		<description>I read the blog.its so scary to think this could happen to anyone of us at any time. Since our involvemment with CPS we are leary of anyone my kids have contact with including teachers (especially teachers and school staff) it seems they are the ones to jump to quick conclusions about things.</description>

		<description>Linda, I urge you to google Roska v. DCFS (Utah)   10th Circuit Court of Appeals which is now deciding on damages for Roska family whose pre-teen son was spirited away from family on kooky ( and not a medical ) dx of MSBP.

It directly contradicts the 9the Circuit ruling this week from your Calif. Court of Appeals.

Both cases cover faulty MSBP diagnoses and the kidnapping of kids based on such.

Difference is: 10the Circuit  (Utah, MT, WY, NM) took a pre-teen when not even their family doctor supported or agreed with diagnosis.

Currently the court is holding on DAMAGES, AND PERSONAL LIABILITY OF CASEWORKERS, SUPERVISORS.

However, in your neck of woods, Calif 9th Circuit declined to hold cw personally liable in the kidanpping of infant on MSBP charges.

The rulings are or were announced this past week.

Very important, especially for families in WEST, with dx of MSBP.
