Marsha... right now you need a lawyer even if you can't afford one. The number one preventative factor that keeps caseworkers from proceeding with CPS cases (at the beginning) is a good lawyer on the parents' side. You could try writing to a legislator later... or now, but you have to follow your heart on that. I can't tell you when would be best because every case is different, and I can't predict how your caseworker and her supervisor might react.

Do we wait to complain to th.e legislators after they take our kids, or risk being retaliated against for writing to them prior? Any help is appreciated, they are about to take my son- and I know they only get paid if its permanently.

Am with Colleen on this one- CPS is the number one tool disgruntled people use against one-another, especially in California & Arizona as well. I've seen someone who was mad they weren't getting paid for babysitting call right then & there, to make up lies, so that they will win in Small Claims court. There is no end to this nonsense!

I don't know whose calling on me, or why all of a sudden a CPS worker is calling me- saying first she had one allegation (she deemed unfounded) and called back saying has 3 more reports on her desk now? Really? She has consistently lied to us, and I am being nice, but I need an attorney- I am a single mother, but my ex & I are friends- they are trying to use my older son as a reason to take my younger one... How can someone fail to supervise a 15 year old, when they are on their own property or next door- with supervision? It doesn't make sense. The only thing neglected in my house, is my non-existent PEDICURE.

Mary, once your children are in the juvenile court system they will need a court order to give them back. Prepare for your next court date by giving the judge a copy of the test results along with your signed declaration. See our legal document library for the link to a sample declaration. You'll need to get your side of the case entered into the court record with this declaration. Good luck!

So sorry, Robin. CPS agents are corrupt and cannot be trusted. It is like this all over the USA. This is why the site exists. You have my deepest sympathy.

my husband and I have been trying to adopt twins that are related to us by marriage. the twins were with us thru foster care from NC. We live in Fl. the Fl agency took the kids, gave them back to NC and now NC has allowed on of their very own adoption unit employees adopt our babies after telling us all we needed was the adoption approval, which we had 5 months before the employee filed her petition for adoption. DSS of NC told our lawyer not to file our petitions for adoption and the lawyer listened to DSS because he was in the GAL program in that county. we have been to court 8 times since April 2010 and still have had no luck. everyone in the systems of lawyers and judges agree we were wronged by the agency but no one is willing to do anything to help us get the babies back. No lawyer will touch our case without 12 to25000 dollars up front. the attorney general office says they only do a report on the CPS employees and the the CPS have the right to hold themselves accountable and they have done nothing to correct the things they have done wrong to us or our babies
