Petition for all US CPS cases to be revisited
Dr. Shirley Moore started a new petition:
Request For All United States Cases to be Revisited.
Please check it out and sign if you feel moved to do so.
In case you don’t know her – Dr. Shirley Moore is a long-time activist who has been affiliated with the American Family Rights Association (AFRA). She has a good track record of effecting actual change in the child protective services system.
Here’s the text of Shirley’s new petition, with an invitation to her next rally (Los Angeles, March 15) at the bottom:
WE THE PEOPLE,
The United States Citizens of the County of Los Angeles, California request that all court cases be revisited or nullified based on evidence of Financial Conflicts of Interest and Fraud committed by judges throughout the United States.
Many of the judges that are sitting in court on cases are also sitting on the boards of phony non-profit organizations created intentionally to generate the State Grants through the Federal Funding.
Also, the judges are not only being paid by the state, the County is also paying them. Many judges and some officers of the courts have willfully and intentionally committed actions with malice to conspire against U.S. citizens causing irreparable injury, damage and harm to U.S. citizens.
Based on the conflicts of interest in the above aforementioned County of Los Angeles, California, we believe that not only should many of these cases be revisited immediately in conjunction with a Federal investigation, we are also requesting that this investigation not be limited only to California; but for every State and County throughout the United States of America.
May God bless you and May God bless America.

I am so thrilled to see that the people are beginning to take a stand. If there has ever been a time to stand, the time is now. Being that there is a crucial national election upon us now, this is the time, this is our time.. We can no longer allow a few to control the masses, we must begin to send a power message that simply states that enough is enough, we are aware of the schemes that are being committed against the people and we no longer want to accept the atrocities.
Keeping the Faith,
Dr. S. Moore

My children and I were victims of a corrupt CPS system in Adams County, Colorado. My daughter was taken with out reason, no search warrant, illegal strip search on a 3 year old girl. The officers told them they were not removing her out of my home, as there was no reason to. The case worker went out side and allegedly called a judge and had it over ruled. My son was placed with abusive people. When I called the cops on them for abuse, nothing was done. But they violated him for running away. 5 years later I am still fighting them.

Dr. Shirley Moore is on the right track. We, the people, have the right to have these government agencies investigated. WE PAY THEIR SALARIES with our tax dollars. We, in essence, are paying them to victimize us and it is time to make it stop. I live in Iowa and this corruption is happening all over the country. I would like to be able to talk or email Dr. Moore. Is that possible?

I am thrilled beyond belief that I am not the only one that is fighting an unjust and unfair practice that has been going on for years. While I haven’t had my children taken from me, I am dealing with CPS and believe me they try to come at you with all kind of garbage. God bless you Dr. Shirley Moore.

Dr. Shirley Moore,
You don’t know the half of the story. I was “removed” from my biological mother at the ripe old age of 3. This all happened back in 1965. It wasn’t until 13 yrs later that I nad two of my siblings were placed back into the home. Do I have some stories for you!! If you are interested, let me know.

I would ask that the residents of Los Angles talk to a journalist at the LA Daily News.
His name is Troy Anderson.
From what I have read of his columns, Mr. Anderson is not real keen on DCFS operations.
I hope he stil writes for the paper. I do not live in LA.

I just had a 2am visit by cps because I took my child to the doctor for some bruise he had on his left arm. That is the same spot where he had ring worm so I was not sure why he had it. The weekend assistant physician did not check for anything other then to say it was bit marks and did not look at my son’s medical records.
They came in at 2am. Like we were some type of criminal. Which in their eyes we are. We have to take one of their specailist now. My wife is going to call her work tomorrow and get a hold of the free legal service her company offers. I feel this is going to end badly after reading all the different accounts both here and on other messages boards. I might end up loosing my 8 month old to these parasites.

