Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.
Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.
Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.
Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.
CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.
Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.
It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

I need a lawyer in Sacramento County that is experienced with CPS cases. I am the aunt of 5 children who have been taken and placed in foster care. CPS told me I have no visitation rights and they can keep the kids in foster care until the next hearing, when I have requested that they be placed with me until they can be released to their parents. My infant daughters, 1mo. and 21mo, were taken 6/8/08. They are in an abusive, neglectful foster home out of our county.I was innocent of the charges I was arrested on, they have been dismissed. CPS and sheriff’s refused to contact any family. The detention and jurisdiction report are full of lies. My court appointed attorney refuses to represent me or present evidence to disprove the reports. The judge refused to appoint new council when I requested a Mars den. HARM ANIAH. THE WICHITA POLICE DEPARTMENT WAS CALLED AND ANIAH AND HER BROTHER WERE PLACED IN PROTECTIVE CUSTODY.
MY SON AND MYSELF MADE TELEPHONE CALLS AND EVEN MADE A VISIT TO THE POLICE DEPARTMENT IN ATTEMPT TO GET THE POLICE TO RELEASE ANIAH AND IF POSSIBLE HER BROTHER RELEASED TO ME. I WAS TOLD BY The HEAD PERSON ON DUTY THAT WE WOULD JUST HAVE TO WAIT UNTIL THE TEMPORARY HEARING TO PLEAD OUR CASE BUT HE WAS PRETTY SURE IT WOULD WORK OUT FOR US. THIS WAS DECEMBER 2007.
WE SHOWED UP FOR THE HEARING AND IMMEDIATELY REALIZED THAT WE WERE NOT WELCOMED THERE.
MY SON WAS INTERROGATED BY THE DISTRICT ATTORNEY AND HAD YOU NOT KNOWN YOU WOULD HAVE THOUGHT THAT HE WAS THE ONE WHO HAD ABUSED/NEGLECTED ANIAH AND HER BROTHER.
THAT DAY IN THE COURTROOM WE FOUND OUT THAT THE JOINT CUSTODY CASE WAS NEVER FINALIZED AND HAD BEEN DISMISSED DUE TO OUR ATTORNEY (TERRY BEALE OF BEALE AND MITCHELL) FAILING TO FILE THE PROPER PAPERWORK (THE FINAL JOURNAL ENTRY). THEREFORE ACCORDING TO THE DA, WE HAD NO RIGHT TO ANIAH.
WE HAD EVEN PROVIDED THE COURT WITH A COPY OF THE PATERNITY RESULTS, BUT ACCORDING TO THE DA AND SRS THAT WAS NOT GOOD ENOUGH. THEY WANTED US TO SPEND MORE MONEY, THEY NOW NEEDED THE AFFIDAVIT AND COPIES OF THE PICTURES THAT WERE TAKEN AT THE LAB THAT COMPLETED THE PATERNITY TEST. ALTHOUGH MOM AND MY SON BOTH ACKNOWLEDE THAT MY SON IS THE FATHER OF ANIAH. ONLY THE DA, SRS, & JUDGE QUESTIONS THE PATERNITY!?!?!?!?
THE END OF FEBRUARY SRS AND YOUTHVILLE FINALLY AGREED TO PLACE BOTH CHILDREN IN MY HOME ONLY IF I PUT MY SON OUT OF MY HOME(AT THE TIME HE WAS 18). WE BOTH AGREED TO DO SO, SO THAT THE CHILDREN WOULD BE SAFE AT HOME WITH ME. SRS AND YOUTHVILLE WAS AND ARE STILL DETERMINED THAT THE CHILDREN WILL GO HOME WITH MOM WHO AT THAT TIME WAS 21AND WAS CONTENT WITH ME HAVING THE CHILDREN.
THEN IN JUNE 2008 SOMETHING CHANGED (STILL NOT SURE WHAT). MOM WAS NO LONGER HAPPY WITH ME HAVING THE CHILDREN. SHE TOLD SRS/YOUTHVILLE THAT I WAS NOT TREATING HER NICE. CLAIMED THAT I HOLLERED SCREAM, AND CURSED AT HER IN FRONT OF THE CHILDREN AND HER THERAPIST AT THERAPY ONE AFTERNOON. THAT SHE AND THE THERAPIST TRIED TO CALM ME DOWN, BUT I WAS SO OUT OF CONTROL. SO I WAS SERVED WITH A 30 DAY NOTICE FROM YOUTHVILLE INFORMING ME THAT THEY WERE REMOVING THE CHILDREN FROM MY HOME. I WENT TO COURT, QUESTIONED MOM, SHE ADMITTED THAT MAYBE I RAISED MY VOICE AT HER AT LITTLE, POSSIBLY ROLLED MY EYES, AND WAS NOT SURE IF THE THERAPIST (KAREN COUNTRYMAN) COULD HAVE OVERHEARD OUR CONVERSATION, SINCE SHE WAS BY THE DOORS OF THE BUILDING, NOT IN THE PARKING LOT. SHE ACKNOWLEGED THAT SHE KNEW THAT I LOVED THE CHILDREN AND WOULD NEVER DO ANTHING TO INTENTIONALLY HARM THE CHILDREN.
THE JUDGE (HENDERSON) RULED THAT HE HAD TO PROTECT MOMS 14TH AMENDMENT RIGHTS (LET US NOT FORGET THERE ARE TWO FATHERS INVOLVED AND THEY BOTH LOVE THEIR CHILDREN) AND ORDERED THAT THE CHILDREN BE REMOVED. BY THE TIME I MADE IT HOME FROM THE COURTHOUSE, YOUTHVILLE WAS AT MY DOOR WAITING FOR ME TO GET THERE SO THAT THEY COULD REMOVE THE CHILDREN THAT DAY (JULY 23RD). I LOST A WEEK WITH THE BABIES SINCE I DECIDED TO CHALLENGE THEM.
I HEARD ON A SHOW TODAY THE SAYING, EVIL TRIUMPHS WHEN GOOD MEN DO NOTHING. WELL I INTEND TO FIGHT FOREVER FOR ANIAH. SHE IS WORTH IT!!!
ANOTHER SAYING I HAVE ALWAYS APPRECIATED AN UNJUST LAW, IS NO LAW AT ALL.
I ALSO INTEND TO CHANGE THIS UNJUST SYSTEM. STARTING WITH THE CHILDREN AND FAMILY SERVICES AND FAMILY COURTS HERE IN WICHITA KANSAS, SEDGWICK COUNTY

ON AUGUST 1ST I GOT EXTREMELY SICK WITH PNEUMONIA AND A 105* TEMPERATURE. ALL OF MY FAMILY WAS OUT OF TOWN AND SO WAS MY KIDS FATHER, SO THERE WAS NO ONE TO TAKE THE KIDS SO CPS CAME AND TOOK THEM INTO CUSTODY. AT THE HEARING TO GET THE KIDS BACK CPS ACCUSED ME OF BEING A DRUG ADDICT(I TAKE PERSCRIPTION PAIN KILLERS FOR A BACK PROBLEM) AND SAID THAT I WAS TRYING TO KILL MYSELR BECAUSE I WAS SEVEARLY DEPRESSED OVER A RAPE TRAUMA THAR HAPPEND 5 YEARS AGO. THEY HAD ME TRIED AND CONVICTED BEFORE I EVEN WALKED INTO THE ROOM. I WAS RIPPED APART, BRUTALIZED AND MENTALLY AN EMOTIONALLY RAPED THAT DAY. i just got a restrainging order put against me by my granddaughters mother for something i did not do. this is what happened, social services was in court with the other party stating that there was a police report on me assaulting the other party and that the police were investigating and turning it over to the da for prosticution against me. so that day i called the officer they said made a report on me assaulting the other party and he told me that he made no report and there was no investigation being done. the judge did not even ask for a policwe report because the social worker was present at the restraining order hearing and i showed proof that i was at the doctors and they still granted the restraining order against me . i need help what can i do? we are going to trial for guardianship on oct 20 2008. if you can help me please my number is 714 7369568 my name is tami thank you

