Child Protective Services laws and agencies are abusive to families and children. This site provides support and information to parents falsely accused of child abuse by Child Protective Services.

FightCPS does not advocate or condone violence or illiegal activities of any kind.

FightCPS is intended to help people learn enough about the law to be able to successfully defend themselves and their families against false accusations using legal documents and strategies that put parents in a stronger position when they go back to court.

For more information, see the FAQ.

Child Protective Services, CPS, has devastated and destroyed hundreds of thousands of families in America during the last thirty years leaving a trail of broken hearts, broken dreams, and shattered childhoods.

Rather than helping families, government agents have used unconstitutional laws in Juvenile Court to rip children away from their loving parents, break asunder God-given, natural, parent-child bonds, and adopt the children of the grieving out to others who profit financially with large monthly adoption subsidy payments.

Child Protective Services must be stopped! The law that started this, CAPTA, must be repealed. We must work tirelessly to inform the public of this very dangerous travesty of justice. We must keep faith knowing that if there is a God, there is an answer and a way to end this heartache.

Child Protective Services Agents - please come to your senses! Family destruction on false or trivial grounds is wrong, reprehensible, and inhumane.

Fosterers - be aware that for the money you get you are holding much-loved children away from their grieving families while the parents are forced to perform a service plan that is anything but a service to them. I call this hostage holding for the government. This is not kindness - to help misguided government agents destroy family relationships and break loving bonds.

CPS workers and fosterers - I ask that you now let the children of the innocent return to their homes where they are truly valued, adored, and loved by the parents God gave them.

Family rights are God-given rights. And they should not be ignored or postponed. Every moment these loving parents and children spend separated from one another is a torment beyond what anyone should ever have to bear.

It is unworthy of human dignity to allow this terrorism and torture of families to go on without saying something, speaking out, and trying to make a change.

Site mission: To provide information and support for families attacked by Child Protective Services and child welfare agents, especially those families facing false or trivial accusations of child abuse or neglect; and for researchers working to protect natural family rights.

Washington: Spokane City Councilman Exposes and Lambasts CPS

Spokane City Councilman Bob Apple launched an outspoken attack on a CPS social worker he claimed submitted false court documents in a child welfare case involving a former employee and campaign volunteer, Daniel Morgan. The City Councilman stated that CPS kidnapped a 2-year-old child, and that the assistant attorney general should be jailed.

From the article:

“It’s a sham… If this is how the court system operates, then it’s broken.” – Bob Apple

Of course CPS said that the charges were “ridiculous” because they go to court and state that the child is “at risk of imminent harm”.

In this case the ex-husband of Morgan’s wife has made accusations against Morgan in a custody dispute.

From the article:

Since 2002, the state agency has received a “number of referrals related to parental neglect of the children and alleged physical abuse of the children by Mr. Morgan,” according to the court documents. A state spokeswoman said she could not disclose how many of the complaints were made by Allen…..The Morgans said Allen has used the referrals “as payback” and to gain custody of the two children he had with Robin Morgan.

Now, this next part hits home with me:

“Unfortunately, in this field, when the custody of children is involved, everyone involved is willing to lie,” said Dave Wood, a lobbyist for Washington Families United, a nonprofit group seeking reforms to the child-welfare system. “You don’t know what the truth is. Something has to change.”

I find that so true – that too many people are willing to lie to get custody. That includes social workers, ex-spouses, girlfriends of ex-spouses, etc. And I plead with each one of you that if you’re in this situation, stay with the truth. Lies lead only to confusion. If you tell the truth, at least when it is all over, you still have your integrity.

City Councilman Bob Apple will advocate for any citizen that contacts him. Perhaps you might want to print out this article and take it to your city councilman (or woman) to see if that person is willing to go to bat for you. I’ve contacted my county supervisor several times, including for an issue involving CPS, and every time she’s been a great help and everything turned out perfectly.

  1. I located the article in the Spokesman Review this morning. I was very interested in the article because it sounds so similar to my current experience with CPS. They have actually retaliated against me for calling them kidnappers for taking my baby from me.

I am interested in speaking with anyone who can possibly assist me with taking my case to the public and any other person or agency who can help me free my child from the grip of CPS.

    My contact information is:

  2. I’m so sorry they took your child from you, Denise. I hope your baby is safe at home with you now. Good luck with your case.

  3. To Denise, May i suggest you take a look at Website:

    http://www.familyrightsassociation.com

There you will find some names and numbers of members in each state.

There are advocates and individual state Websites mentioned there
    also.

  4. To Linda,

Folks might be interested in knowing that there is currently a trial going on in the 10th Circuit Court of Appeals which goes directly against immunity for casewokers.

It is the Roska trial in Utah. Google it folks, easy to find.

Caseworkers there may be INDIVIDUALLY LIABLE FOR REMOVING A CHILD FROM THE HOME OF A FAMILY WHOSE MOM SUPPOSEDLY HAS OR HAD MSBP.

Very important for those living in those Western states covered by the 10th Circuit.

Also, in California, ( 9th Circuit Appeals Court) just this week ruled against family for another MSBP removal which the parents term inappropriate, since it appears Mom was never even dx as MSBP. From the facts cited, it seems that that it was solely a cw decision. It sounds as if NO PHYSICIAN even dx Mom as having MSBP.

