Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.

Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.









Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.

Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.

Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.

CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.

Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.

It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Lawyers who take CPS defense cases

I’m getting a lot of requests for referrals to lawyers who take CPS cases. If you know of any lawyers who do CPS defense, please tell us about them here. If you are a lawyer, please sign in by using the comment link below this post.

Please give us contact information… website links are very welcome. We need to know what state CPS defense attorneys are in, so at least tell us that much.

I’d like to make this page a permanent resource for people looking for lawyers who do CPS defense. Your referrals can help.

To those who don’t have competent attorneys, who can’t find a referral here, I have a suggestion: Go to your county courthouse or to federal court (if you intend to file a lawsuit there) and look through the cases, which should be listed in some kind of computer program. You can ask the county clerk for help locating cases. Look for cases that have the Department of Social Services (or whatever they call it there) as a defendant. Then find out who the attorneys for the CPS victims are. In this way you’ll probably find lawyers who are willing to take on CPS cases.

If there’s nobody available in your county, try nearby counties. Sometimes getting an attorney from another county is the best thing you can do - they are less tied into local politics and not worried about staying friends with local CPS workers and judges.

  3. Linda, just a comment to second what you wrote here.

    Look up your state’s name for its CPS agency.

    Who has won ( prevailed ) in litigating against CPS recently.

    Remember, in NJ, Childrens Rights won a 12.5M dollar settlement for the 4 starved, adoptive boys.

    Remember, that too, often caseworkers and their Supervisors may hold or carry Malpractice insurance or Errors and Omissions Insurance against their negligent acts.

    In fact, the Texas DFPS Website, used to tout insurance sales to its caseworkers, right on the Website.

    If the lowly caseworker does NOT carry insurance, the Supervisor MAY.

    Now this will come out should the case come to deposition.

    However, it is noteworthy to understand that NJ was only suing DYFS for 10M,. but once someone called the Plaintiff’s attorneys ( I wonder who that might have been) the settlement went up by 2.5 MILLION.

    ALSO, THE settlement by Childrens Rights allows others foster children in NJ to sue more easily.

    Preble in WA, Stuckle in I believe North Texas, and others are the names of some attorneys that come to mind.

    Please folks, note that DSHS is the MOST SUED AGENCY IN WASHINGTON.

    Folks must realize that the settlements are often CONFIDENTIAL OR NOT PUBLISHED.

    Remember, even the Roskas were offered 3 settement figures in Utah.

    They ranged from 5 Thousand to 200 Thousand.

    So it is possible to win.

    And I believe it may be the only way to tame CPS’ unnaccountable, un-overseen and irresponsible actions.

    Heck, folks slip a law librarian a few bucks and they will research this issue for you.

    Or even give them a bouquet of flowers.

    You will not only help yourself, but curb CPS’ Fascist tendencies.

    I strongly believe Many CPS victimes will find CPS lawyer here.
    Com on guys , I don’t see enough names , we need more and more CPS lawyers names here.
    Remember the day you were looking for a CPS lawyer , it was like looking for a needle in a hay stack , wasn’t?

  8. Vera: Yes, dependency court attorneys, or attorneys to sue in federal court. Any lawyer specializing in going to court against CPS - that’s who we need to know about.

    Lawyers can use this space to advertise what they do, or people can post about lawyers they know who have been helpful in these matters.

    Washington state has ruled.

    Suggest parents, grandparents, etc. contact the attorneys mentioned on this Website.

    Note that in the Bramm suit v Washington abuse not mentioned, Just that the state moved kids excessively, cw’s untrained, kids needs not considered.

    This needs to be litigated for the good of everyone.

    Please folks, get back to this site when you hear from the attorneys. It may be even better if you have a group of folk from one particular state who assert that their family members were mishandles by CPS.

Like many of us, our first days in court seem a blur and not knowing and believing in justic we allow the courts to stick us with counsel and thats where the nightmare begins Ive been through six different attorneys and what they did best was take your money And when you do find one that will fight its too late but hopefully that good one will have made the record and you always have appeal and that man

  27. i need help i lost custody to my 6 month olds dad even after he failed a cps drug screen!! all because of a mistake i made with my first daughter. i have about 6 mental health reports that say i am fine but the psychologist that they paid to see me has said i am a danger to be around any children!! And my caseworker got up on the stand and admitted that i had done everything on my case plan but i still only get one 4 hour supervised visit per week and they are recommending it be that way until she is 18 i lost her when she was 2 weeks old

We fought with cps in the state of NY and we moved to Az. we did what they called a menu that has parenting, anger management etc. etc. We complete then have us do it again or the fosterparent would make stuff up which held a court delay they were waiting for the recent 15 months out of 18 to terminate rights, they forged letters and stated i wrote it, you can planly see the hand writing isnt mine. My husband and I decided that we should file a lawsuit, if we win a civil case we maybe able to overturn the adoption ???? If nothing else when our kids turn 18 we will have a paper trail showing we never gave up on them and have an acct. with money in there for college. Any ideas where to start? I dont want a lawyer in the same county becaus eno lawyer wants to make enemies of judges and cps. This tookplace in Erie county.

  30. I’m in desperate need of an attorney. I’m disabled, I don’t have any money left, except the pittance of a SSI check i get that barely covers my rent and bills. I spent my savings trying to get the girls home and I’m barely hanging on to my apartment and I’m forgoing fixing my car until better times. We could take our services out in trade.   33. I would like to get more information. My daughter, and possibly all five of my children were molested by a member of the household in which my children were placed.   34. We were fostering my granddaughter. I failed the drug screen (urine was clean, hair was not). A case has been filed by CPS against me for failing the drug screen. There are also allegations of drinking to excess around my step child, passing out drunk, and picking her up from caregivers too drunk to drive. My record is clean. CPS did a home study and approved us to keep my granddaughter. My granddaughter was taken from us Tuesday and we were contacted Wednesday by CPS with these additional allogations. I have no idea where these additional allogations came from. They are totally false. WE NEED HELP in Amarillo, TX.