OUR CASE WITH CPS IS SLIGHTLY DIFFERENT… WE CALLED AND REPORTED (NUMEROUS TIMES) A BIOLOGICAL PARENT FOR LEAVING OUR CHILD WITH A SEXUAL PREDITOR. WE ALSO REPORTED NEGLECT. THE INVESTIGATION, TO SAY THE LEAST, WAS AN ABSOLUTE JOKE. WE WERE LEFT WITH A CHILD THAT ACTED OUT SEXUALLY AND VIOLENTLY. WE HAD HIM IN THERAPY SINCE AGE 3. CPS NEVER DID ANYTHING. JAKE WAS SENT TO A PSYCHIATRIC HOSPITAL AT AGE 9 FOR INPATIENT STAY AND WAS DEEMED A SEXUAL PREDITOR. OUR INSURANCE BENEFIT CEASED AND WE AGAIN CONTACTED CPS FOR HELP. THEY SENT HIM TO ANOTHER FACILITY THAT ALSO DEEMED HIM A SEXUAL PREDITOR. CPS STATED THAT THE HOSPITALS WERE ONLY AFTER MONEY AND THAT IS WHY THEY STRONGLY RECOMMENDED SEXUAL PREDITOR COUNSELING. JAKE’S BIOLOGICAL MOTHER HADN’T SEEN HIM IN OVER THREE YEARS BECAUSE SHE HAD RELINQUISHED HER RIGHTS TO HIM TWICE. CPS CALLED HER UP AND REQUESTED THAT SHE TAKE HIM. THEY “WANTED HIM OFF THEIR BOOKS”. IT WAS RECOMMENDED BY THE COURTS THAT THERE BE A SAFETY PLAN IN PLACE BEFORE HE WAS RELEASED TO HIS MOTHER AND THAT SHE TAKE DRUG AND ALCOHOL EDUCATION. NEITHER HAD BEEN DONE. SHE ALSO HAS BEEN IN JAIL TWICE IN 6 MONTHS. WHO WILL TAKE CARE OF JACOB WHEN SHE IS IN JAIL? SHE IS UNMARRIED AND HER OLDEST CHILD HAS ALSO BEEN ARRESTED FOR CAR THEFT. CPS SHOULD PAY FOR ALL HIS TREATMENT. HIS MOTHER SHOULD BE INPRISONED FOR HER ACTIONS, YET NOTHING HAS BEEN DONE. JACOB’S HOSPTIAL STAY IS $340.00 PER DAY AND HIS MEDICATIONS COST OVER $1000.00 PER MONTH. CPS IS THE WORST WASTE OF TAX PAYER DOLLARS EVER SPENT. THEY ATTACK THOSE WHO ARE INNOCENT AND TURN A BLIND EYE TO THOSE WHO ARE GUILTY. NEVER TRUST THEM. RECORD ALL CONVERSATIONS WITH THEM. WE ARE PREPARED TO SPEND ALOT OF TIME GOING AFTER CPS. I NEED HELP - for my daughters, Sylviana(4) and Raven(2)yrs old.
On March 2008, I took my daughters from their drug addicted mother(she is on Meth) and had them in my custody until April 15, 2008, when the court gave temporary custody to the mother. I live in Washington state and know that the law states that the children should remain with the mother, but not in this case. She is and has been on meth for several years and the court ordered Hair Folicle tests proved that. I have been clean for over 8 months and my Hair Folicle test proved that I was negative. I have proof of child abuse, child neglect and child endangerment, made numerous police and CPS reports, but nothing has been done to take my daughters out of harms way living with their mother, grandmother(who also does drugs). I have made these reports to CPS about the harm that has been happening to my girls, not to their mother. This is not about the mother, this is about my daughters, but CPS has made this only about the mother, by giving her UA’s that have come back ‘unfounded’. CPS has let this go, but once again let me stress that this not about the mother! CPS said that if I do not quit making false accusations and reports, that they will take me to court for harrassment.
Not once during all the reports that I have filed, has CPS asked to see any pictures of the girls that I have or the Doctors reports from the hospital. Why is that? Because all they are looking at is the mother and her ‘clean’ US’s.
Since my daughters have been back living with their in April, they have been subjected to numberous drug people that their mother had in the home, of which her boyfriend and another person living in the home were making meth. In June 2008 the home was busted for manufacturing drugs and boarded up by the City of Tacoma. my girls had to live in that home with all of this going on. On one occassion, when their mother dropped the girls off to me, the girls were both sick, so I imediatly took them to the hospital, where I was told that they smelled of meth fumes, exhaust fumes and cigerate smoke. both my girls have asthma and are not supposed to be around this, BUT once again, they are living with their mother and I have no control over what the mother does to the children, that is why I have reported this numerous times to CPS and the police with nothing happening. My children do have a Guardian at Litem, and we even went into court to do an exparte to get me custody. but the Judge once again put my girls in harms way by letting them stay with their mother!

My precious granddaughter has been legally stolen by the CPS and is going to be adopted to the foster paarents. They are ready for the pre-adoption proceedings. I put in a motion to intervene but was denied then put in a motion for reconsideration but the judge did not even reply to that so then I filed another. I had 30 days to file an appeal and I’m sure ,since I have NO ATTORNEY here in Lincoln Co. in SW MN ,and believe me I have tried EVERYTHING to get one,they think I would NOT file the appeal. HAHA I got it al done on my own and in time!!
I still am in need of representation but if I do not have anyone to go into court to help me fight for my granddaughter i WILL do it myself!! Parents terminated their rights to her and my son is in prison, unjustly because he served his time for what he did years ago in IA and was released 5 yrs ago and has not reoffended but Minnesota seems to think they can take his baby and make him pay again. I HAVE BEEN FALSELY ACCUSED OF LEAVING MY 3 MONTH BABY IN A BASSINET HOME ALONE WHILE I WAS ARREST ON MY BIRTHDAY 9/26/2008 AND I WAS WITH THE FATHER. HE AND HIS GIRLFRIEND LIED ON ME TO DFCS. THEY HAD MY BABY SINCE 9/26 AND I GOT OUT OF JAIL THE NEXT DAY.I ASKED FOR THEM TO BRING MY DAUGHTER HOME AND THEY REFUSED. ON 9/28 THEY TOOK HER TOOK THE DEKALB COUNTY DFACS OFFICE TO DEPRIVE HER AT THE OFFICEAFTER WE GOT IN A AUGUEMENT ABOUT BRINGING HER HOME. I WAS ON THE PHONE WITH DFCS WHILE THEY WERE AT DFCS LYING ON ME AND THE FATHER DIDN’T KNOW. WHILE THEY WERE BUILDING A CASE ON ME THEY DECIDED TO GIVE THE BABY BACK TO THE FATHER AND GIRLFRIEND AND TOLD THEM TO BRING HER BACK TO ME AND HE DIDN’T. I WENT GET MY BABY FROM HIS HOUSE AND BRUNG HER HOME AND THE NEXT DAY DEKALB COUNTY DFACS CAME TO GET MY BABY ON 10/1/2008. THEY SAID THAT THE GOT A REPORT THAT I LEFT HER IN A BASSINET ALONE AND THAT I ALSO HAD OPEN CASE WITH FULTON COUNTY WITH MY OTHER 6 KIDS WHOSE BEEN IN CARE 3 YEARS BECAUSE WHEN I CAME TO ATLANTA IN 10/5/2005. I WAS RUNNING FROM A DOMESTIC VIOLENT RELATIONSHIP AND DECIDED TO COME TO ATLANTA FROM HELP. I WAS STAYING IN A HOTEL ON 10/5/2005, MY CHILDREN WAS LEFT ALONE IN THE ROOM FOR 30 MINUTES WHILE I WAS GETTING MY BELONGINGS FROM OUT THE MIDDLE OF HALLWAY AND I HAD TWO ROOMS . I WAS UNPACKING AND MY CHILDREN WAS LOOKING FOR ME AROUND THE HOTEL AND THE SECURITY GUARD CALLED THE POLICE AND THEY CALLED FULTON COUNTY DFACS. 10/27/05 MY 6 KIDS WAS REMOVED FROM CUSTODY BECAUSE DFACS SAID THAT THEY GAVE ME A WARNING BUT THEY FEEL THAT I WAS DEPRIVING THE FROM PLACE TO STAY IN THE HOTEL WHEN I HAD A SECTION 8 VOUCHER AND THEY NEVER GAVE ME TIME TO LOOK FOR A PLACE WHEN PAPER WORK CAME FROM MY HOMETOWN WHICH IS MEMPHIS, TN SENT MY PAREWORK TO ATLANTA ON 10/19/2005. SO THEY BEEN IS CUSTODY EVER SINCE AND I HAVE FINISH CASE PLAN EXCEPT FOR OBTAINING EMPLOYMENT. I HAVE TO GO TO COURT ON MY 6 KIDS ON 10/9/2008 AND FOR MY 3 MONTH OLD ON 10/6/2008. NOW ABOUT MY BABY THE SUPERVISOR DID RESEARCH ON MY ARREST ON 9/26/2008 AND FOUND EVIDENCE THAT I DIDN’T LEAVE HER IN THE BASSINET BECAUSE HER THE FATHER ADMITTED THAT HE AND THE BABY WAS WITH ME AT THE TIME THAT I WAS ARRESTED, THE SUPERVISOR CALLED THE PLACE WHERE I WAS ARRESTED AND THEY VERIFIED THAT THE BABY WAS WITH US, AND MY POLICE REPORT STATED THAT MY BABY WAS WITH ME AND NOT AT HOME IN A BASSINET. Desperate for help…I am the mother of four beautiful children, In March of 2007 i left my then husband because he was very physically abusive towards me and my children. after which he began to call cps over and over again. it has been a year now that my children have been in foster care because my children were allegally left home alone. i have completed all of my obligations to CPS and the keep coming with more thing that were never ordered by the judge example trying to make me take medication because i am a domestic violence surviver based on a one time appt by a therapist. the are threating to permanetly take my children awya from me. My youngest two were given to thier father who physically and emotionally abused them My oldest son has had his teeth kick out , and double immunized while in cps custody my youngest daughter molested and neglected, my youngest son has got with out medical care, and my oldest daughter has severed emotional abuse at the hands of the first foster home she was in. Cps worker constanly tell my children they arent coming home and talk to my children negitively about me. It like my husband couldnt beat me any more so now he is using cps to keep the mental and emotional abuse going. since this case hase started Iv lost my job, my school my home and my family please someone has to be out there to help us. Can they really get away with all they have done cps has even gone as far as to lying on court documentation! My son lives in Florida with his mother but was than removed by CPS in 3/30/2007 because of her boyfriend abusing both children. She hid the children from CPS, they did find the children at her parents home in FL. 3 days later. I live in Arizona and was NOT notified. I talk to my son on a regular basics. Finally in May my son said we live here at my grandparents house, but I’m not suppose to tell you. He was due to come out for summer break soon.CPS DID NOT follow they policy for letting me know what happened nor sending me my child(interstate program). I do attend court via phone my lawyer does NOTHING. CPS does not inform me of anything. We just had court again yesterday and the judge (not normally on the case) said the abuser could come around the children. He is just another boyfriend of my ex-wife’s. Her lawyer is requesting closing the case next month (Nov.). What happened to listerning to the children or even the doctors report. I don’t have much but I need HELP. These systems are not protecting my child they put them back in harms way. When a child has a fear of someone there is a reason. my son said can my brother and I just come and live with you so we don’t have to be around him (abuser). I would do that ! the charges were dropped due to the childen’s(4&10yrs. old)somewhat difference (their mother said no).Once someone hurts a child and gets away with it whose to say they won’t do it again, next time it could be death. I live in sacramento, ca. I am a 38y old single mother of 15y son,17&13y daughters. My 2yr younger sister & bro inlaw live 45m away in Galt. My sis was with the police for 3mon& had to step down or be fired. Her husband is a police officer. 3yrs ago my children&I got ill in a rental house due to a documented sewage leak/ mold in 2006. We filed a lawsuit which we won this past april 08. It was the start of many many problems, I think will haunt us forever. Bottom line, I went 2 visit my sister on aug 22. I left the house after visiting w her family & 2 sheriffs for 4hrs. Within 15min after driving off with my children. I was pulled over on the freeway by a CHP for “swerving”. The CHP instructed me to keep driving another 5-7min to the next offramp. Thats where the KIDNAPPING of my 3children took place! I wouldn’t see my precious children for 6weeks! I have never been arrested in my life! I had no drugs in or on my body, children or car! The CHP would not allow my 17yr old to call, her father or anyother family member but my sister! I was thrown in jail, kids told I wouldnt be getting out for 90 days due 2 a DUI,told I must get rehab. The cop bro inlaw ransacked my apartment, looking 4whatever he could use to keep my children SAFE from me!Found nothing&took whatever he wanted including our kittens. My bro in law told everyone including CPS that we were HOMELESS! It is still in every CPS report.I had a nice clean apartment. CPS even put notices on my HOMELESS apartment!I was in jail 4-5hrs. Over the next 5-6 days, watchcommanders,galt police managers, called & threatened me to not come near my kids or they would put them in foster care! I had contacted CPS as well. They lied said they met with me when they never had!!My sis repersented herself as a RETIRED officer, called CPS ??times with lies: sideswiped car, put in jail for possiession of meth, you name it & they said it! In hindsight this wasnt the first time they tried to abuse power. They secretly believed our illness&lawsuit was a madeup meth story! I am a very good paperwork person, I have everything to prove my story. I need some help here. My kids have been so hurt by this, my sister even gave my oldest a valium, to calm her!!It is unbelievable! I never want this man or my sis to put anybody ever in jail again!!!

