S. ...You could stand up in court and tell the judge that you don't trust the lawyer and prefer to represent yourself. Prepare to hear the judge refuse your request. What would you say next if he said no? Find your state laws for situations like this, and have them in hand.

I faxed my court-appointed lawyer a letter similar to the one above, and he mailed me a letter back, but at my court date, the lawyer did NOT provide me with any documentation of the discovery even though I demanded it in my letter. He also misrepresented me. I would like to rely on myself for my own representation.
How do I remove him from representing me in court?

Gabrielle, you used too many names, even your kids. I can't post what you wrote. You can get feedback on your case at our message board.

I just want everyone to know if you're in Central Texas, Rollin Khoury is a very good court appointed attorney. I don't know if you can ask for one by name but if you get him he will stand up for you if you are innocent.

I just wanted to say I wrote the letter to my court appointed attorney. I re-worded some of it. I added in some things. He did not find it offensive. Instead he actually is fighting for me. Even the CPS people were surprised they asked him if I hired him or if he was appointed, He told them he was appointed and they said " Wow, good for you. Most appointed attorneys aren't this prepared." He asked them straight up " Why can't my client have her children back? All the allegations stem around her husband and he is out of the picture so why can't she have them?" Unfortunately our hearing was post poned until next week. I thank God for finding this website and for my attorney. Thank you.

You could try suing the attorney for malpractice if you have a copy of the letter proving you asked him for more help - and he didn't try to help you. As far as getting custody of your children - I have no idea what your case was about so I don't know why the children are being withheld from you. You are lucky if they are going to your ex rather than a foster-adoption family. At least you will know where they are. The best advice for getting your kids back is to do everything on the service plan and fix whatever's broken in your life. Sorry if this isn't the perfect advice in your case but generally speaking, that's what I'd advise. Once your life is straightened out and you've got a good income, you can always ask for more visits from your kids, and work toward reunification.

I used the advice on the site after many unanswered calls by my court appointe attorney, he dud in fact call me back after receiving my letter and told me my hostility wasn't going to get me anywhere. I tried opening the door of communicating and still he wouldn't call me back was very rude and refused to call witnesses or ask vital question in my trial. This was after I plead to the judge begging for new council and was denied. I am now in the stage where they are trying to grant custody to my ex, I haven't been able to speak to my babies in almost 5 months. My attorney blatantly said to me at our last hearing there wasno need to return my calls when he had ample time to go over our case prior to court...mind you a maximum of 5 min is what he was referring to. He has allready told me the next steps are merely for the sake if doing...and that they have allready predetermined the fate of my children. ...I don't know what else to do,...I am so lost since the system is so broken! Do I have any other options???

James, I wonder why... because during my time advocating for parents I've known of many parents who used drugs and later got their kids back after rehab. So is this not the first time CPS took your child? If you relapsed that would count against you because they don't like repeat cases. Do everything you can to clean up your life and become the parent you want for your child. Put that child first and impress the judge. You can work around a deadbeat attorney.

My case has been open for less than 30 days and my case involves drug use. Today my attorney said to me that there is a 100% chance of not getting my kids back. What should i do since my "legal representation" has decided ahead of time i am not getting my child back. Case takes place in Washington State. A speedy reply would be appreciated. Thank you in advance.