What to do when CPS comes to your home :
CPS will ask you various questions most of which they have no right to ask. Demand documentation for any thing they bring up. Be polite just do not volunteer anything, choose your words carefully, do not allow them to twist anything you say into other words you did not say. If they do not offer to tape record the interview refuse to be interviewed and if they do tape record the interview let them know in advance that you insist on a copy of the tape or take your own tape recorder with you. Make sure to state on the tape that you are taping the session with their knowledge and have them say they know they are being taped. State the date and time on the tape before any questions are asked and any answers are given. If you can afford it take an attorney with you or at least a witness. Stand up for yourself. If you feel the need to stop the interview then say so and suggest a continuance time and date. Once you know where they are going you may need time to get documentation to back you up. Do not let them bully you or threaten you in any way. Keep your cool; they love to try to rattle you. And above all admit to nothing, make them prove every point or dismiss the issue. Demand copies of all paperwork. Insist they write you a statement as to what they agree to do regarding copies of anything. Set time limits for their response. Take notes, very careful notes. Do not let them rush you, accept no excuses and do not show fear. If you have done nothing wrong then act like you have done nothing wrong.
Video tape your interview and then don’t let them out of your house until they answer all your questions, Best question to ask : What is Title IV-D ???? That will place you on the do not call list ! Most caseworkers have no clue …

Thank you Dr. Shirley Moore! Finally a petition that might actually draw some attention from Sacramento. I can only tell others what I have experienced first hand and that you are denied due process in juvenile court. Public defenders are not there to help, their hands are tied. Without a change in the laws, families will continue to be denied their civil rights. My family has been financially ruined and emotionally traumatized by the injustice we suffered by CPS, public defenders, and the commissioner who had all the power and authority to decide our case. Every case across this nation should be revisited.

I had an unbelieveable case with AZ CPS taking my 18 month old daughter and giving her father custody after his release from prison (I learned he was under investigation for molesting a past girlfriends 3 year old daughter). At this point he had violated his parole for A DUI and 8 related felonies. He returned to prison weeks after being awarded custody which I attempted to explain to CPS and the court and they would have known if they had done a little research ( a criminal background check).
His mother than somehow was permitted to take his place in our custody dispute and was awarded guardianship. Finally her lies caught up to her and the GAL recommended the court remove my child from her custody and place her into a foster home.
Here were all these people allegedly determing what was in my child’s best interest, although they were strangers to one another. I stood up and begged them not to needlessly force my child to endure yet another traumatic experience and finally managed to make them see eye to eye with me and agreed to leave her there! That was 10 years ago.
I now have a happy, healthy, 5 year old son as well, which proves CPS’s allegations to be wrong about me.
I would love to regain custody of my daughter and allow my kids to grow up together! However, no one has the power to return the time that has been stolen from us! The damage has already been done, beyond repair. Nothing can ever replace what we have lost. I don’t question the fact that my daughter would have been happier and had more opportunities in life if she had been raised by me, but she wasn’t!
Even if the courts and CPS were to admit they had made a terrible mistake. I realize that my daughter doesn’t remember living in our home, she is comfortable in her present surroundings and lifestyle.
It would be a terrible shock to her to change everything that she is now comfortable with, yet once again. This would also be a shock to the lifestyle my son is accoustomed to.
As a parent, I have to do what is best for my children and I realize that is to leave them where they are for now.
I have always been permitted two hour visitations with my daughter each week, which I’ve rarely missed. It is very possible that the situation may change and she come live with us in the future, but for now my kids are best where they are!
Some of the many children who were wrongfully ripped from their families may have found good homes and surrogate families and many families my find it in their children’s best interest to leave them where they are! What is most important is that the steps are made to ensure that this doesn’t happen to any children in the present or future and no more families are falsely accused and needlessly destroyed!