I am a new father, of a wonderful baby boy, and his mother is my soon-to-be spouse, we are engaged. She went into labor, and then ended up forced into a C-Section, and 12 hours after that, she collapsed. Now she’s recovering from being in the ICU on life support, due to a bad c-section where the main blood vessel to her uterous was severed, causing serious blood loss and 4 more serious operations.
And now HERE is what went wrong after that. Because she is recovering OK, and should be out in less than a week.
She was found guilty of taking my prescription pain killer, percoset, active ingrediant is oxycodone. Our son had some symptoms of withdrawl, but will be OK. He was born one day after her due date, at 7lbs 14ounces. Anyways the hospotal informed CPS and they came in, overwhelemed mom (still sick in bed at the hospitol) and caused her so much anguish her heart rate skyrocketed that minute and the staff had to give her anti-anxiety medication immediately. That CPS worker came to our home, that was very clean and well prepared for my son, and said she would submit me to hair folicl and urine drug tests, then take my signature to consent forms to get all of my personal medical information from my doctors, and so forth. And I think Mom is going to submit to the same. and she threatens if we ever lied in any way, she will take our baby. What can we do? Mom and I are so afraid and so hurt,,,

I have been dealing with Cps all my life. I was a victim of these people as a child. I was ripped from family . my 2 younger siblings were adopted out ,and I myself was bounced from foster to foster home finally ending up in a boys ranch where I was molested ,beaten ,and in the later teen years I was victimized by a foster family, by being used to labor in the foster placements business. Where i wasn’t paid, and ultimatley ended up in jail for some false allegations, as a retaliatorial move by the foster parents for blowing the whistle on them for exploitation. I was taken out of school ,and made to work in a wrecking yard owned by the placement. They in turn used the police chief who was a good friend of them. to retaliate on me for blowing the whistle on them.I ended up spending most of my adult life in prison. Now I am being victimized by them once again. They have removed my youngest child a new born who they have placed outside my home. They ruled there was no imediate danger, but there was a risk because of prior drug use. These behaviors are old news on my part: however my wife has had some problems. We have been compliying with people ,but still haven’t had our newborn placed back with us. They keep talking about starting services ,but are stringing us along . No services have been forthcoming ,and when we try to start some on our own. They don’t want who we choose. or the agency has a long waiting list. We get 3 hours a week to visit with our infant son,and they still haven’t gotten our services started. I am very frustrated with these people. They have the judges in thier corner, and we have no options to fight these people without an expensive legal battle. I am very frustrated. I had a minor stroke 2 days ago that has left my foot numb, due to the stress these people have put me through. My wife is depressed ,and afriad . We need help ,and some type of resource to fight these people what can we do? They have to much power when they can show up at the hospital and remove our child for no other reason but past behavior. Is this America ? I just don’t get how they are doing this.

The Family accross the street from me was torn apart for the entire neighborhood to see. They have been stuggling financially to pay bills and have started to use a generator for power. They are arguing with the landlord about a severe leak in the roof which he promised to fix but, he hasn’t and now there is mold around the leak in the ceiling. The landlord turned off their well so they have been getting water from my home for a month. I have been in the home several times and it is clean inside but, due to the same dispute… the landlord hasn’t provided the dumpster as was agreed and the garbage is piled in the yard… These people love their 5 Children (ages almost 3 to 11 years old) … They are clean, clothed, food in the house and in their bellies and they have heat and water… The Charge was Neglect. I live across the street and though the garbage pile is a bit bothersome… I do not see that the Children are neglected or abused. I held this poor mother who has never not slept with her babies… they are very poor and both on disability… and do not have internet. Their hearing is set for Tue 14th of Oct 2008. They need an attourney FAST. I told them I would help but, I don’t know where to turn. The kids have been split up into several different homes and were screaming as they were dragged away… My heart is breaking for this family… They are having hard times and have a bad landlord and they are poor but, I do not see any neglect and I have lived across from them for over a year. If there is anyone who can help us… she will be here at my house today while were are searching for an attourney. Thank you to anyone who can help.

My infant passed due to a neglectful provider 4 months ago. Now CPS is coming in claiming that I am not coping good enough and demanding I go to counseling at a center of their choice. There has been no closure in my baby’s death and it’s still very fresh and new. I need to get them to leave me alone. I’m back to not sleeping well or having an appetite just because of them!

She has been is 3 different schools in a months time and in and out of hospitals. This no way for any child to have to live. I’m in PA and have been wrongfully accused of child neglect. My family has a long history of ez bruising which my son has inherited and even tho my legs and body are full of bruises every day of my life, they don’t believe me. This whole thing is out of spite from my soon-to-be ex husband! They took my baby from me and granted him to remain in his father’s care until an investigation happens and a hearing is held but they have no idea when that will be.