  35. I was put into foster care from the ages of 8-18 years. I was coerced as a child to tell the cps worker that I had been sexully abused. I kept stating that that wasn’t true.I was threatened and harrassed harshly and told that if I didn’t say such things that I wouldn’t see my parents again. The cps worker also told me that little girls get into trouble if they lie.I finally gave in the lie and told the cps worker I had been sexually abused by my step father. I was taken from my parents anyway and placed in foster homes and shelters for ten years. My step father was imprisoned falsely for nearly 20 years of his life and is harrassed and has been put in and out of jail since he’s been out in 2005 to this day. We don’t know how the state of Texas was able to do such a thing because proof was never found on their behalf. As soon as this incident had taken place the cps worker quit her job! Please help our innocent family in Killeen, TX.

  37. My son got married to a Lady that they have Dated for Ten years, and now married for one year. My Daughter in Law’s “X” husband who use to beat her and he was on crack cocaine and drank allot, is now saying he is sober and wants custody of her older son.
    well from that she said No way and now he made a “CPS” case and now the worker trying to take my grandson out of my home.
    CPS is falling for the story’s the “X” husband is saying and now they arrested MY son for child abuse That never took place. My son has been the Dad to My Daughter in law’s son from the day he was born The child is 8 years old and the courts will not let us do a DNA test as I think the boy is my son’s son. The “X” husband has no other children and now he is trying to say this Child is his.
    Now my Son is homeless course he was told by the Courts that he can not be around the Children and I am talking about four children with one on the way.
    This is hurting our family as we do allot together, and it just dose not feel right when My Son can not be with us on Sundays dinners or what ever we enjoy to do with the Children.
    Please tell me what to do, My son has a lawyer but that lawyer field to show up on court day and it is postponed over six months now , we also got paper work from “CPS” saying unfounded but my Son can not come home till the courts drop the stay away order They are still dragging this case way to far. My son and his family are on welfare, and my Son can not read at all but he is a great DAD to the Children.and I am deaf not dump as The CPS people treat me as if I don’t know what I am here for.

  38. I am looking for an attorney in Yadkin County North Carolina. CPS has taken my only two grandsons. The oldest is 16 months, and the baby is 2 months. I have been trying to get custody, guardianship, or something to get them out of “the system”. I did have visitation until a few weeks ago, and DSS said that I wasn’t allowed to see them anymore. They are wanting to terminate parental rights on the oldest one and adjudicate the newborn. Both of these babies need to be home with their parents. Help me please!!!

  44. My step-daughter was living with me and my husband and we were having a lot of problems with her. She was acting out because she wanted to be with her Granny (my husband’s mother) So we sent her over there problem solved so we thought. Now his mother has called CPS and accused me of stuff and my other 2 kids. His mother and I have never got along but she has went to far now. CPS went to my kids school and talked to them but I have not spoke to them. I don’t think it would do any good to speak to them. This is not the first time we have had dealing with CPS. They tried to charge my husband with injury to a child last time but they couldn’t. This just makes it look even worse. The child is no longer even in our home. Why can’t they just leave us alone.

  52. Linda has put this part of the site up for attorneys living in your jurisdiction to possibly contact you.

    So, you must indicate your state and general area or county.

    The attorneys would read your postings and decide if you have a valid, winnable case.

    If you are low-income, you can be appointed an attorney by the Court.

    It is difficult to prevail against CPS, but it can be done if you keep your head and are basically a good parent.

    Remember they employ at least a couple of attorneys in just about every CPS county office. Sometimes you are fighting City Hall.

    However, you should realize that the Court is the only one who makes legal decisions. CPS supposedly offers * recommendations* but Judges decide.

    You should also write a valid email addy. Do not include the @ symbol.

    And you are talking about spending some cash.

    A gentleman in TX recently won a 6 figure settlement v DFPS.

    A mom in Orange county won 4.5M against DSS in California, however, CPS is appealing the award.

    This mom had her 2 kids taken on some pretext.

    However, remember that the only defense against CPS is your not talking carelessly, and in knowing your rights and where CPS is dealing from honesty or whether they are scamming you.

    I know Linda will not support those who callously abuse children; however, many of us question the tactics and unfair assumptions that young folks make who are caseworkers. No matter how much book knowlege you have, raising children is an art. Each child is different and parental rights to have the care, custody and control of their own children have been settled by the USSC to be a valid liberty interest of families.

    Governments do not raise children, people do. Some of us are imperfect; indeed, most of us are.

    Government often makes mountains out of molehills in an effort to root out more abuse.

    Pretty soon there will be no more skateboarding, horseback riding or even football. You see…..all of these activities are *dangerous.*

    I believe even more middle-class folks will be visited by CPS in the future. You see, they have to justify their jobs.

    BTW, did you all know that the recent SAMSHA report that cw’s have one of the highest rates of depression?

    It must be difficult to do such a job. Especially when you fear or think that you often may be harming MORE CHILDREN THAN YOU HAVE HELPED.