STOP FALSE ACCUSATIONS AGAINST GOOD PARENTS FOR CHILD ABUSE AND ENDANGERMENT
There is no doubt that there are some parents who abuse both their biological and adopted children.
Some of these parents were abused when they were children and could be on drugs.
I do not support the abuse, molestation and exploitation of children. It is evil.
Equally, I am opposed to false accusations of child abuse against innocent parents.
Sometimes children have to be scolded or disciplined for doing something bad.
That should not constitute child abuse.
However, it seems this is exactly what is going on.
If your child misbehaves and you scold him or her, he/she can call the police, the Child Protective Services and accuse you, the parent of abusing and molesting him/her.
Just like some adult, some children tell lies too.
If some adults tell lies and adults bring children into the world, then it is reasonable to believe that sometimes children could be telling lies.
They must have learned how to do that from the adults.
It appears that many times when there is a report of child abuse and molestation, the authorities side with the children against the parents, jump into conclusion, rush to prosecute, convict and imprison the parents, without a thorough investigation to determine if the child told the truth.
In some cases, the children lie because they disliked their parents for not allowing them to do whatever they liked, so they fabricate stories of abuse and molestation.
I am in favor of proper investigation whenever there is a report of child abuse in a family to make sure that parents are not being falsely accused (for being good parents by disciplining their children) and then prosecuted, convicted and imprisoned.
There are no parenting schools where prospective parents can go to be educated FREE on how to be good parents.
Parenting in America is expensive, risky, fraught with dangers and very difficult!!!
If you allow your child to do whatever he/she likes and not discipline him/her, he/she could join the wrong gang at school, start doing drugs, shop- lifting and one day commit a serious crime that could send him/her to the prison.
When this happens, the parents are accused of being bad parents, spoiling the child and being neglectful.
However, if you care for your children, discipline them when they misbehave, they could report and accuse you of being abusive and molesting them.
When the authorities come, in some cases, they believe the children 9even though they could be lying because they disliked you for disciplining them), remove them and put them in foster care, and then prosecute, convict and imprison the parents for child abuse, molestation or endangerment.
It is a catch 22.
Whatever you do or fail to do, as good parents, could lead to a problem with your children.
It is becoming very risky to have children and be good parents in America.
Instead of finding every little excuse to accuse parents of child endangerment, prosecuting, locking them up, removing the children and putting them in foster care system where they are molested and abused, I am in favor of programs and schools being created to educate prospective parents about good parenting.

CPS took my child because I damaged a door. They said it was terrorizing a child. The “child” was almost 17 years old. She was not terrorized. CPS needs to learn what real child abuse is and they should spend our tax payers money on the real abused children instead of spoiled teenagers who throw fits. support CPS reform. This agency is corrupt as they come.
Comment by Kathleen Dearinger — April 7, 2008 @ 10:00 pm
I had the battle of my life back in 2001, when my ex husband molested, abused, and denied our oldest children with the basic necessities of food, proper clothing, and love.
He was turned into the local CPS office in Az.
Of course, just like most parents who are good and loving towards their children, I was horrified to be made part of this mess of biblical proportions no thanks to my ex, his Mommy, and a blind sighted CPS worker.
I had to go through visitiation hearings, a psych test (which I passed!) and being under this obscene scrutiny that never went away no matter what I did to apease the CPS Gods.
Court cases were cancelled which I was never notified of. My court appointed attorney was more of a hinderance than a help. She did absolutely nothing but kiss the Judges back side.
The state’s appointed several case workers during the years of 2001-2003. I lost count of the times the case was handed over to different case workers. That and the visitation case workers were anything but honest. I was accused of arguing all the time, and not complying with “guidelines.”
I can’t recall the anger and hurt I felt as I read the many deposition papers that were mailed to me by my Attorney. The state claimed that I was mentally unstable, used drugs, abused alcohol, and was an unfit parent.
I never took a drink in my life, nor did I smoke, do drugs of any kind, nor was I diagnosed of having any mental instablility by the half baked shrink who tested me, or by my own Doc.
I can only imagine what’s going to fly through my children’s minds when they one day read through all the allegations filed against me.
My oldest two children were bounced from foster home to foster home, the youngest stayed put in one place.
It was only after I had to sign my parental rights over that the state learned of all the countless stories told about me were out right lies. In Az, once a parent severs his or her parental rights, it’s a done deal.
I had a difficult time dealing with the fact that the child molester, and unfit parent was going to get custody of the two oldest. He had remarried to someone who used Meth, who had a history of being in and out of half way houses, prescription abuse and had her children removed from her care by the state several times. In the end, my ex messed up, his lies were found out, he told my oldest son off, and disowned him. The state barred him from having contact with my children for a year, and had his parental rights severed right then and there.
It’s sickening to learn that the state of Az, has a back track record of keeping up with all its cases. Many children have slipped through the systems cracks, and many have been illegally adopted. Parents found out many months after the fact, and couldn’t do anything about it.
I moved from that corrupt state, and have started a new life, and am the mother to a fantastic child who knows without a shadow of a doubt that he’s very much wanted, needed, accepted, loved, adored and cherished. He’s the center of my world, just as my other children are. I have contact with the oldest and youngest of the three children. The middle child’s adoptive parents don’t wish for me to have contact with my child.
I know well the pain, heartache, and fear that comes with having children ripped from my life.
I will always remember the last time I held my children, hugged and kissed them. I vaguely remember their little voices.

