had baby test because i breast feeding.he was neg too. they also said if i had anymore kids the would take them no question ask.they didnt need reason.this gave me ptss.i fear every day.they took my life away with boy.in live in sbcountry.

Dear Linda, several of us here in Northern Virginia need to file a class action lawsuit against CPS, because we have all had our children stolen by the same agency, the same judges, and many of the same social workers, all under similar false charges of neglect. We would like to find a lawyer who would do this for us on a contingency basis.

I am from Iowa and I believe that the CPS worker Failed to Perform a proper investigation by only questioning an adult who wasn’t even at the location and her coerced into saying she saw something happen that she didn’t, the CPS worker coerced me into signing a “safety” plan of which I had no help in creating nor was made aware of the long term ramifications of my signing his “safety” plan, I was documented proof the DHS Caseworker Lied, and is Biased by making friends with my kids grandmother and father. So How Do I get a Class Action Lawsuit Going In Iowa?? Thank you!

She coerced her daughter (my boyfriends daughter) into telling DHS she witnessed our fight, because he told her he was taking her back to court for custody of the little girl because he is tired of the head lice, constant from age 2 to now she is 9. The little girl was witnessed hanging out of the 2nd floor window which was broken and glass everywhere in it and below.

TO whom much is given much is received , it is my greatest dream to live long enough to see something happens to this entity called cps my grand daughter was tooken from my ex and lied to as well all because my daughter was a little girl not owning up to her responsibilities but the lies just kept coming and when it was my time to get custody a few more lies came crashing through so this ball face system has put me in awe with the justice system and it is sad that these judges allow this bull crap to go on , When people who are put into a position like this and have no means of financial support ,it kills your dreams of ever getting custody and to fight for your flesh and blood in and out of court . Now that my grand child is stolen and adopted out and to never know of her whereabouts , This is a blow in the spirit ,mind and what justice is to be for my grandchild , People we must band together and do this thing . WE must start a foundation to rid this system of ever pulling the GOD given rights to his people to make a stand for our precious children . How sad of a so called system it is to seperate parents and children . Lets get on the ball .

I cant think of a better reason to.
my son is being held captive in the wonderful santa clara county by the sexually abusive adoptive parents of my only true love. I’m a “drug abuser” and seem to have no rights because some sunnyvalle policemen used the color of law to make me look like a “meth cook”.The courts are treating me like I’m stupid and I never was even charged for anything.
My roots go back to the founding of this country and my blood along with the blood of many honorable others has quenched the thirst of the constant battle to defend freedom and liberty in this god given land of america so our children could live free from the tyranny and evil that is constantly trying to corrupt and pervert them.The constitution is what americans gave their lives for , not the government, which grows to enslave the people…and it gives us the people power over the government. We just have to stand up and realize that. To be willing to give our lives to protect our children from the clutches of the beast. It is the only way we will be “Truly Free”!!

I would love to get the C P S back for trying to destroy my boys and my family and me…
You have no idea what they put me through while my wife went through cancer treatments from a lie planted by my x wife after she had just gotten married, taking our sons from me after 11 years after her.
of not being there for them even after I tried every thing to have her involved in their lives.
only when she saw me going through this with my wife who was the one to teach my boys in their schooling and church lessons my boys and was always kind to their mother in letting her know everything about them when she wouldn’t have the time of day with them.
My X had C P S charge me with abuse and mental abuse which none of which I was jailed and even after C P S said they would drop kept showing in court as the mothers defence
and they convinced Dr. to be true with out any proof and haven’t seen my boys for about 3 years. I had called C P S over a dozen times for an interview being denied every time until the judge had them come and give me one after five months into the three year hell.
When they showed on my door steps ,the case worker showed up she was 5′ 5.5″ about 200 lbs ear rings in her tong, nose, eye lid,covering all her ear( both) a butch flat top hair cut , a red bandanna red NY hooded sweeter shorts Levi cut offs with threads hanging off all over with steel toed boots and a Lesbo. attitude and she entered my home she was turning and moving pictures around and when I asked her to stop she got worse.
She asked if I had insurance, med, dental,life, if I had car insurance and more questions which had nothing to do with abuse or my children living with me, matter of fact she stated in her report only my wife and two son’s lived at home which wasn’t true; my daughter and son in-law the prison guard lived in back with out two grand children and when the rest of the family asked her to ask questions about her charges she flat said they didn’t live in back and she got up and walked leaving her supervisor sitting there with a stunned look on her face unable to say she was sorry enough; but the charges kept
coming from the worker all this time and this is when CPS was out of hand. I recently ran into my X’s lawyer who was fired by my X and she said she was lied to and CPS was trying to make an example of me and was pushing her to keep the pressure on me till I went to Jail.
when her my X’s lawyers husband caused her to lose her baby from abuse , she refused to pursue me and if I needed a witness against CPS she would be their for me and this is my X’s lawyer who she fired.
I knew there was something fishy about the judge’s reply and taking sides with CPS in election time and with them saying my wife cancer treatments and med were another factor in the case.
THEY VIOLATED PROTOCOL AND ALL MY RIGHTS AS A FATHER AND SUPPORTING PARENT. HAD MY CHILDREN PUT ON DRUGS AND THEN QUESTIONED THEM.