IT DAZED HIM AND I GOT AWAY TO CALL POLICE. HE HAD DUMPED BEER ALL OVER ME PREVIOUSLY. THE POLICE CAME AND BROUGHT CPS AND THEY ARRESTED HIM FOR PUBLIC DRUNKENESS AND ESCORTED HIM OUT OF TOWN THREATENING NEVER TO RETURN AND BREATHALIZED ME, I PASSED AND THEN TOOK MY KIDS. THEY MAD ME DRUG TEST TWICE, I PASSED. I DON’T DO THAT AND MY CHILDREN AND I GO TO CHURCH 3 TIMES A WEEK REGUARLY. MY DOCTOR PUT ME ON NERVE PILLS FOR PANIC ATTACKS AND NOW CPS HAS MY KIDS AND I WENT TO COURT AND THEY ARE TRYING TO SAY I AM CRAZY DUE TO THE MEDICATION. I AM MIDDLE CLASS AND RUN MY OWN COMPANY.   57. I have raised my niece for approximately eight years now. I also recently had a relative placement of a 2 yr old cousin from CPS. My niece was pregnant and no one in the family, not even my niece, or even the CPS worker that worked with us for the placement knew she was pregnant until the day she gave birth. My niece recently got into trouble and is currently in a Juvenille Detention Center. I am unable to visit with her as I only had parental power of attorney to care for her all these years and I am not considered a legal guardian. CPS removed the 2 yr old stating that it was “procedure” and then told me that they were going to send him to another relative placement home so that my niece could come back home, knowing that the Juvenille office was not going to allow her to return anyway. I have asked several times why, but am getting no answers.

    CPS has stated on numerous occasions that there are no allegations against my husband and I and there are no charges against us. We are not allowed to see the 2 yr old, my niece, or her child. We were listed as a placement home for the new baby but CPS says they can’t consider us because we did not know that the niece (mother) was pregnant. This coming from the same CPS worker that stated to her supervisors that she could not tell that the niece was pregnant either and she saw us at least once every couple of weeks. So far, we all keep getting different responses to the same questions. We do know that there are no charges or allegations against us but the removal of the children have made us outcasts with some of our family members and we come from a very close family. I am really just looking for some advice on how to find out why they took the 2 yr old and why they will not let us see any of the children. We have no criminal history and no prior CPS history. I am tired of the Department of Family and Protective Services and the Department of Juvenile Services dancing around, changing their answers, telling one of us one thing and another something completely different and blowing smoke. Any help or advice on how to get some answers and find out why they are doing this to us would be greatly appreciated. I know parents who are on probation for physically abusing their children, registered sex offenders who have children, and parents who have put their children in danger due to drugs and they all have custody of their children but we are good parents who are very protective of our children who have never had any trouble in the past and were approved as a placement home for another child and we aren’t even able to see ours. How do we defend ourselves?

    Hello my name is Danielle Sade White and I am writing this letter for many reasons mainly about my daughter White I will start from the beginning. When I was 11 years old I was Raped by my mother’s boyfriend Tim Whitehead Hamilton County Case Number B03077726 more times than I can even remember and due from the rape I had a child a the tender age of 13 I had not even been 13 years old for six month. Even though I was raped I still love that child in very much for some reason I felt like she was apart of me and I kept her anyway. I had Chenille Mikeshia White November 27, 2002. Every thing was okay that first year Tim did not go to jail right away it was a year later of chenille life that he got sentence 9 years in prison. I was staying with my mom she was having a very hard time dealing with every thing. Until one day she relapses and starts doing crack cocaine again. We had seen my mother relapse before but never like this. I told chenille before we left the hospital that I would always keep her safe and make sure she did not have to go threw some of the things that I went threw and see some of the things I did. So I decide to go stay with my Grandmother Lillian White and stayed there for about an year and things were okay it was just that my grandma house was old and need 80,000 dollars in work and she had been there 40 years and she said it was time to move on. Well I had went to this independent living program called Positive Beginnings well I was only there for a short time the lady was not running the program right and my worker at the time Monica McGowning who works for Job and Family services did not like what was going on and said I need it to move. My mom was doing really well far as her drug addiction but she had found out that she had Breast Cancer. I wanted to move back home to help her with her cancer. And that what I did me and chenille went back home and every thing was okay for a few months and then in march 2006 my mom relapse once again. I was heart broken because I put so much trust in our relationship that I knew with her having cancer every thing that she would not do that again. Well I called The Cabinet for health and Family Services. Well I thought that they would get her some help but at the time she was not ready to receive it and I and my mother had got into a big fight and she put me and chenille out the house. It was the weekend so on that Monday I went and told my Social Worker Tracy Gentrump what had happen I was hoping that the had some type of independent living program the do but you can’t go there if you have a child. So the filled an ECPO or some thing like that and we were put into foster care I could believe a lot of thing about my life but I never thought me and chenille would end up in the system. I came into care with a Job enrolled in school and I had chenille in school and my own car. Every thing that I had I had work so hard for or to get. Well every thing that I had set up stayed the same. Our Foster Mom Felicia Blythe she is a very good person and things were good between us for a while. The thing about Felicia she tries to be your friend than you foster mom and when she got tired of being your friend she wanted to be your foster mom but it was to late for all of that. Well on 10-4-2006 we had a disruption meeting they were going to change my foster home and I really did not want to do that because I got tired of moving chenille around. Well Felicia had changed her mind and said okay she can say she does not have that long until her 18th birthday. Well things got better between me and Felicia. And I could not be leave it I had started dating a boy name Dustin Buckner every thing I had been threw so had he I mean down to the T it set for the baby part and really understood each other. In February 2007 I found out I was pregnant. In April of 2007 I and Felicia start having problems once again this time because she said I was never there I would always be gone and that was true I am 17 years old I have an car why would me and chenille sit in the house. Well she had said some other stuff to her Social worker Katie Mulroney. Well Felicia had given notice once again and I felt like she was playing with my life now so every thing she had ever did wrong or said I told. And when I did that she really wanted me gone. So on May 16 ,2007 50 days before my 18th birthday they changed my foster home I knew they were going to move me but the moved me to Greenup , Kentucky witch is less than 3 hours away. I could not believe that I lost my job at Oldnavy and I had to leave my car parked I did not have any notice that I was moving that far way so I could not make the right changes for my car. Well they had changed my worker to Tina Ruffin and she is real rude and she talks to me like I am a peace of trash. Well the day I moved Tina was out of the office so Tracy did all the paper work that day and she said Danielle you are only going to be down there until we can find a placement up hear for you. Well I was with the company called Necco and the case manager up Kim Badly said your worker Tina Ruffin said you are going to be down here until your 18th birthday first lie The Cabinet for health and Family Services told. So I said how I am I going to find an apartment form being all the way down here. So then they said a couple weeks before your 18th birthday we will bring you back up here so you can look for and place. Well since they changed our foster home we had to have new physical and new dental and eye care again. Well at the doctor office we are getting our physical chenille has the doll baby and she is looking in her virginal area with a Q –tip and the doctor said that sign of sexual abuse. I said no its not I was sick real bad one day and I had know one to keep chenille a couple a weeks ago and when the did my cathider in chenille was out side with the nurse but she heard me say it hurt she ran in the room and say me that’s where she got that from. Well they want to take her to see a specialist to make sure she has not been sexually abuse I said find. So May 24 , 2007 Chenille goes to this place called Hopes Place and they say chenille Hymen is broke and because of that she has been sexually abuse. I have talk to a lot of people and they said that there is many way you hymen can be broken. So chenille has been sexually abuse so what The Cabinet for health and Family Services say. The Cabinet for health and Family Services has also said that I have HSV Herpes Simplex Virus well for a fact I can prove The Cabinet for health and Family Services wrong for that I do not have that and my doctor records prove that I don’t already have them caught in one lie. June 15, 2007 Tina Ruffin clams that she can’t find a foster home that’s willing to take me for only four days to find an apartment. So since you do not have a place chenille will stay in foster care or you can extend you committed and stay down here in Greenup together. There is that second lie that The Cabinet for health and Family Services told I feel like the could the just did not want to. I decide it that if I went on ahead and came home that I would be able to set things up better. On my 18th birthday I did that I came home only things were a lot different then what the said on the meeting on June 15, 2007. According to Tina Ruffin her supervisor Lynn Berich-Hart witch I really do not get along with her said chenille is going to stay in to foster care 3 to 4 months she wants to see consists and that I would only see her 2 times a week for only 2 hours. I can’t have the phone number where she at or know where she at. I am thinking to myself what I did to deserve this. I have never abuse chenille or did drugs or harm her in any type of way. When I came home I found out that my car was in the impound lot and its 500 hundred dollars to get it out. The money that I do have I am saving it for the apartment. I came into the system The Cabinet for health and Family Services with a job a car and chenille on my birthday I left with nothing now how is that I thought you left the system better than you came. I feel like The Cabinet for health and Family Services think they are God they are playing with people life’s I do not think that every one situation is like that. But a lot of the teen mothers I have spoken with are going threw some of the same things I am parents messed up not us why I am paying for it. I am taking a stand for me and chenille and for any other teen mother that’s going threw what I am.   63. I need help. This is a rather long story, so I will give you the “reader’s digest version.” My granddaughter was taken by CPS in Dallas. Both my daughter and granddaughter are residents of my house in Kansas City, KS, and they were in Dallas with my daughters boyfriend to explore the possibility of moving to the Dallas area. She has since left him, as he has been abusive toward her and after he was arrested on Oct. 9 (the same day that the baby was taken by CPS) she realized that he wasn’t going to change and doesn’t want to be with him any longer. Anyway, long story short, they were in the wrong place at the wrong time, my daughter tested positive for hard drugs, and CPS took the baby from her.