Terri,
I agree with you that there is a correlation between the have-nots and their place in the two-tiered justice system. I know U feel our cause is not getting the same attention as others, and I can honestly say have felt the same way, but I think it is in our best interest to not deny some other special interest groups you’ve mentioned their rights as well. Injustice is injustice, victims are victims. We would all have much more power if we joined forces and
Dr. Shirley Miller is providing us with the means to do so.
She wants to ensure justice for everyone.
Let’s ensure her litigation is successful by supporting her so we will reap the fruit of her efforts, just like anyone else who has been victimized by the Courts.

Even though my case has been over for a few years now, that door which caused tremendous hurt, pain, deafening silence, elevated stress levels, sleepless nights, missed Birthdays, Holidays, and milestones, is never closed. The whole ordeal is on constant play, and never stops. A person may teach him or herself how to overcome all those emotions, to move on with life, and to find new reasons to laugh and smile, but, the haunting pain is always there.
It’s difficult to not go into full detail about my horrendous experience.
My encounter with CPS began in early 2001. At first, my involvement was as a third party. I was the person CPS would turn to when they felt it was appropriate to share new claims with me regarding my ex.
Then came the Sherriff who was doing a follow up regarding an allegation my ex made against me. He was found out in the end, and was given a stern warning by the Sherriff who took the case.
Then came the scrutiny, the home visits with moderators, who were focusing on my ex, and his family.
The psych tests, the almighty shuffle of Caseworkers, supervised visitations, and more caseworkers from another agency. I can honestly sum the whole experience right up there with having a Root Canal done without being given a local to block the pain.
The lies, accusations, being used by the state, and alas adoption papers filled out with the wrong last name
(toally illegal, but they got away with it), and of course the topper, a CPS Caseworker who lied when filling out my family medical history, individual birth experiences, my own medical history, etc, for my children’s individual files (which I should have done myself.) The above mentioned, were just a small part of my experience with Az.
My Attorney was totally and completely on the state’s side, and was a total hindrance than a help.
Still the lies, and mind games continued well after I had signed my parental rights over. I was still a party to the case, even though I was legally out of it.
I didn’t have a voice, but was still involved. How’s that for being neither here nor there?
It wasn’t until the last year of the whole experience that little by little, the lies told about me came to light. My ex was showing his true colors, and began to treat my two oldest children’s foster parents just as he treated me. His new wife was calling wolf every time my son’s would visit them. And then, the moment came when my second child could no longer visit my ex because he was reverting back to his old habits and problems he had at the time he was placed in his now adoptive parent’s house. My ex’s wife couldn’t stand my oldest, so my ex basically wrote him off.
It was then that the state, my son’s foster parents, Attorney’s, etc found out that I was infact innocent, and shouldn’t have been involved in the case at all. They barred my ex, and his wife from having any contact with my children.
I now have to live the rest of my life with a bad report stuck to my name, and with absolutely no thanks to my ex, his Mom, her friends, and, the state of Az.
It’s pathetic that a parent no longer has a voice when it comes to defending him or herself. The state is all too willing to jump to conclusions, and to do what it takes to tear families apart, just because they claim abuse was done without doing a thorough investigation of all parties involved. The state claims that if one parent is guilty, the other is too, even if that’s not the case.
Many falsehoods were claimed against me, and I had to deal with each dishonest, belittling blow to my character without showing emotion.
I completed each and every one of the state’s mandated requirements. In the end, all the signed and documented requirement I completted went into my file as “Unwilling to comply, and requirements not met.”
The day that I read that I was in the state’s eyes, considered an unfit parent, was the toughest blow I had to deal with. My immediate thought was “How dare they claim that against me, when I’m not the one who did those horrible acts against my children!” It was then that I realized the state will do anything to turn a loving, caring parent into a monster who could care less about his or her own children. They know full well that when the child or children become of age, he or she will request to know of the situation which led them to being adopted, or permanently stuck in the foster care system.
I’m grateful that my children know of my unconditional love for each of them. My children harbor no ill feelings towards me, but, they do have great resentment against my ex, and his wife.
Every time I talk to my children, or receive a picture, or letter from their Mother’s, I feel as if I’ve been given a huge hug.