My kids (2,4) were taken from me because of my boyfriend(he is african american) of 3 years spanked my son and it left a mark and my birth mother (dont talk to that often) she knows that i would never let anything happen to my kids i love them so much. Well she turned us in because she dont like my boyfriend now she liked him before but she dont like him anymore dont know why but whatever and now DHS is involed took my kids from me we are doing everything that we have to do to get them to come home. That is not good enough to them. It doent help that we live a “white” town and no one their wants any “blacks” living there. So they are doing whatever they can to get us both taken to prison. We are out on bond right now and have been since July. My son has been evaluated and it comes back that he is not abused but they dont care and they wont let them come home, We have to go to Family Therapy and they dont see any problems or why we are going through this mess. My son has to go through play therapy and she dont see any signs of abuse. So there is 3 people all ready that have told us that my kids are not abused but we still cant have them back and my lawyer is not doing a very good job on what she has to do and it is very fustrating and stressfull and we are not going to let them get away with doing this to us.
So one PLEASE if you can help me with my case PLEASE do. There is ALOT more to it but that is just a summary. Like on all the reports they lie about everything and it is just crazy to have someone lie like that on a person and why would they want a family to go through this mess.

I have a 19 year old with a 2 month old infant she is not my daughter but because she lived in my home more then she did at her own home i was the mother she didnt have and i love her like i do my own
her step mother wanted the baby and she would let her have him so she left 3 days later the cps came calling they told her who called them.Her father choose his girlfriend over his daughter. I want to help but because of a previous cps case they will not allow me to. That case is 16 years old and my son is now 18. They claim they have a rbs case which is what they call a reason to believe but i watched her with her son there is no problems she called me crying because she didnt want to leave and go to work she wanted to stay home with him.We need a lawyer to fight so i can help her and she can have a nice situation to stay. althought i have a previous case i am stable. I need help fighting allegations of abuse and neglect from my estranged husband and my three children through DCFS in Southern California. I have filed what I can here in the family court in Las Vegas, NV and jurisdiction is here for both the divorce and custody. Unfortunately the judge here in Las Vegas, NV has her hands tied until the case of abuse and neglect is closed in California. I can’t even get divorced until this is resolved. I need some serious help!! I am 33 and have been the sole provider and caretaker for my family for the past five years.

Many universities have clinics where families can qualify for some legal services at sliding scale or gratis.
LV should have a Women’s Law site or clinic in the populous area of LV , especially with its high crime rate and divorce rate.
Read through the postings on the right side of Home page for California & NV.
There are many attys in private practice who are starving now, too.
FAMILY LAW IS NOT THE MOST RIGOROUS OF LEGAL SPECIALITIES.
You should be able to negotiate.
Some will flat fee for court attendance at around $250.
Check around with all your contacts as to which attys they used. And yes, talk price with them, too.

Where I live they are investigating me for abuse and neglect of my three children on whether or not they should be taken from the home. I have had a lady from CPS come talk to me and she signed me up for family preservations classes so that hopefully my kids will not be taken from the home. I don’t know what to do! I am a single mother of three and my kids father died four and a half years ago at 24. They are investigating me because my daughter locked her self in a cage that is outside my house and she couldn’t get out and a neighbor let her out. I made plans to move almost a month ago and when they found out I was moving the lady from CPS said it looks “SUSPICIOUS”

I have posted here once and I am currently looking for the “Class action lawsuit”. Is there one? I have been dealing with CPS for two months. They have threatened me with the removal of my children (5). They refuse to transfer my case to the county that I actually reside in and have residency. My two ex-husbands accused one of the children of sexually acts on the other. The accused child has gone through three interviews, no evidence found. The child that was supposed to have been abused went through a forensic interview and said that “I just say that cause he’s my Dad”. I have police officers and state employees that are telling me that CPS is on a witch hunt. HELP how do you stop this insanity.

Hello, my name is Jessica. I am a 28 year old mother of three. I am a full-time sophmore in college going for my B.A. in Business and Accounting. I have not had custody of my daughter and son for 5 and a half years. My aunt could not have children so she insisted on having my son. My aunt had both my children taken from CPS and has guardianship of my son now. After about a year she made up lies so my daughter could be placed elsewhere because she my daughter would tell her brother that my aunt was not his mother. My daughter is still in foster care and I have no idea why? I have a four year old baby girl who lives with me and has always lived with me. When I try to call CPS they refuse to call me back. They will not tell me anything about my child and are trying to find someone to adopt her (They asked my sister). Why can she be with me? Why is it fair that I can raise one child but not the other? Well, at first I think they though if they gave one child back they would have to give the other one back. And now they will not give me the time of day. I called and left 60 messages in one week on probably just about everyones answering machine, and got no reply back from anyone. My public pretender does not help what so ever. I don’t want to loose my child forever, it is not fair! Please if anyone sees this by the grace of god please help me! Like I said I am a full-time student with a job, and my husband has a job, we have our own two bedroom apartment (for now) and we have people that will vouch for us (everyone from DR.’s to people at the college including Instructors) But I just cannot seem to catch a break. My best friend’s little boy (Jacob)at only 9 months old got taken from her by the cops and then put with CPS. Her and the baby’s dad were only verbally arguing in front of his house in the street. The baby was down the street with his siblings (all over 18 I believe) When the cops came (neighbor called them) the kids walked up to the scene. He is now with his aunt, but my friend has jumped through all of the hoops. It has been over a year and she is now taking it to trial. There is absolutely no reason this child should be away from his mom. The baby’s social worker came to check the house. All was fine and she was told she would get overnight visits. Never happened. She went to court and they told her she has to wait till the trial starts. She is a great mom. I have never seen a mom so attentive and loving to their child. Please help some how. I am going to court weekly concerning my 2 special needs daughters. (10 and 16) I am not sure why the social worker is on a witch hunt, but I know that is what it is. My then 15 year old talked to a 19 year old neighbor boy and he called the police. I was arrested as a Felony. It is filed as a misdemeanor and my criminal Attorney thinks it will all be dropped. My daughter wrote a letter saying it did not happen and she exaggerated the whole thing thinking she was talking to a friend. My court appointed attorney is leaving the program on the 16th. The attorney I was to hire now says she is not sure she wants to take the case. the social worker is labling me Angry and Hostile. I have never in my 42 years had a problem talking to or working with people. Every week we go to court and CPS says they want to detain my children. So far the judge has let them stay with me. I have letters from our family Dr of 10 years saying he has never seen anything to indictate any abuse and the girls have never come in with suspicious injuries or anything. I also have a letter from my youngest’s Psychiatrist saying he has known us for 5 years and it is in her best long term interest to stay in my care. I am a mother of a six year old girl and a three year old boy. Two years ago my children were removed because one piece of paraphanailia was fornd in my apartment. After a year and a half or fighting with Nevada CPS, I was advised by my court appointed attorney to sign papers to have my sister in law adopt my children even though I was well on my way to recovery. Atfer some research I found out that this was not the best advise to follow. If there are any attorneys in california that could advise me I would appreciate it. Well, as far as getting actual legal representation, I don’t know. I have had only ONE attorney email me for contact information. And for people who include contact information in their posts, I have no way of tracking who gets phone calls or emails.
One attorney said he couldn’t contact people, that they would have to contact him. I don’t know if that is the state bar rule in every state or only one, and don’t know if answering a plea for help such as the ones on this thread would actually be breaking a bar rule. Maybe some attorney who reads this will clarify what’s allowed.
There are still many attorneys who have listed themselves on the Lawyers page of this site. Is there nobody there from your state?
Here’s an idea on how to get an attorney who wants to fight CPS. Go to the county courthouse and look for cases that have been filed against DHS, and find out what attorneys filed them. You might have even better luck going to counties nearby rather than your own, because often the local county attorneys are too worried about kissing up to the judge, and can’t do a really aggressive and impressive job of representing you because of local politics in the legal community.
Best of luck to you. I apologize a million times that I’ve been too busy working to give this site the attention it deserves. I’m grateful that now I’ve lost my job and can actually come here to participate more.

My 3 year old daughter got taken from me in July. I need some SERIOUS help. My court appointed attorney barely ever returns my calls and there is some serious stuff going on. Including my daughters “biological father” is now going to file for full custody of her after not wanting to have anything to do with her for 3 years and sending me a letter in February wanting to sign over his rights. He is younger than me and is married, his wife is only 18 years old (I am 32) she has cancer and they have a 6-8 month old daughter. The system is making me divorce my husband in order to have any chance at all at getting my daughter back and after telling me that they would not and could not hold against me the fact that I am bi-polar that is now their main focus and reason for taking her (after changing their minds 4 times as to why they took her from me). PLEASE PLEASE help. I am in Nebraska. Everything I tell my case worker is getting twisted and used against me and she always finds times to meet with me or talk to me when I have no witnesses present. Can someone please help me? Any advise and a decent attorney would be helpful. PLEASE I am begging. I have given my daughter a clean home, a safe environment and toys beyond belief with VERY LITTLE help from the “sperm donor” and now he wants to take her and from my understanding has more of a chance than I do at getting her. Do not panic. Get rid of that cage if you haven’t already, or lock it so nobody can get back in.
If you already signed something agreeing to go to classes, then I suggest you go through with it. Keep a very positive attitude, be friendly, and try to enjoy it. They will be watching you and your family.
Perhaps it isn’t a good time to move. Did you already have a place picked out? Sometimes caseworkers come in while the place is in disarray from moving and use that as “evidence” against the parents.
Good luck and as I said, do not panic. You still have your children which is PROOF that they do not have enough evidence against you at this time to take your kids.