    I am trying to get temporary guardianship of my granddaughter, to bring her back to her home in Kansas with me. Because my daughter had a Kansas child protective case earlier this year, the DA decided that Kansas wasn’t doing their job correctly and has decided to keep Zephyr in Texas until a home study is done by ICPC because the DA doesn’t think that I am an acceptable guardian because I admitted to smoking marijuana 2 weeks before the baby was taken while I was at a party, and smoking only very occasionally, with this last time being the fourth time that I had smoked this year. (When I told CPS about this, they told me, of course, not to smoke anymore, but they didn’t forsee this as being a problem whatsoever because since they deem marijuana a “soft drug” they only become concerned if someone is a frequent user, such as once a day or so.)

    CPS said that she would be transferred to KS because the baby is a KS resident, and the baby would be in foster care here until a home study was done of my house. However, the DA in court on Oct. 23rd chose to keep Zephyr in Texas under Texas CPS guardianship until ICPC could do a home study to determine whether my house was appropriate because they thought KS would mishandle the case and they wanted to keep her in Texas so they could oversee the handling of this.

    So, my question is this: Does Texas have the right to claim jurisdiction in this case and keep the baby there who is a Kansas resident, or should the case have been transferred to Kansas? Is there a protocol that exists between state child protection agencies about “full faith and credit” regarding the trust that should exist between state agencies?

    Thank you for any advice that you can offer. I can not afford a lawyer, especially with taking trips to Dallas every two weeks now for visitation with the baby (gas - this is an 1100 mile round trip for us 2 times a month, motels, and loss of work time.) Our public defender did no “defending” and just completely went along with what the DA requested without even trying to argue about jurisdiction, possibly for good reason. I don’t know, I am not a lawyer, but I feel like I am really getting pushed around by Dallas, TX family courts.