So, just this week there are 2 absolutely counter court holdings on the subject of MSBP. ( And even more important it looks as though UT may pierce cw immunity and hold them personally liable for wrongful removal.)

Note that the subject of not providing services to families b4 removal was mentioned in fact patterns.

Roska is in Utah ( 10th Circuit) and folks should note that the lower court has ruled that cw’s are liable for the unjust removal of the 12 yo young man.

She is suing for lawyer compensation and to stop DCFS in Utah from predating on other families.

Please folks, note that her family physician was in support of Mom, as was the family’s stable caretaker for the boy who suffered from a documented disease process.

THIS WILL BE BIG FOR FAMILIES LIVING IN UTAH, NM, WY, MT. Someone should look up just what states 10th Circuit Covers.

This story begs out for your front page.

What is interesting is each was accepted by the Appeals Court and that it may be that California Appeals Court seems to be more conservative ( seem to support CPS) than the truly conservative Utah Appeals Court.

Keep up the good work, Linda.

    Best. F.

  5. I have had a couple of visits form our lovely DCFS workers here in Utah also. My Husbands mother works for them in salt lake city and after a disagreement with her (I was 8 months prenant with my third child) she made threats to me and my family about having our kids taken away. well of course we didn’t let her know when he was born. when I had my 2nd child we told her she wasn’t allowed to take her out of the room because she didn’t have a wristband. she told us all she had to do was show them her DCFS badge and she would be able to walk right out of the hospital with her! Very disturbing! about a week after I had my son we had a visit from DCFS, stating that our house was filthy and we had dog crap all over our house and dirty diapers. when they searched my house they found none of that. We didn’t even have a dog. his mom wasthe only one who didn’t know we had gotten rid of it a coiuple months before. then we had another visit about a year ago stating that we were mistreating our children. they had to take my almost four year old child into a seperate room to ask her questions! They ended up finding nothing out of course, but it is really humiliating to have to be investigated when you know you have done nothing wrong! My heart goes out to all of you that have actually had your kids taken wrongfully! It boggles my mind that these peoples job security depends on the misuse of children!! Everytime my door bell rings and I’m not expecting anyone my heart nearly jumps out of my chest in fear that my husbands wonderful mother is trying to get our kids taken again!!

  7. I have learned to navigate the DSHS website to request records on my case. The DSHS has a forms section to click on and get names of documents. The CPS has a Manual they go by or rather they ignore in order to get their jobs half done. In Washington www1.dshs.wa.gov then find manuals, Children’s Administration Practices and Procedures Manual, Knowledge is power, I’m taking them to Administrative Law Court, Fair Hearing where CPS will have to explain their actions, now I am a paralegal student who when finished will write how to fight CPS book and my experiences. I had to start my battel because my public pretenders could care less, my current one is better but she does not have the time to fight adequately for me, I can proudly say CPS turned me into a fighter with their unethical tactics and incompetent social workers.

  8. I was born and raised in Seattle and graduated from Franklin High School in 1956. I married in 58 and from that year on, my husband & I raised two wonderful children and remained happily married for 50 years-this year. We have moved several times for my husbands job relocation. This made the four of us stronger as far as a family. We have never had problems with the law or been in court for any reason.
Our two children graduated from college in Texas.
Our son became involved at 40 with a very attractive, but, very promiscuous woman who drank alcohol incessantly & it seemed to my husband and I, she was never sober. We found soon after they married, she was bi-polar and unfortunately, pregnant. Our granddaughter was born in 2003 and since her birth, our son has been harrassed by CPS because of false accusations by the mother of his child and vicious lies from CPS. Our son is a very loving parent and cherishes his baby girl, but the alcoholic mother’s money-grabbing attorney (by the way….he’s being paid for by one of the mother’s bed partners) and CPS. CPS has taken her away from her father and us, the grandparents. Us, because our son has to have supervised visits a couple times a week…supervised, mind you, by the mother…and……the mother doesn’t like us, mostly, I suppose, because we live a decent life. This is so wrong since we are the ones that always lived a God loving, decent life. The mother of our grandaughter is a very bad person and a very bad mother. It’s been 3 years now and our son is losing all he worked to gain in his life because of the costs involved in fighting to have his daughter returned. He had to let the attorney go, he will lose his home next month, he lost his job from too much time off of work and he is so disillusioned from the way our justice system works. CPS should not be controlling our family’s life. Most the workers we have seen, have not even been in this world long enough to be making judgements on my family.
I guess I am asking for help from someone in my home state who may care about a home grown gal who finds all this from CPS and attorneys, so hard to believe
We cannot help him financially while on a small pension and soc. sec. Can anyone offer me something that doesn’t cost our home to help get our GRANDDAUGHTER BACK TO A REASONABLE LIFE and take away these mindless judgements etc. by all the states Child Protective Services?

  10. I recently found that my daughters mother lied to the courts and had her parental rights taken away, along with mine(unknowingly) because she told the courts that she didn’t know my whereabouts.
CPS had all of my info because I gave it to them!!!
I new that something was going on but not to that extent.
I am currently trying to get my daughter back but the system is so hard to navigate through.
If anyone has information that could help I would be in your debt.

  13. I believe that the cps system needs to be done away with. Because there are too many children taken from their families. Cps lies and falsifies the reports that they give to the courts. I know this because my fiancee and I are both victims of the system, and we are both suffering from the undoings of the CPS system.