I am so glad to see this class action suit organize. I am in my second battle, and 4 investagation with CPS here in San Diego,California. My granddaughter made an accusation against my ex-son-in-law that he sexually assalted here 3 years ago. A trumped up medical report, reports written by CPS for the courts are lies and they have twisted the statements from family members. My granddaughter is well know documented by her school and CPS of being a great liar. Now with this story they told my daughter to get a restraining order against her ex-husband to stay away from their 4 year old daughter, CPS gave my daughter wrong information regarding the restraining order, told her the wrong place to get it, gave her only 1 day to do it, threaten to take her kids age 4 and age 15 if she didn’t do it. She tries to do what they asked, they knew she could not get the restraining order. The very next morning they were waiting outside my 4 year old pre-school, and as soon as her greatgrandmothe dropped her off, they went in and got her and it was 2 days before they would let her talk to her, they set up a visit with my daughter, when she went, they had moved my grandddaughter. They also removed my 15 year old granddaughterIt was almost 3 weeks before I saw her and that’s because it took me that long to get custody of my granddaugther. Not they have crossed state lines and threaten the mother of his son that lives in another state, that if she didn’t get a restraining order, they were taking her kids, which consist of an infant and a step-son. They threaten my ex-son-in-law with arrest if he didn’t cooperate. They had him arrested and has suffered at the hands of the police department with several injuries. My granddaughter has been greatly traumatized by their actions. Our case is getting worst by the minuted, every day. I just touched on the light things going on. My family has had enough of CPS. Include us in.

On this Website Linda has a section where lawyers publicize their readiness to litigate v CPS.
Linda may have moved the location of this area of the site a week or 2 ago.
There were over 200 comments for folks and attorneys to post about their good experiences going up against CPS, nationwide.
Most of the attys were from Calif.
I am certain there are a number from SD county.
Grand Juries throughout Calif are WELL AWARE THAT CPS CONSTANTLY FLOUTS, SKIRTS AND OUTRIGHTS DISREGARDS LAWS AND ADMINSTRATIVE REGULATIONS DESIGNED TO CURB THEIR EXCESSIVE POWERS.
Also, California has or had an insurance provision whereby folks HARMED BY DCFS IN CALIFORNIA have access to obtain $$$$ from the deeply flawed agency.
You must join the Message Boards ( or Message Forums here as Linda calls them) and meet with folks familiar with California laws, policies, procedures and just what PLAIN WORKS.

Class action suits would probably involve one of the attorneys who have already successfully litigated v CPS in the past.
One Mom was awarded close to 5M for CPS wrongful interventions.
This suit will not easy, quick, or guaranteed. The law is constantly evolving. Also, Calif’s debt is well known.
FOLKS HAVE TO WORK AND NETWORK TOGETHER. This is the reason Linda started this site.
However, many of us all over the nation have proclaimed to CPS —ENOUGH IS ENOUGH.
We are innocent as are many of CPS family victims.
Join, learn, and give back to the community of folks wrongfully targeted by CPS to KEEP THEIR JOBS.

La is i need of multimillon class action suit against CPS and its services to the public in the state of California.Me and my family are suffering a great deal in these near holidays this year.The case started in july 2009 and its be one hell of a shock on how lazy, understaffed and lack of competence, these county workers really are..And the more you point these imperfections, they more they make you suffer. SERIOUSLY.. This state is in Desperately reform.Reunification of families,really??what a joke!!So lets sue a write to our senators..