I need an attorney. The Bar Ass. knows that the judge violated our rights but no one will tell us how to re-open the case. This would never happen to a wealthy person.
In 2005, I called CPS for help because my daughter was being evicted. With no warning, CPS came to my home and took my two grandsons. They still have them. My daughter and I were denied access to court dates and findings and were not offered attorneys.
Recently, my grandsons contacted us without permission. The total personality change is scary and I suspect abuse. I’m helpless to save my family members. Please help me.

After we’d been denied the right to an attorney and the right to confront your accusers, after they’d secretly filed for permanent custody, after it was too late to appeal, they finally told us that it was all over and we would never see my grandchildren again. They ENJOYED telling us that they had won. And the children had lost.
Three months after it was too late, the crooked Judge James appointed the crooked attorney Allyson Blake to make it look like she was filing for a new trial, based on the fact that we had not been offered an attorney.
Allyson Blake said that Stark County, Ohio was full of “BABY STEALERS.” This is what she called them. In other words, being right didn’t matter. The baby stealers were in charge. The Bar Ass. has been investigating Judge James and Ms. Blake but their findings won’t help my case. IS THERE NO HELP ANYWHERE ?

I am dealing with a situation right now with a CPS worker who has fabricated allegations and has substantiated allegations based on an isolated incident involving two children in my care. I did nothing wrong and instead of remaining professional this worker is attacking me and intentionally trying to ruin my livelyhood and reputation. Jessica, your case is so complex I don’t know what to say… your children, gone for five years, tells me this case must be in permanency status now. Are you still going to court for your children? …or is that over? I don’t believe CPS social workers can decide to give your children back at this point, so why call them? You would have to get a court order.
I think it is always preferable not to call CPS social workers. What if they were to open a case on your youngest because you kept harassing them about the older ones? Much better to find a lawyer who can help you go to court for a reconsideration on where your children are living. Go through family court, not juvenile court, if there’s no CPS case active right now.
But that’s just my thoughts… I’m not an attorney and know so little about your case I may just be shooting in the dark not totally understanding what’s going on.
I am a mother who lived without two of her children for ten years and believe me, I am aware of the pain you’re enduring and how the suffering never seems to end.

Linda McGee… it might help if this mother was able to create some legal documents using the samples on this site - for example, a declaration of facts, and a declaration of “Objections and Corrections to the Report of the Social Worker”… especially if there are lies in the social work document. Working on a CPS case is a complex matter and of course nobody will understand it as well as the parents, so they should be the ones doing most of the work if at all possible.
A juvenile court case is decided on “a preponderance of the evidence” so to win, the parents must have more documentation and evidence than the other side. I hope these parents are being fairly treated by their attorney in this matter.

If you have no attorney and need one in your area, try this… go to the county courthouse and look through their files to see who is suing CPS. Find out what attorneys are helping to sue. Also try this in nearby counties because often it is better to have an attorney from out of county - they won’t be involved in local politics so much, and worried about kissing up to the judge.

I am Warren Waldrup of Elgin Tx. and my wife Gayl and I are having issues with DFPS out of Travis County Texas, Child Care Licensing. I read the article in the Austin Chronical regarding Mrs. Gaines plight and felt contacting an Attorney would be necessary due to the case. We were contacted by Child Care Licensing due to a mildly violent issue with my special needs daughter while we were sitting a good friends 3 children. We were visited by a single representative to provide us information on how to “List” with the
state and pay a fee that was left in our mailbox, when we caught her doing this, Gayl approached her and she removed the information from our mailbox and handed it to Gayl.
On the last visit by “two” representatives this time, (the second person did
not id her self and only said “Hi”), Gayl was told that she had to sign a
hand written document or the unrelated children would be removed from our
home. There were no unrelated children in our home. My wife felt duress, no
choice, added comments and signed the document. My wife recieved a certified
letter after this visit and is accused by Child Care Licensing of Child
Neglect. At no time was my wife informed by this dept. that she was under
investigation for any issue.

Beware, DFPS\DHS\CPS has a partner, Child Care Services who will ask to “meet” with you due to someone reporting you are babysitting in your home and want you to pay a fee but may act as a CPS investigator.

The only way to successfully confront CPS is for good, rules-obey folk to band together and to challenge their illegalities.
And please remember that CPS is flummoxed by anyone who knows their rights and asserts. Probably the only way to tame DFPS will be for folks to LITIGATE.
Child Care Centers are often ripe since they have lots to lose. Many of the early folks decrying CPS were those with day cares, etc.

I posted for legal help yesterday. I realized that i forgot to mention that the state I reside in is California but the CPS case was in Nevada. My children also reside in California with their aunt who is in the process of adopting them…I strongly feel that I was tricked into signing the papers for the adoption. I was told by my attorney that if I didnt sign, my rights would be terminated and the adoption would be closed and I would get absolutly no contact with them at all. I believed him and signed the papers fearing the thought of never seeing my kids again. I love my kids more than anything in the world and without them I am nothing, so the thought of never seeing them again was enough for me to be bullied and lied to. PLEASE PLEASE I beg of you….if there is any attorney in the state of california that would be willing to help me with this I would be forever indebted to you. I can pay you it would take me a long time because I can only afford small monthly payments but I can and will pay. I need to know at the very least if it is too late or if I can fight the adoption (even though I signed the papers). If someone could please advise me as to what my rights are, and if I have a fighting chance to change the outcome. Dian… what part of CA do you live in? There are several CA attorneys who listed themselves on the lawyers page of this site. I don’t know if the paperwork could be reversed at this time. You might try filing the “rescind signature” legal document to slow things down. That form is found in the Legal Document Library section of this site. [Note, click on the Rescind Signature #2 link - I just found out the other one is a dead link.]

One more thing… when you create your ‘rescind signature’ legal document you will have to personalize it with your details and leave out everything that doesn’t pertain to your situation. I am tired of no one wonting to help all the familys and children whom DFCS is supposed to be protecting. I know your grandsons, but I haven’t spoken to them in about 5 months. I know their previous foster mom and she is very kind and loves them very much; she did not abuse them when they lived with her. However I know nothing about the people they are with now. You scared me by saying that you suspect abuse…. I know that you hadn’t spoken to them for about 2 years prior to this past July, so please don’t be offended, but… are you sure that the personality change hasn’t been a gradually change that kids go through, particulary at Jamie’s age? Joyce, if you truly suspect abuse in their current home, let me know ASAP and let me know why you think that and I’ll try to contact the boys myself and I’ll also call their case worker and their former foster mom. I love Jamie and Jacob very much and if they are being abused in anyway I will do ANYTHING to protect them. Even if I have to drive down and get them myself.
As far as your legal situation, I’m very sorry that I can’t help. If I had the money, I’d pay for a good lawyer for you, but I don’t. There is an organization caled Ohio Against CPS that’s petioning for changes right now and they are collecting cases where children were unjustly removed. I’m actually starting a chapter of their organization here in Stark County to try and help kids that were removed under the dependent child act, like Jamie and Jacob probably were. Investagating and trying to bring down Judge Jim James is the first thing I plan on doing.

We have 2 months left on the 6 cps timeclock for adoption of a newborn. My grandson was taken from a prominent Santa Barbara Hospital 2 days after his birth. My daughter had taken some vicodin/lorazapam during labor. The hospital liason called her nothing short of a loser, and refused to let the babies father sign the birth certificate. My grandson went straight to an adoptive family, first court meeting, cps did not allow us (about 15 family members) into the court room. The judge asked if the baby had any family at all. cps said they were working on it. Initial paperwork for taking the baby, they said they thought the baby had no relatives. There were 2 grandmothers, the father, aunts etc. It has been a continuous nightmare, cps has denied me getting guardianship. I know we are being trashed by the system. My Governor has offered to help, as has my Senator. I want back up help, in case the time clock runs out, and it turns out like everything I read, and it’s all a ruse. CPS refuses to admit any wrong, or correct their records, or stop this hellbound train. We live in California. Someone, please help us. 805.688.8530

I need help. My 3 children ages 4, 2, and 1 were taken away to foster care for no good reason. It has been almost 6 months and nothing has changed. We only see them once every other week for 2 hours and they keep making little excuses not to increase visitation. I have done everything on our reunification plan and am not being given any credit for anything I am doing. Our children are being affected by the separation. They are very sad and cry when we leave. I am heartbroken and am having a very hard time dealing with life away from them. I was always very protective and loving to them. They were well taken care of and in a nice home. When cps took them they said it wasn’t about abuse or neglect but about me and my husband getting along. We get along very well and love each other. They are going by hearsay and have nothing to back up their false statements. Now the kids are still gone and the holidays are coming. How can I live without them here? They were so happy at home and we were happy as a family together. We need to be reunited as a family like it is supposed to be. I feel like there is possibly some predjudism going on as my husband is black and I am white. My children are mixed races. We desperately need help to get them home. I can’t live without them. They cry and look at me like I need to do something but I can’t do anything. We need someone to fight to get these prescious children home where they need to be. I am doing everything they have told me to do plus a lot more I have done on my own. They even tell me that I am doing great with everything but nothing is changing. I NEED HELP……..My 5-year-old daughter accused her father of hitting her and of sexual abuse when she was only 3. CPS did nothing and said that since my daughter wouldn’t talk to them that I must be coaching her. Now at age 5 she is accusing him of hitting her, putting soap in her mouth to the point she becomes ill, and basically terrorizing her. This time around my daughters Doctor reported to CPS, and my daughter was able to tell a cop what was happening to her. CPS discredited the police report, the doctors report, and the picture of her bruised butt. CPS actually told me I was either making it up or coaching her. They told me that if anyone, including her school and doctor, call them again with reports of abuse, they will take my daughter away from me. I don’t understand how they can do this. My baby girl is too scared to talk to anyone. I am seeing the emotional pain she is from all this. She is refusing to go to her dads but I have no choice in the matter and have to make her go. How can I get CPS to believe me and get her out of a harmful situation?