  65. To make a long stroy short there were false alligations . We had the case expunged within 6 months.
    I have prove that the county and the state have broken laws I also know for a fact that there is away to find out the number of any caller if it is a false alligation. I can prove that they system does not work.
    I’m looking for a lawyer who is willing to go up against Suffolk County CPS.
    The police departmet as well as the DA who does not investigate false calls which is a crime.
    I know who made the call and now we are the victims of CPS

I was recently arrested on september 26 th for a conspiracy to purchase methanphetamines and they seized my car and my phone i have 4 children and im a single mother. i lost both of my jobs due to this and cant afford an attorney i need to have someone take my case so i dont ever have to leave my babies again. i spent 6 days in the manatee county jail because i could not afford the bond they set of 20,000. i have just recently had a letter sent to me saying my sec 8 housing assistance is terminated and i dont know what to do. I have tried to contact the legal aid attorney several times to now be told i have a new attorney appointed to me im in a big circle going nowhere i go to court on nov 2 and i have yet to speak to anyone i need help to get my life back i cant have a felony charge on my record i have goals of going back to school this year for nursing im not perfect but i am a good mother to my kids and this has affected there lives as much as mine with this issue.   68. I live in San Antonio Tx. Looking for a lawyer. My son has had colon problems since he was a child right about potty training. My X wife has and enlarged colon so I think well theres genetics and tried as i could to help him deal with it. During his 13 year life Ive had the 2 of his schools call CPS and My X-mother in law. (but that was more to find a way to get at me when i was with her daughter.. in the end she helped me get custody from her daughter). Right now I just got back from a court date where they are tryng to file an “order to participate” Because This last time they got called by sons school. A case worker showed up at my house looked at every thing and told me he did not know why they had even opened the case and would see my son the next day in school and would close the case then. Then 4 months later the CPS “Supivisor calls me to tell me that the person that last had my case is no longer with them and that she would need to start all over. Then she tells me after shes going to see my son in school. just take him to the emergency room so they can look at him so i can close this case.. I get called back 2 days later .. we need to have our doctors looks at this to see if its Neglect.. by this time im starting to get a little ticked. So i wait and she calls me back to say. Ok our doctor says this is not neglect .. but it could be emotion abuse.. i want you volenteer to take services.. at this point im like not only no but hell no in a calm voice. Back to my point my son gets an apointed “Guardian” who reviews all his cps case notes and his school records tells me she for the first time in her history and an court apointed attorney that she disagrees with cps and in her letter i got in my hand here it states. “Based on the information botained thru written rocords, and interviews with witnesses I do not belive that the petitioner’s motion is in the best intrest of the child and recommend that the court deny said motion.” The district attorney rescheduled us outside to Nov 7. Why is this continuing? Can someone make this stop? I could use some help. I read some place i cant sue this state. is this true? Im not really out for the money but if thats what it takes to make CPS hire people that will do their jobs instead of tring to find faults when none are here. I read in the document the state wanted me to take a evaluation and the guarding in this paper works states. ” Lastly the department is requesting that the father undergo psychological testing, but provides no basis for doing do. there is no evidence of physical abuse. ” If someone can help. Somehow CPS found some crazy loop hole that I have never heard of to have there children removed they are with family at this time but, they say if it is any longer than a week they may take them in there custody.   75. I need an attorney in the Phoenix, AZ area who will help me get my grandchldren from CPS where they have been put in a foster home for 15 months now. I have done everyhing they have requested of me and was told by my caseworker that I would have them by the end of July. She left before that time and the new caseworker won’t talk to me, return calls, nothing. Neither wll her supervsor or her supervisor. No one will even talk to me so I don’t know what is going on. They are dragging it out forever and now I’ve learned that the foster family want to adopt them. I can’t afford an attorney but I have no voice in the courtroom. I need someone who would be willing to repesent me before they are adopted by someone else.

  77. We lost our two oldest grandchildren into the evil hands of cps. After our daughter could no longer fight the “giants” she lost her rights. We were not even considered fit to raise a dog, even though we still had our youngest at home at the age of 10. Shes now 19 yrs old & a college freshman. We never lost our grandparents rights.   80. I have 3 children that were taken from me on Jan.17th,2007 by ACDSS. I have a 14yr old daughter,12yr old son [terminally ill with CF] and a 6yr old son. I had been trying to get assistance for my family so i could take my daughter and myself to therapy and getour medications. I had been working with the CF social worker at The Children’s Hospital of Denver for 4mths before my children were taken. Cystic Fibrosis social worker and myself were both calling and placing a referrals to try to get my family assistance. We were also calling back every 2 to 3 days to check to see if anyone had gotten my referral and if I was going to get any HELP. But there wasn’t ever a answer yet. That no one had gotten my referral at this. They were not sure if their director had gotten to my referral yet or not, but the director has to asign the referral to the right case load if they were able to help my family. After trying to get assistance from 4 different referral that I had placed through state agencies on my family myself. Still also trying to get some help through the CF Social Wokers Office in the Children’s Hospital were I have been taken my 12yr old with CF to get his care since he was first seen there at the age of 9mth. I neve got any response from any of these areas. I was trying to get this assistance because I knew that I was starting to have problems with trying to keep my anxiety and depression under control. I was speaking to the CF caseworkers on a daily basis everytime my son was in the hopital. This was every 2 to 3 weeks.My son wasbeing admitted into the hospital every 2 to 3 weeks,then he would be in the hospital for 3 to 4 weeks.Then after being back home for about 2 to 3 weeks he would always be admitted right back into the hospital again. This went on for about 18 mths with every admit diagnosised with a virus but also everytime the treatment was with IV antibiotics for 2 weeks. I always questioned this with every admit. I always questioned the diagnosis and treatmnt everytime he was admitted,and I would always asked the CF staff if there were more testing that could be done? Because I didn’t like the fact that they had always diagnosised him everytime he was admitted for the whole 18mths with the same thing and no one had any concern that there was a pattern to my sons illness and there were so many admits with the same diagnosises. But I always got the same answer when I ask would for more testing. That maybe there was another underlying problem that we don’t no about.
    The CF Social Worker that I had beentrying to ge help through then went and made a report against me on Jan.10th 2007 that I have a mental illness and lots of chaos in the home . And because of my mental illness issues I was not giving my son his medicines and machines correctly and as a result of my neglance to do so my son was getting sick more often and being admitted more often.
    I then had a nervous breakdown on Jan.17th and I went to the hospital and talked to the same CF social worker that I had I been working with for help. I told her that I can’t take care of my kids right now and I need Help!
    The social worker ask me if I wanted her to plae my kids? I said NO! So we called my husband in Washington and made plans for a family friend to come and get my children and this was all agreed on by the social worker,my husband, and myself. So SW walked me down to the ER. Apparently after I was dropped off in the ER this same social worker decided to change all of the plans that we had just agreed on.
    I was taken across the street to St. Joseph’s hospital to be see by a physcitrist because SW reported that I was suicidial so I needed to be admitted for 72hrs!
    So, family friend shows up as scheduled to pickup children and was told that things had changd and she can not take my kids! That ACDSS was placing them under protective custody and putting them in placements.
    I was released from St. Joseph’s Hospital after 3 hrs of being in their ER. I was also evaluated by 2 different phystrist in their ER and was not Suicidial! So I called the ACDSS crisis team as soon as I got home, I told them that I had been released from the ER and I am not Suicidial. That I wanted m kids back and WHAT? and WHO? I needed to talk to? I was denied my children! That I needed to wait and go to court. That hey have 72hr to have a emergency hearing so that the JUDGE could inform me of the next step!!