Honestly… again CHILD PROTECTIVE SERVICES not PARENT PROTECTIVE SERVICES. This Dr apparently is not looking at the best interest of the children. If a child has been with adoptive parents for a long period of time they need to leave the children alone. Honestly if my children were ever taken away I would do as much research as possible, and make sure I was aware of my rights. Unfortunately sometime there is corruption however, I would use any excuse I guess too if I blew threw all my opportunities to get my children back. But think why would the state want to make sure children are being adopted if the parents are clearly doing what is asked of them? The state, the same people you claim that are receiving money for adoption have to pay for legal fees for any one who adopts kids that are in custody of the state, on top of that they also usually have to pay adoption subsidy, even though it is very, very minimal. Please conspiracy…. or guilt of a parent who realizes that they made a mistake and now it is too late?
Comment by Mary — May 30, 2008 @ 7:15 pm
if you look at studies properly, many children are abused, sexually by other children in foster homes that (in 8 out 10 cases) bio parents messed up in the first place. How is that the foster parents fault. Usually sexually abused children are and should be placed in a therapeutic foster home. A lot of times CPS will remove a child and not even know about sexual abuse until they start to act out. So again how is that the foster parents fault? Can’t bio parents take any responsibility for anything they have done to these innocent children?
Comment by mary — June 2, 2008 @ 2:27 am
Some people have obviously NOT gone through one single CPS case as a parent who has done NOTHING wrong to hurt his/her child or children.
There is NO ground to blaspheme the parents who have lost their children to things that were out of their control in the first place.
It’s a total shame that this day and age, any little thing that a parent is blamed of is warrant for their child to be taken from them.
I remember there was once a time when a CPS worker would actually talked to the parent or parents about the claim against them. The case worker would also talk to teachers, school counselors, and if need be, talk to the child or children involved.
If the child needed to be removed from their home, then the proper steps would be taken to do so.
Sexual abuse, physical abuse, & the like happens in one parent’s house without the other knowing about it until it’s too late. The same goes for Foster parents houses as well. It’s a sick, sad, disgusting epidemic.
As former Foster & now adoptive parent if I feel that a biological parent is good, I allow open communication between child and parent. If I know a parent was abusive, then all comminication is off.
Nobody has the right to tell a birth parent (other than the adoptive or Foster parent) to stop contact with his or her child if communication between parent & child has been established, & is monitored.
Open adoption is beneficial to both the birth child & parents.
Here are some examples of CPS jumping the boat:
A few years ago, some of my friends lost their three daughters because their oldest lied to her teacher. She was mad about something, & reported to her teacher that her parents refused feed her Bkfst. in the morning. She went on with the lie, & said the only meal she ate was Lunch at school.
CPS did not talk to my friends before barging into their house. If CPS had talked to my friends, they would have found that not only was this child eating her Bkfst, Lunch & Dinner, but she was eating snacks imbetween each day.
Six months after the children were removed, my friends family was reunited.
A man from a church down the road got the shock of his life when he was accused of supporting his 15 year old son’s drug habit.
This guy, hardworking, widower, had absolutely no idea his son was doing drugs.
He knew his son was depressed, & was in the process of arranging a counselor for him.
One night, his son snuck out, & was later arrested.
Within a few weeks, CPS stripped this man of his parental rights even after his son begged for them not to from a half way house.
This man was barred from having any contact with his son until he turns 18.
A lady down the road has a son with severe Asthma. One day, he had a bad episode, & was taken to the E.R. by Ambulance.
The Doctor, Nurses, and parents alike tried to tell the Social Worker that this child has been having episodes since Toddlerhood.
The Doctor even went as far as showing the child’s medical records. The Social Worker already made up her mind that this child’s parents were negligent, & would have nothing to do with medical proof.
Three days later, the child was in state custody.
Two years, & several episodes later, CPS decided that the parents were innocent. The family was thus reunited.
Another lady’s Grandson was playing in a tree after he was told not to. He fell out of it, & broke his leg. Not only did my Grandson have a broken leg, he needed surgery to fix it. CPS did not ask, they just barged into my Grandson’s recovery room, & took custody of him. Fortunately, later that week, he was reunited with my son & Daughter in law.
Whether or not a parent knows his or her rights, does not make a hill of a difference when it comes to taking on a state custody case.
Parents are given a list of their rights at the beginning of their case.
What they are not told is that those rights are basically null & void from that point on. It makes no difference if they choose to comply or not. They are all treated the same way, and that is without rights.
I have seen with my own eyes many, many sneaky, deceitful, underhanded, and manipulative things CPS has pulled against parents.
These were things that kept the child or children as wards of the court.
Nobody’s claiming conspiracy. What they are doing is sharing their experiences just to let people aware, and know that they are not alone with their CPS struggles.