A Dad in California recently WON a 6-figure settlement from DHS, because his daughter was KEPT FROM HIS CARE, AFTER THE MOM ABANDONED HER TO CPS.
Dad was even paying Child Support. But DHS in California never contacted the Dad. I think he lived in another county.
Suggest you contact CPS Ombudsman in Calif.
You local politicians should be able to help you with this.

I had a relative given to me by CPS. 10 days later they told me they child was going to foster care because I left Poop in his diaper (he was at the sitters home for 3 hrs). I believe the state just wants to give the child up for adoption and the family only has 6 months because of his young age. If the parents are guilty of what CPS says they are I would like to get the child back - what options do I have if any. Most of the family has drug history’s with the courts so to think they would past a background check is slim. Iowa

The first thing I want everyone to know is all the case workers dont give a dam about your child their job is to get your child in fostercare and keep them their! Dont call C.P.S. they will runin the childs life. The only time C.P.S might be called is if the childs life is in danger, and even then think twice! On 13th Oct my son called me to let me know my Granddauther Trinity was taken by C.P.S. and he did not know why! My son had a drug problem 18 months ago he went to detox and rehab and has been drug free since then while he was cleaning himselfup grama and grampa had gardenship of Trinity
we had her with us for one year. She went back to her father 7 months ago
her father does have a drink after work and on the 13th he drank a bottle of wine and went to bed Trinity woke up at 2 A,M, having truble breathing Adom call her doctor and he listened to her breathing on the phone Adom was told to call 911.He road to the hospital with her and after 1/2 hour the doctor told him she had a broncal tube infection. they told him C.P.S. wanted to talk to him he waited 3 hours for them and was upset and worried about what was going on some one smelled licker on his breath and thought he was behaving strangly so C.P.S. took his child. At six A,M, Trinity was placed in a permited home within hours of being taken before the shelter hearing because thrier were no tempery homes avaible.

she was torn from her farther and placed in a new foster home Spanish Speaking she speaks and understands English she is 2 years old She showed up for a 1 hour visataision in dirity shit covered closes with dryed vomit on her back a rash, tromatised, dehidrated, we were at the shelter hereing and wanted her back we live in Californa this is oregon they would not give her to us we went agin to the seconed hereing and still could not get her the judge told C.P.S.to return her to the farther as soon as possible and set the next court date for the 24 Novbember C.P.S. case worker said they do not have to return her until the Judge orders it.

I need a pro bono attorney to represent my son Ronald Denson who is serving time a Mayo Correctional Institution. He had to take a plea bargain for a crime he did not commit. HI I am looking for help in texason 7/18/08 cps had me sign parenl authorization form to place my kids with my mother well really one child the one that already lived with her not the other 2 they were taking from me any way i started service they kept changeing every thing classes after i fished some they said those were no good so i asked to do court order service and they have been playing games know they are trying to get a family member to sign SAPCR my mother thinks there are no grounds for them to take me to court so they want somebody else to do it with there help of course please help me.

looking for assistance from attorney that accepts payments of some type to help defend daughter to CPS. Mother of two ages 1 1/ years and 3 1/2 year old.
CPS brought in a Public Health Nurse from the Santa Clara Valley Medical who is seemingly trying to find anything to portray my daughter as unfit.
We are very alarmed as they have become increasingly rude, judgmental, demanding as well as demeaning. Dropping in with a 5-minute notice throughout the week.
Kindly advise if you think you may be able to assist.

Sir/Madam,
I am writing to you on behalf of my grandchildren children, Dante Jr., Bryanna, and Angelina. Dante Sr. and I have recently received CPS’ copies of the documentation of sexual abuse of Dante Jr., alleged three times, documentation verifying twice, while in the custody of CPS. The last incident reported as recently as August of this year. CPS left Dante Jr. in that particular foster home for at least four weeks after the incident occurred. We have yet to receive the documentation of the physical abuse Dante Jr. suffered at the hands of a foster dad. The verbal report of this incident made by the CPS caseworker is that Dante Jr. was hit so hard it left a handprint on his face. Dante Jr. now has permanent hearing loss in his left ear; he has also suffered a concussion while in their custody. We are still waiting for the documentation on this incident.
Bryanna has also suffered “alleged” sexual abuse while in their custody, because of her age no further investigation will be done. I sir/madam, am a survivor of sexual abuse and recognized the documentation of Bryannas’ behavior, the description of what she was saying, and doing as an indication of sexual abuse. Documentation by a foster parent on Bryannas’ behalf was never even acknowledged or looked at by CPS until I questioned it. The documentation of this incident was turned over to Dads’ attorney who has been remiss in handling the documents and cannot seem to find them. All three children have been diagnosed with PTSD, separation, and abandonment issues. I am confident in saying that the instability in placement, they were moved well over seventeen times, further exacerbated this psychological diagnosis.
Upon my first notification by caseworker, Kristen Meehan, that my grandchildren Dante Jr., Bryanna, and Angelina, were in CPS’ custody, I told them I would take all three children if they would pay off my lease and provide me with housing. I was told that CPS just doesn’t do that.
Dante Sr. was incarcerated at the time CPS became involved. Upon his notification of CPS’ involvement, he immediately contacted the current caseworker Dorinda Sigalas, through his counselor by phone. Dante Sr. at that time made a formal request for all the case files on his children and requested telephonic visits with each one of them. It is well documented that Dante Sr. immediately began taking every class available to him recommended and/or suggested by CPS’ staff. Dante Sr. was also available for every court appearance telephonically, the exception being the last one at the time of his release. He consistently sent cards, letters, and gifts to all of his children; this is well documented by CPS. Dante Sr. had repeatedly requested the Mother of his children please bring them to visit prior to CPS’ involvement, his requests fell on deaf ears. It is a known fact that Mother did have the availability to bring their children for visitations because of her arrest in another state and her ability to get from county to county. The Mother did at least consistently show a “complete” picture of Dante Sr. to the children and read every card and letter he sent to them.
The over zealousness in showing a “half” picture of father to the children may well have been more detrimental towards the children and their father causing them confusion as to whom they were looking at. CPS’ ability to provide telephonic visits should have been implemented at the point of the case plan being reunification changed in Dads’ favor. A parent whose attempts to visit or support their children are “prevented by the acts of others” should not be considered to have willfully or otherwise abandoned the children. CPS was not diligent and did not act persistently to establish the relationship however possible between Dante Sr. and his children, and did not vigorously assert his legal rights to the extent necessary.
Dante Jr., Bryanna, and Angelina were deprived of a “normal” home while in the custody of CPS because of their own inability to find safe and secure placement that would guarantee they would be out of imminent danger and harms way. In CPS’ own standard of the goals of the healthy family, where the father is concerned they have not met one of the standards set before them. The fundamental liberty interest of parents in the care, custody, and management of their children does not evaporate simply because they have not been model parents. Dante Sr. has been as amicable as humanly possible throughout this entire process completing every task set before him and requesting more. The states attorney has told Dante Sr. if he does not accept custody of Dante Jr. and voluntarily sign over an open adoption of his two girls Angelina and Bryanna, he will lose all three.
I absolutely understand your caseload is probably bursting at the seams. I implore you to please help in any way you possibly can before these children are damaged any further or adopted out for the price on their heads.

It appears that Arizona has some vicious legislators who have a dual relationship with also representing the foster care industry. I believe this legislator is Hershberger.
They do try to stifle the volunteer’s freedom of speech.
It appears many families have been greviously predated upon by the foster care industry in AZ.
Possibly because of the transient population, undocumented workers, and native Americans.