  89. Well my story is very long but im going through the same thing as everybody else on this page. Ill start from the begrining. I got pregnant and it was planned. I was happy and so was my boyfriend. I found out when i was 4 months a long. I went to my appoints like usal and went to work like i always did. my boyfriend was still working at the time also. But our relationship wasn’t so good. He was breaking my things and we were always fighting even before i got pregnant. But i thought it would stop once kaden came along my first son. Well i kept going to my appointments with the dad and we decided to move to his moms house in Aziona. So in aust. we moved to aziona to have our child. Got there and wanted to go home already. His mom had bugs in her house and the place was falling apart. And she had dogs that went to the bathroom inside. my boyfriend and i would fight all the time because we were soo stressed out all the time. Thank god my it didnt effect the baby. Well the end of sep. came around and i went into labor in oct. with my first child had a emergicey c-section. Because his heart rate was dropping. Then it dropped soo much that when they pulled him out he was dead. they rivied him and got him back to life. I was told that after i woke up. Then we get back from the hospital and the bugs were worse then what we left. The dogs were still going to the bathroom in the house. And on top of everything we were all fighting with each other. My boyfriend was starting to fight with me again about whos going to change the diper whos going to feed him. He was good with kaden he just had to fight with me all the time about things. We got into a big fight one day and thats when i knew he cant be good with kaden. Because things just got worse. We ended up coming back to michigan thank godd. And then we were home for 2 weeks and the impossible happend. my son was crying all day long on a sunday after thanksgiving. we didnt know what to do we fed him, changed him, bathed him, talked to him, held him close, wrapped him up did everything we could. he still cried soo i was like lets take him the hospital. But instead we took him on car ride. Got home and he was sleeping. the father wanted to make him comforable soo he took him out and sure enough he started to cry i knew that was going to happen. The he fed him and tried to get him to sleep. But it didnt work soo he changed him and then tried nothing. then we went to roll him over to his stomach and thats when it happend i heard the screaming. he called me into the room holding on to him and said he heard a poping noice. i took my son and his arm was limp like it had nothing to it. I was in tears and i knew what was going to happen. so we got in the car and took him to the hospital. they ripped off his onsie and my son has brusing and scaches on his stomach i was devsted asking my boyfriend how the hell did that happen. where did he get the scatchs and he just shook his head. holding on to my sons tiny little hand was soo hard. And then they called child protective servies and my boyriend went off on the doctor. And all i could do is cry i couldnt even look at my son was soo upset. They came in and talked to us both separet. asking me what happend and i didnt know because i wasnt in the room. i was just there and heard the crying. Well then they came in and said he has sufferd from fractured ribs twice. that they were broken in arizona and re broken a week ago. And i never seen any bruising till we took him to the hospital that night it happend. Anyways he was taken away and my boyfriend was charged with 2 nd degree child abuse and i was charged with nothing. My son now lives with his grand parents who adopted him. I just had another child 2 weeks ago and they came to my home and took him because of what happend with my first child and my rights was soppose to be terminated with the first but i signed them over. and now they want to terminate my rights with this one. so i could have children again thats what they told me to do. Now im trying to get back my son. I need a good lawyer in the muskgon county or anywhere in grand rapids that can help me get my son back. All i want is to be a mother.   90. I live in East Texas.

    I have a 9 yr old boy that was forced to take Adderall, a class C, triple prescription narcotic at a boys home. Our children were removed from our home 10/2.

    He reported to us this week Tuesday that he told the boys home he would spit the pill out. They told him that if he did he would be put in the hospital strapped down and injected with a needle. This happened on the day he saw a doctor that the boys home recommended. We had a status hearing that day and had expected to take Samuel home as our counselor had recommended “monitored return at this time”. However since they were reporting behavioral problems with him, the DA said in the pre-trial conference that the judge would be upset since in the 45 days since the removal NO psychological evaluation was done, no counseling services were offered … so they send him to a family doctor at 10am that day. Oh the doctor says he’s a psychiatrist and can do the evaluations … 15 minute evaluations! He said he’s ADHD. Without our input or even a chance to encourage Samuel, they force him to take this drug.

    This child has been in the same school district all his life. He has resided in the same residence all his life. He is in the gifted and talented program at school. He has only 1 behavior incident in his record for “disruption”. Since his removal he has been physically and emotionally abused. I can’t even believe that I am living in the United States of American with this happening.

    On Thursday, Samuel had a scheduled psychological evaluation with a good psychologist. It was recommended that he didn’t receive anymore further testing until either me or my wife could help Samuel understand and calm him down. Now CPS has decided that Samuel should be admitted to an inpatient assessment center. The boy is just so scared. And why not? I have told him all his life to NOT accept drugs! He has seen the destruction of drug as his mother has fought addiction all his life. This boy is being misdiagnosed and this is just such a perfect case of abuse in the system. When I tried to request CPS records, they responded with a 90 day waiting period in this area. I guess I have to subpoena the records. I know they are scared in this case and their is a report that Samuel was fighting and kicking and spitting out the pill from the boys home.