Jeff, I know… I was so depressed during the time CPS had my baby (back in 1989) … whereas normally I have almost no depression. What can be done to alleviate depression? Thousands of parents need to know. I know about St. John’s Wort…
Have you tried a state administrative hearing to resolve the problems with your caseworker?

I petition for a rehearing by the panel filed by appellant is denied by the UNITED STATES COURT OF APPEALS for the eight circuit office of the clerk ST Louis the appeal from the U.S. District for the Southern District of IOWA sign by Michael E. Gans they have voilated my rights and attorney general is behin it all just like county attorney they are both corrupted Mr Charles K Phillips who works for them keeps denying my request because He know that I am right that they lied so in the Federal Courts they said that the state court did’t do no wrong but I know they did.

Please don’t judge all cps workers because you had a bad experience that would be the same as a white person judging all Latinos because he was robbed. Why I say this is simple I am in school to be a CPS worker and my Wife is one already. Just recently she has been working in a small town pleading with the judge to remove a child, but since the judge knows the parents he refuses and guesses what as of today the child is gone. Now she cried herself to sleep saying she failed that child who secretly keep asking for help. The majority of CPS workers take the job to help, although there are those like in any profession that abuse their power or just are in it for a pay check. So please don’t hate the organization instead ask that they higher better people with BA and not someone that took a course as some major city do. My wife went into this profession with a big heart and an open mind, thanks good she hasn’t not change but I can’t tell you how many times she has come home and just held our daughter in her arms and cried. It’s a painful job and can be very stressful I only ask that if you point the finger at the ones who don’t do their job than please give credit to those that do. One more thing ask yourself how many times can you handle a case where a child has been sexually abuse and the parent has no remorse I remember during my internship I saw a work question a parent about dozen of sexual chargers to all five of his children and the only problem the parent had was that we got the date that it happen wrong. Think about it looking into their face and not even seeing one tear for their child not one sign of remorse. CPS was created for a reason and I agree all cases should be done with a fine come and reevaluated after sometime. Just please see it from our eyes before you judge all of us because of some bad apples

How come school officials, CPS workers, judges, and so forth are not held accountable for organizing child kidnapping?
How come schools and parents are not held liable for mislabeling and disproportinate placement of children and special education?
How come Doctors not held accountable for over-medicating our children?

Nando,
You are right there are some good CPS workers, however, I do not think that they are included with the bad CPS workers. See one thing people must realize is that if a CPS worker does not go along with it’s employer, the judge, and other affiliates they get fired, threaten, and so forth. With my case a lot of people did what they did to keep their jobs even though it was wrong. This clickish system with CPS is really all about the money and destroying the family unit. Many receives promotions and so forth for injustice. However, I forsee a lot of people going to be held accountable and legal actions will be taken. I forgive all of the 57 or more that was involved in the illegal removal of my children, however, I am fighting for crimminal charges to be enforced.

Dear Dr.Shirley Moore,
I have seen your video on YOUTUBE about COURT CORUPTION PT1 & 2.I would like to get in touch with you about my child support case which has turned criminal.I have some insight about the “system” but need a little coaching. If you would be so kind to contact me back I can explain in a little more detail about my case in order to hit the FRIEND OF THE COURT with its ‘conflict of interest’ defense.
Also if you have the information to the next ‘Rally’ in D.C. or anywhere else please let me know.I would definetely like to sign on for the class action law suit as well.

It has gotten out of hand everywhere and it’s up to all of us to take a stand. They’ve taken 4 children from my wife and I and we were always so torn up that once it was over, we were just glad for it to be over. This time they took our baby on October 30,2008 and we haven’t seen him yet. They have hurt me all that they can hurt me and this time I will NOT be scared by their threats and I will NOT take it sitting down… CPS has to be stopped…
Please don’t forget to sign my petition…