Apparently, someone called CPS last weekend 10/18/2008 when my 15 y.o. son and I got in a loud, heated argument after he punched a hole in the wall when he got mad at his mother when I was at work. On 10/23, a cps worker came by to our 3 boys(15, 14, and 9 y.o.) school and interviewed them. My 15 y.o. did tell the worker that I smacked him on the face and this was the only time, my 14 y.o. said we’ve never hit him or his brothers, my 9.y.o. said that I (the dad) hit him once on the head. All 3 boys reported that there wasn’t any abuse between my wife and I, which is true. My wife and I both don’t have records or any cps visits in our history. All 3 boys answered that they have plenty of food and clothing. The CPS worker was supposed to visit us on 10/24, but my wife called the night before to let them know that we were not going to let them come in to our house. We decided on this after hearing and reading stories of a CPS worker making a visit and distorting their observations and next thing you know, the kids were taken out of the home. We don’t have anything to hide but I also don’t trust CPS from what I’ve read on the websites. We also feel that they should get a warrant, our consent, or find exigent circumstances before we let them into our privacy. It is now Saturday night and we haven’t heard from them since my wife cancelled the visitation. My wife and I are both losing peace of mind and sleep over this. We’re planning on seeing their pediatrician early next week and get a report from him that shows there is no physical abuse, which there isn’t. What should we do next? There are many more incidences of child physical
abuse and neglect than of sexual abuse. In fact,
over 200,000 incidences of child physical abuse
occur each year in this country. A national survey
sponsored by the National Center on Child Abuse and
Neglect revealed that despite this number, district
attorneys’ offices prosecute far fewer cases of
child physical abuse and neglect than cases of
child sexual abuse. To discover what can be done
about this situation, the National Institute of
Justice and the Office of Juvenile Justice and
Delinquency Prevention sponsored a study of a
prosecutor’s office that aggressively pursues child
physical abuse and neglect cases by coordinating
with other agencies and using specialized staff.
The results, reported in the Research in Brief also
entitled Prosecuting Child Physical Abuse Cases:
Lessons Learned From the San Diego Experience,
indicate that the San Diego’s prosecutor’s office
multi-agency approach has resulted in high felony
conviction rates for child physical abuse cases.
They ranged from a low of 77 percent in 1986 to a
high of 94 percent in 1992, and averaged 85 percent
in the 7-year period from 1986 to 1992.
A multiagency approach
San Diego’s multiagency approach involves
coordination among child protective services (CPS),
the police, the medical community, and the
prosecutor’s office. A CPS worker is usually the
first official to respond to a report of suspected
child abuse. Initial referrals to CPS come in via a
24-hour hotline. Every hotline report and every
case that results in an investigation are forwarded
to law enforcement.
Law enforcement officers have full access to all
the information contained in any CPS report. The
police department is also required by law to report
any alleged cases of child abuse to CPS. Under the
interagency agreement, CPS’s prime responsibility
is to protect the child and law enforcement’s is to
investigate the alleged perpetrator. Prosecutors in
the San Diego District Attorney’s Family Protection
Division work closely with law enforcement officers
to answer any questions regarding the sufficiency
of evidence or the type of evidence the prosecutors
will need to convict.
Because of the importance of collecting and
interpreting medical evidence, the medical
community also plays a crucial role in prosecuting
physical abuse cases. The Child Protection Center
at San Diego’s Children’s Hospital and CPS cohost a
weekly meeting for representatives from the police
department, CPS, the district attorney’s office,
and the health and medical community to discuss
problematic cases and share expertise.
Specialization and training
The San Diego police department’s specialized unit
of 14 investigators handles all physical abuse,
severe neglect, and sexual abuse cases. All
investigators assigned to the unit must request the
assignment, and they are required to attend four
training classes conducted by the State of
California on various aspects of investigating
child abuse.
The unit that handles child abuse cases in the
district attorney’s office, the Family Protection
Division, consists of 10 deputy district attorneys,
a division chief, 2 investigators, and a victim
witness counselor. Deputies must request assignment
to the division, and they receive training from the
division chief and through State and national
seminars.
In addition to developing expertise, specialization
has enabled the police department and the district
attorney’s office to build a close working
relationship. Both police and prosecutors would
like to see specialization return to CPS as well
(special units for sexual abuse and severe physical
abuse were recently disbanded due to budgetary
constraints). In the view of law enforcement, the
lack of specialization among San Diego’s 600 CPS
workers makes building a rapport with individual
workers difficult, and although newly hired workers
attend a 6- to 8-week training program on
investigating child abuse and neglect cases, the
need for more intensive training was seen as acute.
Dissatisfaction with child abuse prosecution
Interviews with CPS, the police, and the
prosecutors in San Diego, revealed great
dissatisfaction with the leniency of sentences
imposed in child abuse cases, which recalled the
similar complaint of many of the 600 prosecutors
interviewed in the 1993 survey. Sentences were
usually described as “mere slaps on the wrists.”
Although San Diego gives priority to physical abuse
cases and has allocated resources for successful
prosecution, the chief of its Family Protection
Division expressed the opinion that physical abuse
prosecutions are at the stage now where sexual
prosecutions were 10 years ago. Jurors tend to not
believe that parents, or caretakers, intentionally
harm their children. They tend to see injuries as
the accidental result of discipline that parents
can, and often should, impose. Unless the public is
made aware of the nature of child physical abuse
cases, prosecution and conviction will remain
difficult.
Implications for action
Public education in the area of physical abuse has
yet to reach the same level that has been reached
by public knowledge of sexual abuse. Every
professional interviewed in San Diego believed that
the jurors needed to be enlightened about the
dynamics and seriousness of physical abuse cases.
The study also indicates the importance of
prosecutors communicating to law enforcement and
CPS that they will pursue physical abuse
prosecutions when appropriate. A case in which a
child’s injury appears suspicious requires careful
scrutiny for possible criminal action and
coordinated investigations to ensure the
preservation of evidence.
Concerns that CPS workers “tip off” suspects can be
minimized by an interagency understanding that
delineates each agency’s role and responsibilities.
San Diego’s agencies have such a memorandum of
understanding among units dedicated to child abuse
cases. The researchers recommend other communities
consider San Diego’s approach since it permits
close, collaborative working relationships that can
lead to successful resolutions of these cases.

You have to live in AZ to see what CPS does and how they tie into the legislators pockets. It is horrible!
Did you know that our news channel 3 runs regular commercials for “Are You My Family” adoption promotions? Every few hours we see the faces of kids asking “are you my family?” They make it look as though these kids are happy to be away from thier families, even though they are in fostercare to do it.
Adoption should not be promoted on TV as a business!!! But here, in Arizona, it is a business and our dual legislators, profit by acting as the good guy and promoting it.
Trying to get ANY legislator here to help is worse than pulling teeth. They’d lose their status and their pocket money.

Please try the attorney message boards, as here and most states, the BARR prohibits lawyers from “soliciting for clients”. A lawyer is only permited to talk to you IF you initiate the contact. A lawyer generally will not seek you out in any way that could be mis-contrude by the BARR Association. The could get a license suspension or worse.
This is why we see their commercials written to the public at large. It becomes soliciting IF they approach or single out 1 person, under BARR rules.

Our case is closed and now currently waiting for a response to our Civil Lawsuit which filed against CPS and the States Attorney General, Terry Goddard office. And because we as grandparents have come so far with our case, we do not wish to allow our case to become a class action suit.
But I will forward your writings via e-mail to him. After he studies it for merit, I’m sure he’ll say yes or no, he knows of someone or not.

around 1999-2000 my wife & I were part time youth directors at church and also trying to start a family. we quit the job in 2000.
in 2001 we were notified a visitor to our youth group got mad and made abuse allegations against me. Dept of Children & Families asked our local sheriff’s dept to investigate. the investigator recorded the interview and we heard no more about it.
in 2003 we decided to start an international adoption from China. during the required homestudy, we find out that allegations from 2001 were still showing as founded in the DCF database, so our adoption social worker contacted the lead investigator who informed her that shortly after we were interviewed he noticed inconsistancies in the girls story and when he asked her to explain, she recanted her entire story and told him that she was mad because I would not drop her off at her boyfriends house as I dropped off the other kids after youth meeting.
our adoption social worker contacted the investigators and we obtained a notarized statement of ‘no arrest or warrants being made’. this was attached to our home study and it was approved. we brought our daughter home in Nov.2004.
in 2006 we started a 2nd adoption from China and again the report came up in our background check. our adoption social worker is now with a different agency and our home study has been denied until we have that report removed and my name cleared. we contacted DCF with the notarized statement and asked them to review the case. based on however the taped interview was interpreted the request to remove the file against me was denied.
we have since obtained another notarized statement from the lead investigator stating that the girl did recant and her reasons.
what is the best way to present this to DCF and have the false report/allegation removed from my record? would it be best for a lawyer to make the request on our behalf?
we asked 1 lawyer to check, he only made a couple phone calls and suggested we start a domestic adoption through DCF at which time it would be denied due to the false abuse report and we could make an appeal for a judge to review the case. We have already spent 19months and alot of money working on this China adoption and feel that this is like starting over.
we contacted a local judge for guidence and all he could tell us was that he couldn’t help since the case was not assigned to him and that we should hire a lawyer.
we have emailed 4 lawyers in Gainesville FL and haven’t heard a thing in 2 weeks. also have emailed Gov Charlie Crist, but I have no faith in that going anywhere.