  95. Beverly, because of folks like Linda and Leonard and Al and scores of others, CPS has had investigations, courts have been opened and folks are networking.

    This is an industry and it feeds many hungry mouths. If you think that this runaway train can be stopped in a year or two, you are sadly mistaken.

    Even Walter Mondale, who proposed CAPTA, was chastened by the spectre of what HE created.

    Most folks are aware that CPS is sadly deficient.

    Try telling that to legislators who by and large are attorneys who benefit from vague, unconstitutional statutes.

    At one time, we considered a Parents March on Washington, and that idea is still viable.

    Many folks have helped to reform and tame CPS somewhat over the past decade.

    Richard Wexler, Martin Guggenheim, even Seligman ( former APA President) all know about the real failings of CPS.

    It’s all about the J-O_B_S.

    If little people get hurt, that’s the price of doing business.

    If kids get harmed, the rationale is they are the underclass anyway, who cares about them?

    And plenty of folks in a number of states have sacrificed muchly to give the newbies some sense of security.

    I always suggest that folks look at AFRA

    Special ed groups ( for parents with special needs kids) is another fertile area for folks to meet and lobby.

    The real corruption, is in the secret money, no-bid contracts and bought employees.

    Heck, just this month KY did a big expose on CPS. I see a huge sea change in the state of KY.

    Things are changing. Attorneys want and deserve to be paid–and there are folks who warrant CPS interventions.

    Drugs are the main cause of parental neglect, and no one on this site nor anywhere else supports truly neglectful parents.

    The problem is that CPS is difficult to sue b/c of their governmental immunities. Some court decisions have backed up our activism.

    A Mom in Orange county Calif was awarded close to 5M for DCFS’ unlawful conduct.

    The problem is parents who successfully litigate must be pretty snow whitish.

    That is, totally innocent. But things are changing from when Richard Wexler penned his book, ” Wounded Innocents” which exposed the dark underbelly of CPS.

    But the whole structure of US employment is changing, and folks who have been to college need jobs.

    I have had University Professors address my professional group, and spout this. So, if your kids are taken, the Profs have their jobs and the social work majors have their *make-work* jobs.

    Linda calls such jobs *unworthy* and especially castigates foster caretakers.

    The essence of the US economy is business—and yeah, CPS makes and creates jobs.

    The sad part is that most of what CPS does—take for example, court custody evals, were put in place without any scientific study or validation.

    And see just how brutal and arbitrary custody evals ( done in Family Court everyday) are foisted off on folks.

    Until you have had a tragedy like your family has had, it is difficult to comprehend or empathize with them.

    Most of us do care….And do see some improvements…..

    Thanks to all the Calif crew who have made valiant efforts to reform CPS lo this past decade.

    Let us hope that folks in other states, like Kentucky, can continue the good fight.

    Because it is for the benefit of the children and for those who have yet to meet up with the chilling cw.

  96. DHHS has taken my children away. They have never been abused and willing admitted this in court, yet since they dont like the father of one my children they have removed 3 out of 5 of my children. I still have custody of my 7 and 4 year old, but they took my 14,11 and 6 month old. The judge said there was no abuse done to my children, but they were going to stop it before any abuse occured. What can I do to protect my children and remove from the danger of DHHS.

  97. My mother is fighting social services for rights to her two youngest children. I am there oldest sister and I’m writing because my mother raised the children by herself without there fathers. i was there to witness everything she did to make them the happiest kids they can be and now my little my sisters father is an alcoholic and i feel the kids are not safe I’ve seen him drink and drive many times without a thought of it being wrong. sisters father who made hardly any effort to see her not to mention no effort at all to see my little brother, has temporary custody of both children and limits family time ( sisters, nieces nephew brother) with them to 15 min on Sundays 1 hour a month to share on the phone. i was there for the kids more then he has still. my mother has done everything she can do and still only gets 1 hour a week for visiting with them and its supervised. i found this site and started crying because this is exactly what my mother has been looking for. please answer our prayers. help us with a good defense.. please help

  98. CPS has my two granddaughters, and from the beginning said they we’re taking my daughters parental rights. Her first Attorney fought for DHS not Koby, fired him. My attorney filed for my right to intervene and the cps home study worker said my house was not fit(lie), we remodeled and still are doing more. My daughter keeps messing up, so now their trying to say I no longer have any right to be at court, but I still get 1 Whopping hour a month supervised with the girls. I need a lawyer that knows how to fight against the cps in Cedar Rapids, Iowa Linn county Iowa. I’m desperate and afraid of the abuse their getting from the foster home. The 2 yr old couldn’t walk due to some injury at the foster home. I have pictures, so I’m bad.Please help me I have cash and will pay an attorney . Grandma misses her granddaughters. Thank you!

My case with CPS is closed, however, CPS has given my children to their father whom has a criminal sexual history and had been placed on the sex offender list. CPS has manipulated and falsified many items, retained “professionals” whom have histories that are quite concerning and have letters of admonishment by the licensing board. My son is two yrs. and these foster fathers have had him for 1 and a half years already, now i am fighting the two foster fathers as cps stepped out leaving my rites intact but my son with the foster fathers, My mother passed a home study as did I and , when my now two year old was seven months I was pregnant with my little Joshua, and we (josh and I fled to wisconsin where I have family, as the Houston Cps would have taken Joshua,too.I did everthing I was told to do and they never returned my son, which goes against their own mandate..to return a child to family, I wonder if these two foster guys bribed anyone…..I am very close to broke due to the last year and half, also very sad and can’t believe this has happend. Help….Someone find me a lawyer in Monmouth County NJ who will allow me to make payment plans…I’m low income caucasian who lost my 14 yr old son to Dyfs custody while I was just one week in a local psych ward for treating my one bipolar episode..which I haven’t had in 11 years…Dyfs is saying I have a long history of mental illness, (BS) because my mother whom they placed my son with temporarily told them I was diagnosed bipolar 20 years ago. Now I have to go to a Day program and I have court tomorrow but my public defender is not fighting hard enough to get my son back. He’s a jerk and goes along with whatever Dyfs orders…and so does this judge. I’ve had sole custody of my son for 11 years since I left his father in Israel and his father has not even tried to contact him all these years..though I use to call him. My son is a gorgeous boy who is miserable staying with my 84 yr old mom, I have never abused or neglected by son and now they are discriminating against me due to bipolar label. I am not a bad case of this anyway and want my son back NOW…I feel my civil rights are being violated and want to file a lawsuit for the 3 months my son and I have suffered thus far. I get to visit him but he wants to come home, and they won’t even let him speak at age 14 in the court room……Dyfs worker told me last week their psych evaluation came back positive for me and my son and it looks good but there will be stipulations they say if and when I get my son back..Screw their stipulations, I’ve been able to raise my son all these years and I had one minor breakdown due to a boyfriend’s threats, went to a local hospital with my son, the ER called Dyfs in, and the rest is a nightmare for the past 3 months..They are holding my son hostage. By the way, my son is considered an Israeli citizen too, can I run away there? Nah, that would be kidnapping at this point..Ridiculous..I need a lawyer to get my son back ..all we want to do is move out of NJ to another state and live out our lives without this craziness…….I need the custody back now…if they put stipulations down tomorrow in court, I will appeal them but want a lawyer.

My name is Leigha Hoffner and like many of you i have a horror story about DCFS however I am going to take action I have a court date on December 20 at 10am in the cook county juvenile courthouse court room 2B. I am asking anyone and everyone who has problems with DCFS to please contact me so that a press conference about my case and other cases can be addressed while a worker and supervisor are present. We reside in Coryell County in Texas. and had to place my daughter into CPS custody due to sexual behavior problems due to my insurance not willing to pay for treatment for her anymore at the RTC she was at. They placed her in a theraputic foster home where she was suppose to be the only child in which she was not there is a smaller child who is 3 there along with another foster child who is 9 that just got there 3-4 weeks ago. Then the foster parents leave her in care of their son who is not an appropriate care giver. Also, the foster mom has neglected to get my daughter her flu shot and lipid test done in which she has been reminded several times. Also, it was told that my daughters level dropped to moderate and they would be moving her closer to us so we can start visitiation and family therapy but that was 3 weeks ago and found out today that she is not moving until during xmas break so she wont miss school. But yet we have a permency hearing in Jan. How are we to get her back if we cant do all the requirments like have the supervised and unsupervised vists and family therapy? That is why I need help to try to find a lawyer to see if someone can help us in this matter.

  113. Has anyone ever fought CPS in South Carolina, especially Anderson County?? My girlfriend’s son has been falsely accused of “causing great bodily harm” to his 2 month old son, born prematurely and likely suffering from “brittle bone” or Osteogenesis Imperfecta . My girlfriends family has a history of this syndrome, yet CPS has guaranteed her that her son will “go down” for this and that she will not get custody of her grandson. The father and mother have both been incarcerated since November 21, 2007 and only the father has thus far been assigned an attorney/public defender, and a sad one at that.This is occurring in Anderson, South Carolina and my girlfriend/the grandmother lives in Concord, NC. She is working class, single mom still raising two more kids at home, so her funds are very limited but I want to find her help in any form I can. CPS down there has already tried and convicted her son (in their minds) and are throwing up roadblock upon roadblock for her. HELP!!!

    There is a Federal lawsuit pending v DCF in FL for wrongful medical on the part of CPS there.

    You might also want to Google and see if there is an OI foundation or such group who will help with good doctors, etc. for trial.

    In NY, just past week, a child with 14 fractures under 4 months old, was deemed NOT to be victim of child abuse.

  116. OH MY GOSH!!!! FCS/Private Mediators really know how to damage families across the USA!! I am in N. California dealing with Sacramento County. My Ex has managed to violate court order after court order and nothing is being done. I can’t afford an attorney and his is a #@$%^&* The private mediator is all about giving the person paying what they want regardless if its in the best interest of the child/children. Can anyone or does anyone have the same CRAP happening to them in SAC County? I need HELP to stop this non-sense.. My child is paying the price and is now going to counseling.. The innocent are being damaged. HELP HELP HELP

  117. California SLO county has violated my daughters civil rights by placing her in a locked mental facility, in the Los Angeles area, against her wishes. They have no legal bases for doing so but somehow have managed to keep her there for over 1 month now. She is 18 years of age.
    Prior to this SLO CWS placed her in an inappropriate placement that resulted in an Amber alert being issued on her. Lucikly she found her way back to the placement. CWS allowed her to remain there for 6 days without her medication, no money and only the clothes on her back. Now if that is not a violation of ones civil rights I honestly don’t know what is. I have tried to contact several attorneys in the Los Angles area but have had luck in finding one. So I’ll post here and hope that someone will see this for what it is.

  118. Thanks Fern!!! We already know about the OI Foundation site. The additional info about the Fla and NY cases is strong information. We can’t get over the fact that they treat her as if she has no interest or rights, or that her son doesn’t either. They are quite arrogant in the way they treat people and act as though their decisions are final and law. Good luck to anyone fighting CPS. Honestly until now, I never knew the true injustices committed by CPS, apparently nationwide. We’ll keep you updated and share anything we learn.

    I am outraged at the abuses that are occuring in this country. Brenda Scott’s book “Out of Control” opened my eyes and my company is now dedicated to defending families.