Please help!
My children were removed/stolen from me in October 2003 and because I was a complete mess worrying about my kids being okay I agreed to anything and everything c.p.s told me to do.
My court appointed attorney told me that we could fight it but if I was found guilty of even one allegation that I would never see my kids again ( word for word)
Of course I agreed and he assured me that by agreeing I wouldd have my kids back within 2 to 4 months.
18 months later I got them home.
They had been placed with my mother who I had repeatedly told the socail worker that she was extremely abusive both emotionaly and physicaly.
So now here we are. it’s 2008 and after telling my mother I have had enough of the drugs that the state forced me to lie and say I needed and that due to my very real and documented physical pain I was seeiing a doctor to treat me.
She called c.p.s.
The allegations have been deemed unfounded but because of the past c.p.s. hell we went through they are trying to force me to sign a release of information for MY doctor so they can tell him of all the allegations and case history ( this is what the socail worker said) I have passed all U.A.’s and now moved my child who was diagnosed with P.T.S.D. due to c.p.s. involvement to a family members home so she is no longer terrified of going to school where she believes she will be stolen from again.
What do I do?
Someone please help, I miss her so much and I am so tired of being afraid as well as helplessly watching as her world once again falls to peices.

my 6 month old was removed from my husband and myself due to our past history. there is no alligations of abuse nor neglect. cps doesn’t even want to offer services because of our past with them before. i lost 2 other children my son was 3 and my daughter was 5 months when taken. my two other children were taken because my ex was accused of biting his son in the toe. because i worked and he lived with me watching my children all of the children were removed. my other two are already in a adoptive home. could somebody please help me. 916-993-8047. please now they have my new son and just want to adopt him out. please call me .916-993-8047. bethany i live in SACRAMENTO, CALIFORNIA

cps took my children away while i was in the hospital with chf and seperated them while in foster medicated my 11yr old son on 13 different phsyc meds 24 different foster homes and are now adopting my 4 yr old son to foster parents

Grandson taken from daughter on May 19, 2008. 4 days earlier she got drunk and she and her boyfriend had a fight. My grandson woke to fighting got scared and called 911, police arrived and arrested my daughter and friend for drunk and disordely language and possesion of drug paraphenilia (this charge dismissed) my grandson stayed with neighbors. CPS removed my grandson on May 19. Had original CFT and an accqaintence of my daughter stepped up and grandson placed with her. In this placement grandson taken to bars, mentally abused, visits cancelled for punishment, daughter requested he be placed elswhere, taken to new foster home on 10/22 daughter has not spoken to son or seen him since 10/18 case worker acts like she is doing a favor because she will get to see him on 11/5 for 2 hours at CPS center. Daughter is 100% compliant and sober and clean for 5 months, I My neice and nephew have offered to have him placed with them until case is over, but CPS seems to be dragging feet. I have requested he be placed with me but I live out of state and its “allot of paperwork” not a simple process. Counsellor for grandson talk down to daughter and has called my grandson a spoiled manipulative brat in my presence just need to know what rights do we have? What rights does my grandson has surely he has some?

I have a 6year old that was taken away from me on the word of my mother who is an abusive women…she claimed i choked my child and got my daughter to tell a lie to a police office in return she promised her to take her to see her cousins that are her age. The charges in criminal court were dropped due to lack of evidence but my daughter is still in foster care..I have been doing classes and therapy that I don’t need…my public defender said I shouldn’t go to trial even though my fiance would testify that he never saw me do anything to my daughter..need a better lawyer to help me get my daughter back and sue my mother…funkyhearts-@-yahoo.com

My son has 3 children by Shannon a drug addict. She beat the felony charges of drugs with drug court. Now she has the kids again. The CPS worker is the same one who has given the children back to her over and over again. Shannon has my grandsons on Ritalin and anti-depressants. The granddaughter is on anti-depressants only and this is with CPS approval for applying for SSI for them. Help me stop the nightmare for these children

Gainesville, Florida area: looking for a lawyer to SUE the DCF for fabricating and pursuing false allegations, assisting the mother in interfering with custody and visits via false DCF accusations. Randall.. every state is different so my experience in CA isn’t relevant to you. I agree that you may need an attorney as probably this will have to be taken care of in court.

Nicole, I can’t tell you what to do about signing the paper to release medical records. You need to hire a lawyer to help you with this, in my opinion. The problem is that if I tell you to do it that could work against you and then you could blame me. Or if I tell you not to they might take you to court, then you might blame me for that. So I feel helpless to say, one way or another. If it was me I’d say NO but that’s just me… I also wouldn’t have taken any UAs without a court order, but again, that’s just me… I get very uppity at the thought of the state interfering with my privacy rights.
Right now it looks like the social workers are on a fishing expedition, looking for anything to hold against you.
One thing for sure, if my mom called CPS I’d say ’see you later mom’ and get my family as far from her as possible and exclude her from my life. People who call CPS are not safe to be around even if they are your closest relatives.

(((bethany sanchez))) I am so sorry… I hope you can get some help. That is the law since 1996 (ASFA)… if you have had another TPR then they can take your newborn without a reunification plan.
I’M So Very Sorry… you have been through the worst thing in life.
If you want to have children again, you may have to leave the country first.

Kathleen, rather than getting a new lawyer, why don’t you try to make your current attorney work for you? This person could be recommending no trial because they don’t want to do the work… but you have the RIGHT to a good defense and a trial, especially if you’re innocent of the charges.

Andria White, I don’t believe your grandchildren should be taken from their mother. Sorry she’s used drugs, but she must be doing better now or the kids wouldn’t be back with her. In general it saddens me greatly when grandparents try to take kids away from their parents, and a call to CPS is a wildcard… you never know if that call might lead to having the children placed with strangers for adoption. Unless the children are being terribly physically abused and you know that beyond a shadow of doubt, I’d stay out of it. And about the drugs the children are on… I’m sure they’re doctor prescribed and that the mother believes this is best for her children and the situation they’re in.

my family has been going through the child protective system fo a few years now and im a grandmother wonderingwhere I can get help with this fight, I have put in for interested party status but dont think it is going to do much good. these children are in more jeopardy in the foster care system then they ever was at home I am on disability and have not got much money to pay someone but could really use the help you can email me if you know anyone in maine that can help it waldo county area thanks.

My family and I are being harassed by defacs and I need help in getting them to leave us be..We lost our oldest son in a car accident about 2 years ago and I am currently pregnant with a high risk pregnancy and defacs is constantly opening cases on me that are always unfounded. But continue to open cases on me with no reasonable cause.
What are my rights where this is concerned and how can I stop the stress and heartache this causes on my family.
Please help or Family.

My mother and step father are part of a ongoing land dispute, this morning I took a small video clip for my mother of the survey stake and the fence belonging to the neighbors that is on my mother’s property. The older female neighbor continued to scream at me from the porch that she was going to call the welfare office on me. (for what ? was all i wondered) after going to do some shopping with my mother a CPS case worker showed up to inform and discuss the fact that myself, my husband, my mother and step father were all named in reports of abuse.
I have never harmed my children and the same goes for the others mentioned. The real issue is that we have already reported this problem of false allegations to the D.A.’s office because previously we were all reported by (I know for sure) the same people 6 times in one month all reports were of course unfounded and now it continues again as my mother and step father get closer to a court date to settling the property matter.
i really need some help to make this stop. The D.A.’s office previously just told them don’t do that anymore. It is obvious that these people are not cooperative with anyone.

I would write to the OCFS Commissioner and copy in the Inspector General. You are not really complaining about CPS as mush as alerting the big wigs that the reporting is malicious in nature and is a waste of everyone’s time, including CPS.
Call first, speak to the Commissioner’s chief of staff if possible and then write the letter memorializing the conversation and sen it certified return receipt requested.
Do you have an attorney for the land dispute?
That attorney may agree to write a demand letter requesting that the neighbors cease and desist from harassing you (without naming CPS) just cease and desist.

I am writing because i am a step parent in los angeles trying to get my daughter out of dcfs adoptions…. i am willing to provide her with a home and keep her safe i have fostered 15 cvhildren for dcfs and they will not let me have my step daughter that is four years old. She is being adopted and they will not consider her family.
if anyone can help. i have completed all the classes my husband did not. he is now in jail. we have been seperated for a year. i never ever missed a visit of hers in the entire four years she has been in the system and yet they tell me i have no rights to her.

this is to mykael …it is the first law in the dependentcy act that all kin must be inspected before the child is removed or placed..they have done the same to me my sister was a foster parent twice and the refused her rights also…get a lawyer its the law
